AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING
ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF
THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF PROPERTY
LOCATED AT 244 SOUTH 4TH STREET FROM R-3 ONE TO EIGHT FAMILY
RESIDENCE DISTRICT TO R-3 SU ONE TO EIGHT FAMILY RESIDENCE SPECIAL
USE DISTRICT, AND AUTHORIZING THE SPECIAL USE OF SAID PROPERTY AS A
BUSINESS AND ADMINISTRATIVE OFFICE.
WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968
designates and describes as R-3 One To Eight Family
Residence District the property located at 244 South 4th
Street; and,
WHEREAS, it is the intent and purpose hereof to change the zoning
classification of said property from R-3 One To Eight Family
Residence District to R-3 SU One To Eight Family Residence
Special Use District, and to authorize the Special Use of
Said property as a Business and Administrative Office ; and,
WHEREAS, a study of this Ordinance was conducted by the Richmond City
Plan Commission the a5d day of , 1986, at which
time remonstrances were heard from all p rties interested in
or affected by this Ordinance; and,
WHEREAS, the vote of the Richmond City Plan Commission was 9
to 0 in favor of/' recommending the
passage of Ordinance No. 17-1986.
NOW THEREFORE BE IT ORDAINED by the Common Council of the City of
Richmond, Indiana as follows:
SECTION 1. That the zoning classification of the property described
below, and the same is hereby changed to R-3 One To Eight
Family Reidence Special Use District, and that said property
be regulated in accordance with the Zoning Ordinance of the
City of Richmond, Indiana and all amendments thereto.
The following described real estate situated in the City of
Richmond, Wayne County, Indiana, to wit:
Lot 62 in John Smith's Addition to the City of Richmond.
SECTION 2. That as provided in Articles 22 and 48 of Chapter 154 of
the Municipal Code, the following described use of the above
described real estate is allowed as a Special Use as a
Business and Administrative Office.
SECTION 3. As a condition of being granted the Special Use and as an
additional restriction on said use, the following
requirements shall hereafter and at all times be met by the
owner of said real estate.
a. The site plan and narrative regarding the design and
characteristics of the Special Use Business and
Administrative Office shall be marked Exhibit "A" and
be made a part of this Ordinance.
SECTION 4. This Ordinance shall be in full force and effect from and
after its passage and approval as by law required.
PASSED AND ADOPTED by the Common Council of the City of Richmond,

Dear Mr. Bodiker, Members of Common Council and
Mrs. Merchanthouse:
The Richmond City Plan Commission conducted a public hearing
on Tuesday, February 25, 1986, on the petition of Romaine
Delucio, owner; James Harlan, Agent, requesting to rezone
property located at 244 South 4th Street from R-3 One -to -
Eight Family Resident District to R-3 SU One -to -Eight Family
Residence Special Use District and also requesting Special
Authorization for a Business and. Administrative Office.
Eleven (11) notices ofpublic hearing were sent to the surround-
ing residents with one (1) returned in favor of the petition.
During the public hearing, no one spoke in opposition to
the petition.
The property at 244 South 4th Street is presently a two-family
dwelling. The owners desire to sell the property to Mr.
William Gill, who proposes to establish on the premises a
Northwestern Mutual Life Insurance office. The exterior of
the structure shall retain its residential character and
off-street parking shall be provided at the rear of the prop-
erty. The Zoning Ordinance provides that such business and
administrative offices may be established in multi -family
residential districts through the Special Use process as a
way to preserve and maintain the physical character of a
neighborhood.
There are presently three (3) Special Use offices operating
in the immediate neighborhood and experience has shown these
offices have not adversely effected adjacent residential
property.

PETITION FOR REZONING TO THE SPECIAL USE DISTRICT

The Common Council of the City of Richmond has established as a
Zoning Classification the Special Use District. The Special Use
District does not stand by itself but shall be combined with an
existing zoning district. The Special Uses that may be allowed
within the Special Use District are specifically enumerated in
each zoning district classification,
The Richmond City Plan Commission meets on the fourth Tuesday of
each month at 7:30 P.M. in the City Council Chambers, The
Petition for Rezoning to the Special Use District consists of the

All Petitions must be filed complete, in duplicate, by the last
Tuesday of each -month in order to be placed on the next month's
Agenda. The presence of the Petitioner or the Petitioner's

B. SPECIAL USE STANDARDS:
Article 48 of the Zoning Ordinance setsforth certain
standards to be used as guidelines by the Plan Commission
in considering Special Use District rezoning Petitions.
The following is the Petitioner's response demonsrating the
manner in which the requested Special Use rezoning complies
with said standards:
1, The establishment, maintenance, or operation of the Special
Use will not be detrimental to or endager the public
health, safety, morals, convenience, or general welfare for
the following reasons:
Office will be staffed by two employees, with other agents dropping
in, this is in keeping with surrounding properties.

C. SPECIAL USE NARRATIVE (continued):
Will be possible under this use and more likely than if property
was to be used as multi family.
D. SITE PLAN:
The Site Plan submitted is to be drawn on unlined paper at an
engineering scale, with a north arrow and shall show the
following:
1. All property lines
2. Location of existing building(s)
3. Location of proposed building(s) and/or additions
4. Location of off street parking and loading spaces
5. Existing and propsed dimensions shall be given for the following

2. The Special Use will not be injurious to the use and
enjoyment of other property in the immediate vicinity for
the purposes already permitted, nor substantially diminish
and impair property values within the neighborhood for the
following reasons:
Plans include maintaining exterior in orginal design and interior
will be upgraded.
3. The establishment of the Special Use will not impede the
normal and orderly development and improvement of the
surrounding property for uses permitted in the ditrict for
the following reasons:
No noticeable change in property other than parking in rear,
unsightly garage to be removed.
4. Adequate utilities, access roads, drainage, buffering and
other necessary facilities will be provided for the
following reasons:
Already in existance.
r 5. Adequate measures will be taken to provide ingress and
egress so designed as to minimize traffic congestion in
the public streets for the following reasons:
Removal of garage will clean up and allow better traffic flow
in ally and addition of off street parking.
C. SPECIAL USE NARRATIVE:
The Special Use established by Ordinance of the Common Council
within the Special Use. District shall be limited to that
specific Special Use and shall not be altered, converted,
modified or substituted in any way without an amendment to
said Special Use being granted in accordance with Article 62
of the zoning Ordinance. The following narrative is the
Petitioner's detailed description of the Special Use being
requested:
Petitioner is requesting zoning change based upon an accepted
offer to purchase stipulating the use as an insurance office,
under professional use with special use profession. This will
allow the highest and best use of the property. The maintenance
and building upgrading.
