AN ORDINANCE AMENDING SECTION 96.10 (C)(5)OF THE RICHMOND CITY CODE AS IT APPLIES
TO EXCAVATIONS AND STREET CUTS
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Richmond
that Section 96.10 (C)(5) of the Richmond City Code be amended as follows:
SECTION 96.10 (C)(5)
(i) Any applicant for a street cut or excavation permit shall execute,
in conjunction with a permit application, an agreement to indemnify
the City, its officials and employees from any liability due to loss
of damage, injuries or other casualties arising out of the work for
which a permit is granted. The applicant shall also certify that it
has procured or will procure prior to the street cut or excavation
work, an insurance policy naming the applicant and the City as
co-insured to protect its interest.
(ii) Failure to execute the indemnification agreement and/or to
provide the insurance policy naming the City as co-insured shall be
deemed prima facie evidence of the non --disclosure of the work to the
City, its officials and employees.
