HomeMy Public PortalAbout069-1987- DEFEATED - ZONING - 420-426 SOUTH 9TH STORDINANCE NO. 69-1987 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO., 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF THE PROPERTY LOCATED AT 420-426 SOUTH 9TH STREET, FROM R-4 MULTI -FAMILY RESIDENCE DISTRICT TO C-1 LIMITED COMMERCIAL DISTRICT. WHEREAS, the Zoning map which is a part of Ordinance No. 2325-1968 designates and describes as R-4 Multi Family Residence District; and, WHEREAS, it is the intent and purpose hereof to change the zoning classification of said property from R-4 Multi Family Residence District; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the day of 1987, at which time remonstrances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was to in favor of/in opposition to recommending the passage of Ordinance No. 69-1987. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Indiana as follows: SECTION 1. That the zoning classification of the property described below, and the same is hereby changed to C-1 Limited Commercial District, and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana and all amendments thereto. Lots Nos. 2 and 5 in the Poe and Hittle's ADdition to the City of Richmond. And Also Lot Nos. 5, 8 and 11 Cincinnati and Ft. Wayne Railroad Addition. SECTION 2. This Ordinance shall be in full force and effect from and after its passage and approval as by law required. Mayor ATTEST City Clerk CITY PLAN COMMISSION RICHMOND, INDIANA December 30, 1987 Mrs. Jane Brookbank, President Members of Common Council and Mrs. Mary Merchanthouse, City Clerk Municipal Building Richmond, Indiana 47374 Re: Ordinance No. 69-1987 Plan Commission Case PC-87-13 Dear Mrs. Brookbank, Members of Common Council and Mrs. Merchanthouse: The Richmond City Plan Commission conducted a public hearing on Tuesday, December 22, 1987, on the petition of Carl Bargmann and Homestead Savings, owners; Roger Shockley, agent, requesting to rezone property located at 426, 424, 420 and 416 South 9th Street from R-4 Multi -Family Residence District to C-1 Limited Commercial District. Family Dollar Stores has an offer to purchase this property subject to the requested rezoning. Thirty-one (31) notices of public hearing were sent to the surrounding residents with three (3) returned in opposition to the petition and one (1) returned in favor of the petition. During the public hearing, Ms. Gertrude Ward spoke in opposition to the petition expressing concerns about the likelihood of three (3) historic residential structures being torn down if the rezoning takes place. The Plan Commission considered the criteria found in the State Law, at IC 36-7-4-603, regarding the establishment of zoning districts in making its determination. The Commission voted seven (7) to one (1) to recommend that Ordinance No. 69-1987 be adopted. Respectfully submitted, Daniel S. Dooley, Ex cutive Secretary Richmond City Plan Commission
