IONA CITY HALL
MARCH 16,2021 —7:00 P.M.
PRESENT: Mayor Dan Gubler, Council President Rob Geray, Council Member Michael
Thompson, Council Member Peter Wadsworth, Council Member Kathy McNamara, City
Attorney Andrew Rawlings, Public Works Director Zech Prouse (via teleconference) and City
Clerk/Treasurer Keri West.
ABSENT: None.
VISITORS: Allen Eldridge, Greg McBride and Brent Purcell.
Mayor Gubler welcomed everyone and Council Member Thompson led the Pledge of
Allegiance. A roll call was taken by Clerk West to open the meeting.
CONSENT AGENDA: City Council Work Meeting and Regular Meeting Minutes of February
16, 2021 were reviewed. Council reviewed the finance reports for the period ending February 28,
2021 (41% of the fiscal year elapsed). The City had $1,307,841.02 in the bank and routine bills
had been paid, "Exhibit A".
Mayor Gubler entertained a motion. Council Member Thompson made a motion to approve the
consent agenda as presented. Council Member Wadsworth seconded the motion. All in favor.
Motion carried.
ITEMS OF BUSINESS:
Revocation of Business License for Main Street Sales — Clerk West explained the business
owner has not paid their Business License fee for 2021 that was due December 31, 2020. She
continued and stated she has sent three letters since December and the most recent letter warned
of revocation of license if not paid prior to tonight's Council Meeting. Council Member
McNamara asked how he would get a new business license if they revoke it. Clerk West stated
he would need to submit a new application and be approved by the City Council. Council
President Geray stated if the business owner has not responded to multiple attempts and has not
paid for his license, he believes it is time to revoke the license. All Council Members agreed.
Mayor Gubler entertained a motion. Council President Geray made a motion to revoke the
Business License of Main Street Sales. Council Member Thompson seconded the motion. All in
favor. Motion carried.
Public Hearing — Ordinance to Amend Ordinance No. 244-08-20, Appropriations
Ordinance for the 2021 Fiscal Year, Appropriating Additional Monies that have been
awarded to the City of Iona in the sum of $575,000 as additional funding for the Water
Project (Ord. 250-03-21) — Clerk West explained the current budget did not include the Army
Corp of Engineers (ACoE) grant money. She apologized and stated it was in the previous year's
budget, but was not approved by the close of that budget. She continued and stated it somehow
did not make it into this year's final budget numbers. Clerk West stated now that the City has

been approved and has begun receiving funds from the ACoE grant, they need to open the
budget to add this grant and utilize those funds for the water project. Mayor Gubler clarified this
budget amendment is not to increase taxation or spend additional City money. Rather it is to
include monies received from the ACoE to allow the City to spend those monies received to
complete the water project. Clerk West agreed and confirmed she was told the exact amount of
$575,000 to be enumerated on this amended budget by City Engineer, Dave Noel.

this course of action. No response. Mayor Gubler then closed the Public Hearing portion of this
agenda item.

Ordinance No. 250-03-21, an Ordinance of the City of Iona, Idaho; amending Ordinance No.
244-08-20, the Appropriations Ordinance for the fiscal year beginning October 1, 2020, and
ending September 30, 2021; appropriating additional monies that are to be received by the City
of Iona, Idaho, in the sum of $575,000.00 and providing an effective date. Council President
Geray also made a motion to dispense with the rule of reading the proposed ordinance in full and
on three separate occasions. Council Member Wadsworth seconded the motion.

Public Hearing — Ordinance for Annexation and Initial Zoning of Sunrise Acres
Subdivision (Ord. 251-03-21) — Mayor Gubler stated the Annexation Agreement and Final Plat
have already been approved by the City Council. He explained this is the official Ordinance to
annex Sunrise Acres Subdivision into the City of Iona and set the initial zoning of this
subdivision as R-1, Single Family Residential.
Mayor Gubler stated this is a Public Hearing and asked if anyone in the audience is for or against
this course of action. No response. Mayor Gubler then closed the Public Hearing portion of this
agenda item to allow the City Council to deliberate.No further discussion.
Mayor Gubler entertained a motion. Council Member Wadsworth made a motion to approve
Ordinance No. 251-03-21, an Ordinance annexing certain lands to the City of Iona, Idaho;
describing these lands; establishing the initial zoning for such lands; requiring the filing of the
Ordinance and amended City map and amended legal description of the City with the appropriate
County and State authorities; and establishing an effective date. Council Member Wadsworth
also made a motion to dispense with the rule of reading the proposed ordinance in full and on
three separate occasions. Council Member Thompson seconded the motion.

