A RESOLUTION OF THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA; AUTHORIZING
THE FIRST SERVE AT THE ERICSSON TO CONDUCT A
CHARITY PROGRAM WHICH SHALL BENEFIT THE
COMMUNITY PARTNERSHIP FOR THE HOMELESS AND
THE ASHE-BUCHHOLZ TENNIS CENTER AT MOORE
PARK; PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, The Ericsson Open Championships in conjunction with the First Serve at the
Ericsson desires to conduct a benefit program for the Community Partnership for the Homeless and
the Ashe-Buchholz Tennis Center at Moore Park on Tuesday, March 22, 2000 (or thereabouts) at
the Tennis Center at Crandon Park, (the "Event"); and
WHEREAS, Miami -Dade County in their letter dated June 9, 1998, marked Exhibit A and
attached to this Resolution, addressed to the Village Attorney, Joseph H. Serota, Weiss Serota
Helfman Pastoriza & Guedes, P.A., provided the Village with assurances that the agreement of the
Village to permit the Event will never be considered by the County as a waiver of the Village's right
to enforce the Declaration limiting the use of the Tennis Center at Crandon Park in the future, and
that the Village's agreement to allow the Event will not be considered an admission of any kind that
this Event or future events are consistent with the Declaration.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF THE
VILLAGE OF KEY BISCAYNE, FLORIDA AS FOLLOWS:
Section 1. The First Serve at Ericsson Fund Raising Program Event on March 22, 2000, or
thereabouts, is hereby approved in reliance upon and in accordance with the terms and conditions
as outlined in a letter dated June 7, 1999, marked Exhibit B and attached to this Resolution,
addressed to the Village Manager from the Vice President, Community Affairs, Ericsson Open, Mr.
Tom Annear, and subject to the condition that all net program proceeds shall benefit the Community
Partnership for the Homeless and the Ashe-Buchholz Tennis Center at Moore Park.
Section 2. The Declaration concerning the use of the Tennis Center at Crandon Park shall
remain in full force and effect, and the Village reserves the right to strictly enforce such Declaration.
Section 3. This resolution shall take effect immediately upon adoption.

Miami -Dade County ("County'); Miami Dade County Commission Resolution
No. R-415-95
Dear Mr. Serota:
This letter is in response to yours ()flu= 2, 1998, which contained the following
paragraph:
First Serve at the Lipton has once again asked the Village to allow this
event [a concert benefiting the Community Partnership for Homeless, Inc. and the
Ash/Buchholz Tennis Center at Moore Park] as part of the Lipton festivities for
1999. The Village Council has agreed to allow the concert with the express
understanding that the County stipulates to certain legal issues. That is the
purpose for this letter. Specifically, the Village wants an assurance from the
County that the agreement of the Village to permit the event will never be
considered by the County as a waiver of the Village's right to enforce the
Dtclaration in the future. The Village also requires a stipulation from the County
that the Village's agreement to allow the event will not be considered an •
admission of any kind that this event or future events are consistent with the
Declaration.
The purpose of this letter is to provide the Village of Key Biscayne with the assurance
and the stipulation requested in the foregoing paragraph. Specifically, the agreement of the
Village to permit the event will never be considered by the County as a waiver of the Village's
right to enforce the Declaration in the future; and the Village's agreement to allow the event will

Dear Sam:
To follow up on our conversation, this formally requests that the Village of Key Biscayne accept
our proposal to, once again, hold the First Serve charity benefit, which is scheduled to take place
within a few days of the opening round of the Ericsson Open (March 23 -April 2, 2000).
The First Serve will take place during the evening, and will include a private reception followed
by musical entertainment in the grand stand court. The event will begin at 6:30pm and conclude
no later thin l 1:00pm, and will be limited to 1,250 guests.
Tickets far this event will sell for approximately $350 per person, and all net proceeds will benefit
the same two- charities as last year: the Community Partnership for the Homeless (Alvah
Chapman s group) and the Ashe-Buchholz Tennis Center at Moore Park.
Last year, nearly 800 guests joined us for First Serve, which featured The Beach Boys, and we
raised nearly $60,000 for the two charities. In 2000, our goal is to reach our stated capacity of
1,250 guests, which would significantly increase the net proceeds we would be able to donate.
We would increase attendance through targeted solicitations by our advisory board members and
through strategically placed public service announcements and advertisements. The attached
outlines our proposed plan for generating awareness for the event.
