AN ORDINANCE VACATING EIGHTEEN (18) FEET OFF OF THE NORTH SIDE
OF THAT PORTION OF SOUTH "M" STREET RUNNING WEST FROM SOUTH 5TH
STREET TO THE FIRST NORTH/ SOUTH ALLEY AND LYING ADJACENT TO LOT
NUMBER 580 IN THE BEALLVIEW ADDITION.
WHEREAS, Norman and Maxine Notoras and James Clements have
petitioner) the Common Council of the City of Richmond,
Indiana requesting to vacate eighteen (18) feet off of
the north side of that portion of South "M" Street
running west from South 5th Street to the first
north/south alley; and,
WHEREAS, the Common Council, pursuant to the provisions of I.C.
36-7-3-12, conducted a public hearing on said vacation
petition on� --- , 1989; and,
WHEREAS, a study of this Ordinance was conducted by the Richmond
City Plan Commission the W.7 day of Zblc� �
1987, at which time remonstrances were heard from all
parties interested in or affected by this Ordinance;
and,
WHEREAS, the vote of the Richmond City Plan Commission wash
to p in favor of/in
recommending passage of Ordinance No. 67-1987.
NOW THEREFORE BE IT ORDAINED by the Common Council of the City
of Richmond, Indiana, as follows:
SECTION 1. That subject to the preservation of all easements
for existing utilities, the public right-of-way
described below is hereby vacated:
Being a part of sixty (60) foot street, all in the
Beallview Addition to the City of Richmond, Indiana as
recorded in Plat Book 4, Page 90, Wayne County
Recorder's Office, Richmond, Indiana, and described as
follows:
Being an eighteen (18) foot strip lying south and
parallel to the following described line;
Beginning at the Southeast corner of Lot 580 said above
addition; thence West along the south line of said Lot
580 to the southwest corner of Lot 580 said above
addition.
SECTION 2, This Ordinance shall be in full force and effect
from and after the passage and approval as by law
required.
