A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF RICHLAND
HILLS, TEXAS, AUTHORIZING THE CITY MANAGER TO EXECUTE
AND APPROVE THE ADVANCED FUNDING AGREEMENT (AFA) WITH
THE TEXAS DEPARTMENT OF TRANSPORTATION (TXDOT) FOR A
GREEN RIBBON PROJECT ALONG STATE HIGHWAY (SH) 183.
WHEREAS, federal law establishes federally funded programs for transportation
improvements to implement its public purposes; and
WHEREAS, the Texas Transportation Code, Section 201.103 establishes that the
State shall design, construct and operate a system of highways in cooperation with local
governments, and Section 222.052 authorizes the Texas Transportation Commission to
accept contributions from political subdivisions for development and construction of public
roads and the state highway system within the political subdivision; and
WHEREAS, federal and state laws require local governments to meet certain
contract standards relating to the management and administration of State and federal
funds; and
WHEREAS, the Texas Transportation Commission has codified 43 TAC, Rules
15.50-15.56 that describe federal, state, and local responsibilities for cost participation in
highway improvement and other transportation projects; and
WHEREAS, the Texas Transportation Commission passed Minute Order Number
116292 authorizing the State to undertake and complete a highway improvement or other
transportation project generally described as Landscape Development. The portion of the
project work covered by this Agreement is identified in the Agreement, Article 3, Scope
of Work (Project), and
WHEREAS, Highway 183, also known as Baker Boulevard, is a Texas Department
of Transportation (TxDOT) managed road; and
WHEREAS, the medians on Baker Boulevard, are eligible for grants offered by
TxDOT; and
WHEREAS, it is the City's responsibility to manage the medians after the
completion of any work done on the medians; and
WHEREAS, the City Council of the City of Richland Hills, Texas, has approved
entering into this Agreement by resolution dated May 8, 2023.
NOW, THEREFORE, BE IT RESOLVED, BUT THE CITY COUNCIL OF THE
CITY OF RICHLAND HILLS, TEXAS, THAT:
SECTION 1.
The City Council authorizes an Advance Funding Agreement with the State of
Texas for the construction of the Highway Safety Improvement Program (CSJ # 0094-02-
146) grant improvements from Rufe Snow to Handley-Ederville for an estimated total cost
of $540,153, with the City's share of the cost being 20 percent or $85,000 plus any cost
overruns. The City Manager is authorized to execute all documents necessary to
complete this transaction.
SECTION 2.
It is hereby officially found and determined that the meeting at which this resolution
is passed is open to the public and that the public notice of the time, place, and purpose
of said meeting was given as required by law.
APPROVED AND ADOPTED at a regular meeting of the Richland Hills City
Council on May 8, 2023, by a vote of ayes, D nays, and 0 abstentions.