Public Hearing — Ordinance to Amend Iona City Code § 10-1-3(A)(41); changing the
definition of subdivision (Ord. 252-03-21) — Mayor Gubler stated this was discussed at last
month's City Council Meeting. It was decided at that time to change the definition of
"subdivision" from 5 or more lots, to 3 or more lots. He continued and stated this is the
Ordinance to amend this definition in the Iona City Code. Attorney Rawlings also stated it now
includes a caveat that a split can only occur once every 10 years so residents are not regularly
splitting lots into only two to avoid the subdivision process. Mayor Gubler agreed on this
addition and clarified this amendment is an attempt to clean up the code and require developers
of three or more lots to proceed through the subdivision process, which includes City Council
approval.

agenda item to allow the City Council to deliberate. No further discussion.

3(A)(41) of the Iona City Code; changing the definition of"subdivide"to include all divisions of
land into three or more lots; providing methodology; preserving prior ordinances in each
instance; providing for severability; and establishing an effective date. Council Member
Thompson also made a motion to dispense with the rule of reading the proposed ordinance in full
and on three separate occasions. Council Member McNamara seconded the motion.

Ordinance to Amend Iona City Code § 5-1-3; specifying infraction penalties (Ord. 254-03-
21) — Attorney Rawlings stated this item does not require a Public Hearing because it is not
zoning related and is not increasing a fee. Council President Geray stated this was discussed at
last month's Council Meeting and clarified this is to establish a fee schedule pertaining to
infractions in the City.
Mayor Gubler entertained a motion. Council Member McNamara made a motion to approve
Ordinance No. 254-03-21, an Ordinance of the City of Iona, Idaho; amending Section 5-1-3 of
the Iona City Code; specifying infraction penalties; providing methodology; preserving prior
ordinances in each instance; providing for severability; and establishing an effective date.
Council Member McNamara also made a motion to dispense with the rule of reading the
proposed ordinance in full and on three separate occasions. Council President Geray seconded
the motion.

Public Hearing — Ordinance to Amend Iona City Code §§ 8-2-4 and 11-4-2; pertaining to
private emergency wells in R-1 Zones (Ord. 253-03-21) — Mayor Gubler stated this
amendment was also discussed in last month's City Council Meeting. He continued and stated
the Planning & Zoning Commission (P&Z) discussed this at their most recent meeting and had a
few concerns. Council President Geray stated P&Z was concerned with the proposed subsection
8-2-4(B)(1)(c)which states concerning emergency wells,
"The well may not provide water to or for any person not residing at the property on which the
well is located."
Council President Geray continued and stated the P&Z was concerned that this item disallows a
resident to provide water from their private well to a neighbor, in an emergency situation. Clerk
West elaborated and stated the P&Z requested to add that the City may give permission on a case
by case basis for residents to share water from their well, in an emergency. Mayor Gubler
recommended this subsection be removed prior to approval. He continued and stated this entire
section is only pertaining to private wells for emergency use. Council President Geray agreed,
but pointed out this chapter in the City Code does not define "emergency". Mayor Gubler stated
he believes this definition is already established by state statute. Director Prouse suggested
establishing a definition for emergency that is directly related to the water system.
Director Prouse also stated subsection 8-2-4(B)(4) needs to refer to "state statutes" referring to
requirements to remove wells once no longer in use or in the event of permit revocation. Mayor
Gubler agreed and expressed concern over the requirement for residents to maintain a permit for
an emergency well. Council President Geray stated he interprets the permit maintenance
requirement to mean that once a resident obtains the permit, they need to keep the well in good
standing and up to the standards set forth in the original permit. He continued and clarified it
does not mean the resident needs to renew the permit annually. Director Prouse agreed and added
the City has the ability to inspect the well annually. Mayor Gubler understood and agreed with
this interpretation and requirement.
Council Member Wadsworth asked if this needs to be passed tonight, or if it can wait until next
month to include the changes that have been discussed. Attorney Rawlings stated they can pass it
tonight with the mentioned changes under the Public Hearing. He can then present it next month
with cleaner language for approval, which would no longer require a Public Hearing.

