A Special Council Meeting of Savannah Beach City Council
was called for 7:00 P.M. this evening for the following purposes:
1) Discussing again the facility plan involving the various
local governments, etc, which will be explained by Mr.
Howard Bellinger of the Metropolitan Planning Commission.
2) Discussing with Mr.Joseph Hutton the problems we are
encountering with the Federal Grants for our sewerage
system in taking the necessary action to get them moving.
This meeting was presided over by Mayor M. J. Counihan and
a quorum consisting of the following Councilmen was present:
Richard DeLoach, John Wylly, Ernest Hosti, James Bond, Edward
Fahey, Joseph Agnew. City Attorney William H. Pinson, Jr. was
also present.
Visitors attending the meeting were: Mr. Howard Bellinger,
Executive Director of the Metropolitan Planning Commision, Mr.
William Saxman, Planner, Metropolitan Planning Commission and
Mr. Joseph J. Hutton of the engineering firm of Thomas and Hutton.
The meeting was opened by Mayor Counihan who then called
upon the Clerk to read the reasons and purposes as to why the
meeting was called. Following this the Mayor called upon Mr.
Howard Bellinger to explain this Facility Plan which would
involve the various local governments in the Chatham County
area and which would make the City of Savannah the lead applicant
in future requests for Polution Abatement Grants.
Mr. Bellinger explained fully the need for such a plan in
regard to applications for future 201 Programs and strongly
urged the Council authorize the Mayor to sign a Letter of Intent
addressed to Mr. Rock Howard of the Environmental Protection
Division of the Department of Natural Resources of the State of
Georgia stating that the City of Savannah Beach, Georgia was
aware of the need for this community's participation in the
development of a Facility Plan for all of Chatham County as a
result of the Governor's non - deisgnation of the Chatham County
area. Mr. Bellinger further stated that the letter was simply
to advise that the City of Savannah Beach intendsto participate
with the City of Savannah as lead applicant in the preparation
of an Environmental Protection Agency, Step One Grant Applications

for a Facility Plan encompassing the Chatham County area and
requesting that we be kept informed of developments in this
program.

Following Mr. Bellinger's explanation a motion was made by
Councilman Edward Fahey that the Mayor be given authority to
sign this Letter of Intent. The motion was seconded by Councilman
Bond and unanimously carried.
The Mayor then introduced Mr. Joe Hutton to tell us about the
problems that we were being encountered with our Federal Grants
for our sewerage system so that the necessary remedial action may
be taken. Mr. Hutton stated that the City had been informed by
letter of September 13th concerning the status of our Beach
'Erosion Project #C13035301. This letter from Mr. James R. Baker,
Engineer, Municipal Engineering Service, Department of Natural
Resources, Environmental Protection Division, outlines the
necessary steps which must be taken to get our Grants moving.
They are as follows:
1) Savannah Beach had to formally request an increase in
their Step Two Grant to cover the costs of the Infiltra
tion ::Analysis and Evaluation Survey.
2) A Resolution authorizing the preparation of an application
to the Environmental Protection Agency for Step Three
Construction Grant under provision of P.L. 92 -500 and
also authorizing the execution of all forms of applica-
tions on behalf of the City of Savannah Beach for this
project and that henceforth, all documents so executed
will be valid and will reflect the intention of the
City of Savannah Beach.
3) Execution of Statement of Step Three Assurances.
4) Statement regarding Operation and Maintenance.
5) Requested Schedule of Payment
6) Certification of Site by City Attorney.
7) The Executed Application.
Mayor Counihan then requested the Clerk to read the letter
to be signed by the Mayor addressed to the Department of Natural
Resources formerly requesting an increase in our Step Two Grant

Award to cover the costs for the preparation of:
A) The Infiltration /Inflow Anaylsis.
B) The Sewer System Evaluation Survey.
C) The Plans and Specifications for the Rehabilitation
Work recommended by the survey and determined eligible
for Federal Funding.
LETTER REQUESTING INCREASE IN STEP TWO GRAND AWARD
Following a reading of the letter a motion was made by
Councilman Edward. Fahey that we request an increase to seventy -
five percent (75%) of Sixty Four Thousand and Seventy Two Dollars.
($64, 072.00) which would amount to Forty Eight Thousand and
Fifty Four Dollars ($48,054.00) to cover the costs of the prepa-
ration of this Analysis Survey and Plans and Specifications for
the rehabilitation recommended by the survey. This motion was
seconded by Councilman Jim Bond and unanimously carried.
Mr. Hutton stated that the Enviornmental Protection Agency
had sent a batch of new applications stating that the forms had
been changed and that new applications must be submitted on these
forms.
Mr. Hutton stated that the next thing to be adopted by Council was
the Resolution authorizing the preparation of the application and
naming M. J. Counihan as Mayor of the City of Savannah Beach to
execute all forms and applications on behalf of the City of
Savannah Beach for this Project. The clerk then read the following
Resolution:
RESOLUTION
This Resolution called for the signatures of the Mayor and City
Clerk and all six Councilmen. Following its reading, Councilman
Richard DeLoach moved that it be adopted. Councilman Edward Fahey
seconded the motion and it was unanimously carried.
Council then authorized the Mayor to sign this Statement of
Assurances for P.L. 92 -500 Construction Grants,Statement Regarding
Operation and Maintenance; together with requested schedule of
payments, copies of which are attached to and form a part of the
Munutes of this meeting.
Mr. Hutton then stated that there was one other thing
necessary to complete all of the items needed and that was a
Certificate of Site Availability to be signed by the City Attorney.

