AN ORDINANCE RATIFYING THE PROFESSIONAL NEGOTIATION AGREEMENT BETWEEN THE F.O.P.
BARGAINING UNIT AND THE CITY OF RICHMOND, INCLUDING ESTABLISHING THE LONGEVITY
PAY OF RICHMOND POLICE OFFICERS AND REPEALING ORDINANCE NO. 80-1984,EFFECTIVE
JANUARY 1, 1986.
WHEREAS, the Board of Public Works and Safety through its wage negotiating team
has negotiated with the representatives of the John Hennigar Lodge
#63, Fraternal Order of Police,representing members of the Richmond
Police Department and in said negotiations have agreed on the articles
contained in the Professional Negotiation Agreement; and
WHEREAS, Indiana Code L.C. 36-8-3-3 authorizes the Common Council of the City
of Richmond, Indiana to ratify such amendments; and
WHEREAS, the Board of Public Works and Safety and the Richmond F.O.P. have set
their hands and seals this 26th day of December, 1985 to the amendments
to the Agreement; and
WHEREAS, such Professional Negotiation Agreement have been approved by Mayor
Frank H. Waltermann; and
WHEREAS, Ordinance No. 80-1984 established the longevity pay to be paid during
1985; and
WHEREAS, Ordinance No. 80-1984 in no longer needed, and;
WHEREAS, the Common Council of the City of Richmond, Indiana, desires to ratify
such Professional Negotiation Agreement and to incorporate such
Professional Negotiation Agreement into this ordinance;
NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond,
Indiana that;
SECTION 1. The Professional Negotiation Agreement entered into by
the Union and the City and dated the 26th day of December, 1985, is
hereby ratified and incorporated into this ordinance.
SECTION 2. Ordinance No. 80-1984 be repealed as of January 1, 1986.

REFERENCE: Professional Negotiation Agreement with Police
Ordinance No. 5-1986
Attached is the 1986 contract between the City and the Police and a copy of my
memo to the Board of Public Works and Safety highlighting the changes.
No additional appropriation will be needed to fund the 1986 base wage and longevity.
The 1986 Police budget contained a 3% increase in base pay. Recent changes in the
FLSA will reduce the amount needed for FLSA. An intra category (between line
item) transfer will be made from FLSA to regular and longevity pay to provide the
money to fund the 1985 contract.

Attached is the 1986 contract between the Board of Public Works
and Safety on behalf of the City and the Fraternal Order of Police on
behalf of the members of the Richmond Police Department.
Under the 1986 contract, each officer will receive $800 additional
pay. $300 in the form of base wage and $500 in the form of base longevity.
The following is a synopsis of those articles that were changed from
the 1985 contract;
Article 12 - A Minimum Manpower - a new article added to the contract.
Article 16 - Base pay of a patrolman was increased from $16,790
to $17,090, a $300 dollar increase. The permanent differential
between the ranks is the same as that in prior years contracts.
Article 17 - Tour of Duty - this article is a new article added
to the contract to bring the contract into compliance with FLSA.
Article 18 - Overtime - this article was re -written in order to
comply with FLSA and qualify the Richmond Police Department for
excemption under Section 7(K) of FLSA. The 1985 contract with
the Police Department designated all hours worked in.access of
forty hours to be.considered overtime. The 1985 contract was
less restrictive than FLSA by three hours per seven day period.
This article also reflects overtime pay to include all the com-
ponents as mandated under FLSA. The officers can bank overtime
up to 480 hours.
Article-19 - Five Day weekend - this is a new article to the con-
tract but not a new benefit to the Police Department_ This para-
graph was previously a part of the overtime article but was removed
for language clarity.
Article 20 - Vacation - no new vacation time was granted. Section.
III was amended to allow the officers to take up to one week of
their vacation time, either one day at a time or in any combination
less than five, subject to the "Manpower Rule".

Article 23 - Longevity Pay - a base longevity of $500 was added to
the contract in order to provide each officer with an across the
board pay increase in 1986 over 1985 of $800. Legal constraints
prohibited the City and the F.O.P.-from including all of the $800.00
as base pay
Article 26, Section V was amended to include an amount of $225
to be consistent of that with other technician categories.
Article 29 - Insurance - this article was amended to allow for
the creation of a City Self Insurance Committee. The amendments
to this article allow the City to change third party group insur-
ance administrators.
The contract was "re -arranged" in order to provide better clarity.
There were no increases in education incentive, tech. pay, clothing
allowance, holiday pay or any other monetary amount.
The city's negotiating team consisted of myself, Sue Roberson,
Director of Administrative Services, and Mayor Frank Waltermann.