agenda item.
Mayor Gubler entertained a motion. Council President Geray made a motion to approve
Ordinance No. 253-03-21, an Ordinance of the City of Iona, Idaho; amending Section 8-2-4 of
the Iona City Code; providing for private emergency wells within the City under specified
conditions; amending Section 11-4-2 of the Iona City Code; allowing for private emergency
wells as a permitted use within Single Family Residential (R-1) Zones in the City; providing
methodology; preserving prior ordinances in each instance; providing for severability; and
establishing an effective date; subject to the following modifications: 8-2-4(B)(1)(c) be deleted,
adjusting all subsequent section numbers, and 8-2-4(B)(4) to reference state statutes or other

appropriate language. Council President Geray also made a motion to dispense with the rule of
reading the proposed ordinance in full and on three separate occasions. Council Member
Wadsworth seconded the motion.

Public Hearing—Building Inspection Fee Increase—Mayor Gubler stated this is an attempt to
increase the building inspection fees obtained by our inspectors. He continued and stated he has
researched and found these increases reasonable.
Mayor Gubler stated this is a Public Hearing and asked if anyone in the audience is for or against
this course of action. No response. Mayor Gubler then closed the Public Hearing portion of this
agenda item to allow the Council to deliberate. Council President Geray asked if the $150 fee for
a generator installation includes both mechanical and electrical inspections. Clerk West
confirmed it includes all mechanical and electrical inspections. Mayor Gubler then asked if this
fee schedule is available on the City's website. Clerk West stated she believes it is, but will
confirm the updated price list be uploaded to the City's website after tonight's meeting.
Mayor Gubler entertained a motion. Council President Geray made a motion to approve the
Building Inspection Fee Increase as specified in the Building Permit Price List provided in the
Council Packet. Council Member Wadsworth seconded the motion. All in favor. Motion carried.
Resolution 2021-01 — A Resolution Designating City Health & Safety Inspectors and
Specifying Inspection Fees — Mayor Gubler stated this Resolution confirms the updated
inspection fees and designates the City's inspectors. No questions or discussions.
Mayor Gubler entertained a motion. Council Member Thompson made a motion to approve
Resolution 2021-01, a Resolution designating City Health & Safety Inspectors and specifying
inspection fees. Council President Geray seconded the motion. All in favor. Motion carried.
Oaths of Appointment for Building Department Inspectors — Clerk West swore in Allen
Eldridge as the Building Official for the City of Iona.
Clerk West swore in Greg McBride as the Mechanical and Plumbing Inspector for the City of
Iona.
Clerk West swore in Brent Purcell as the Electrical Inspector for the City of Iona.
STAFF REPORTS: Clerk West stated the Association of Idaho Cities (AIC) Annual
Conference will be held in June this year and it will be in person. This conference is open to
Mayors, Council Members, Clerks, Treasurers and Mayor's Youth Advisory Council (MYAC)
members from all over the state of Idaho. She also stated the Idaho City Clerks Treasurers and
Financial Officers Association (ICCTFOA) Conference will be held in person this year in
September in Boise. She requested feedback from the Council on which conference she should

attend, or if both are an option. Clerk West also stated she is currently serving as the 1st Director
of District 6 for the ICCTFOA. Mayor Gubler stated he has not received any confirmations from
MYAC members on whether they will be attending the conference in June this year. Council
President Geray stated if he had to pick only one conference, he would recommend going to the
ICCTFOA Conference in September.
Clerk West also reported the Easter Egg Hunt is going to take place on March 27th at 1:00pm.
She also commended Office Assistant Rylea Farrens for her hard work planning the event and
raising over $700 in donations. She continued and stated if anyone would like to help, they will
be at the park all morning setting up.
Director Prouse stated nothing to report.
Council Members Wadsworth and Thompson stated nothing to report.
Council President Geray advised the Council Members to pay attention to the emails from AIC
regarding upcoming bills in the state legislature and encouraged them to communicate with our
local state legislators.
Council Member McNamara stated the Iona Historical Museum is having a meeting tomorrow at
1:00pm. She continued and stated she will attend and then update the Council on the status of the
Museum.
Attorney Rawlings reported he is currently working on an Ordinance for the Heritage
Commission. He also stated he is currently researching options for the City to avoid the cost of
upsizing water line pipe by requiring developers to pay for the infrastructure when developing a
new subdivision.