Mr. Hutton stated that he had been trying for over a year to get
the Savannah Beach City Attorney to sign such a certificate, to
no avail. He stated that he had sent one today to Mr. Bill Pinson,
the present City Attorney.
Mr. Pinson stated that he had received the Certificate of
Site Availability for his signature and that he would like to
comment on it. He said that this Site Certificate, which the
Environmental Protection Agency required, necessitated him
certifying to them that the City has title to all of this property
involved with our Water Pollution Control Facilities. Mr. Pinson
stated further that he was at a disadvantage by not having all of
the files on this but he said he had been in contact with two
people whose property was in controversy, Baron Burke being one and
Mitchell Dunn being the other. And based on these two cases he
stated that he could not certify the City's title in it. That he
therefore, could not execute the Site Certificate based on his
present knowledge. Mr. Pinson stated further that this was
definitely a problem due to the fact that he felt that Mr. Dunn
would file suit against the City and that Mr. Baron Burke had
already filed suit against the City for encroachment. In regard
to this Certification of the Site Plan, it was decided that in
lieu of this certificate we shall state to the Environmental
Protection Agency that our attorney is looking into this and he
will be in touch with them.
Following a discussion in regard to the committee to be sent
to Atlanta to keep the appointment with Mr. Joe Tanner, to call on
the Environmental Protection Agency, and the Environmental Protec-
tion Division of the State in regard to our Polution Abatement
Grants, Councilman Ed Fahey moved that Mr. Jim Bond, Chairman of
our Beach Erosion Protection Project, accompany our City Attorney
Mr. Bill Pinson to Atlanta in lieu of the larger committee which
had previously been designated to go.
There being no further business the meeting was adjourned
to the next regular or special called meeting.

On June 30, 1973 the Environmental Protection Agency awarded us a Grant of
$15, 180.00 for the design of 5 pumping stations and 3 interceptor sewers. Subsequent
to this award we were required to make an Infiltration /Inflow Analysis and a Sewer
Evaluation Survey.
As a result of the Sewer Evaluation Survey, rehabilitation of sewers was found
necessary and some of this rehabilitation is eligible for E.P.A. participation. The
cost of work included in the Step 2 phase is estimated to be:

RESOLUTION - STEP 3 GRANT APPLICATION
WHEREAS, the City of Savannah Beach proposes to construct projects for the
abatement of water pollution consisting of wastewater treatment works,
and
WHEREAS, the City of Savannah Beach is eligible for Federal grant assistance
under Title II of the Federal Water Pollution Control Act of 1972,
P . L : 92 -500,
NOW THEREFORE IT IS RESOLVED that the City of Savannah Beach prepare and
submit an application to the Environmental Protection Agency for a
Step 3 construction grant under provision of P.L. 92 -500 .
IT IS FURTHER RESOLVED that the Mayor, M. J. Counlhan for the City of Savannah
Beach is authorized to execute all forms and applications on behalf of
the City of Savannah Beach for this project, and that henceforth all
documents so executed will be valid and will reflect the intentions of
the City of Savannah Beach.

STATEMENT OF ASSURANCES
P. L. 92 -500 Construction Grants
The applicant hereby gives assurance and certifies with respect to the grant
that:
(1) It possesses legal authority to apply for the grant, and possesses the
institutional, managerial, and financial capability to construct, operate, and maintain
the proposed facilities; that a resolution, motion, or similar action has been duly
adopted or passed as an official act of the applicant's governing body, authorizing
the filing of the application, including all understandings, and .assurances contained
therein, and directing and authorizing the person identified as the official represent-
ative of the applicant to act in connection with the application and to provide such
additional information as may be required.
(2) It will have sufficient funds available to meet the non - Federal share of the
cost for construction projects, and agrees to pay the non- Federal costs. Sufficient
funds will be available when construction is completed to assure effective operation
and maintenance of the facility for the purposes constructed.
(3) It will cause work on the project to be commenced within a reasonable
time after receipt of notification from the approving Federal agency that funds have
been approved and that the project will be prosecuted to completion with reasonable
diligence.
(4) It will operate and maintain the facility in accordance with the minimum
standards as may be required or prescribed by the applicable Federal, State and local
agencies for the maintenance and operation of such facilities .

STATEMENT REGARDING OPERATION AND MAINTENANCE
35.925 -10 An Operation and Maintenance Manual has been prepared for the
Waste Treatment Plant and Pumping Stations constructed under C130205.
This Manual will be amended to include the new Pumping Stations and
its procedures for maintenance followed.
35.925 -11 The User Charges are based upon the quantity of water delivered
to each user. The charges conform to Model No. 1 of Appendix B. Federal
Guidelines.
35.925 -12 There are no industrial users of water and sewerage. The Zoning
regulations do not permit waste producing industries.
