HomeMy Public PortalAbout018-1986 - REZONING - SOUTHSIDE OF NEW PARIS PIKE IN THE 3700 BLOCKGENERAL ORDINANCE NO. 18-1986 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA PROVIDING FOR THE REZONING OF PROPERTY LOCATED ON THE SOUTH SIDE OF NEW PARIS PIKE IN THE 3700 BLOCK FROM A-1 AGRICULTURAL DISTRICT TO A-1 SU AGRICULTURAL SPECIAL USE DISTRICT, AND AUTHORIZING THE SPECIAL USE OF SAID PROPERTY AS A COMMERCIAL RECREATIONAL FACILITY. WHEREAS, the Zoning Map which is a part of Ordinance No. 2325-1968 designates and describes as A-1 Agricultural District the property located on the south side of New Paris Pike in the 3700 Block; and, WHEREAS, it is the intent and purpose hereof to change the zoning classification of said property from A-1 Agricultural District to A-1 SU Agricultural Special Use District, and to authorize the Special Use of Said property as a Commercial Recreational Facility; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the _'Sa day of Z-ja&&/, , 1986, at which time remonstrances were heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was to to 0- in favor of/in recommending the passage of Ordinance No. 18-1986. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Indiana as follows: SECTION 1. That the zoning classification of the property described below, and the same is hereby changed to A-INAgricultural Special Use District, and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana and all amendments thereto. The following described real estate situated in Wayne County, Indiana, to wit: Part of the Southwest Quarter of Section 25, Township 14, Range 1 West, described as follows, to wit: Beginning at the Southwest corner of said Section, running thence east along the section line 80 poles; thence north 92 rods to a marked stone corner; thence east 40 rods to a marked stone corner; thence north 16 rods to a marked stone corner; thence east 40 rods to a marked stone corner in the east line of said quarter section; thence north 52 rods to the northeast corner of said quarter section; thence west along the quarter section line 81.21 rods to a marked stone corner; thence south parallel with the line on the west side of said section 57.54 rods to a marked stone corner; thence west 78.79 rods to the section line; thence south 102.46 rods to the place of beginning, containing 81.33 acres. EXCEPTING THEREFROM, the following described real estate: Part of the Southwest quarter of Section 25, Township 14, Range 1 west, beginning at a point in the South line of said quarter section, said point being 79.4 feet West of the Southeast corner of the West half of the Southwest quarter of said Section, and running thence from said beginning point of a Northwesterly direction along the right of way line of Federal Highway No. 70, as follows: North 39 degrees 13 minutes west 781.4 feet to a point; thence North 44 degrees 56 minutes west 603 feet to a point; thence North 39 degrees 13 minutes west 102 feet to a point; thence North 42 degrees 06 minutes west 100.1 feet to a point; thence North 39 degrees 13 minutes west 300 feet to a point; thence North 44 degrees 56 minutes west 3.4 feet to a point on the Section line where the South boundary line of said Federal Highway intersects with said Section line; thence South 1412 feet, more or less, to the southwest corner of said quarter section; thence east 1240.6 feet, more or less, to the place of beginning, the same containing 20.32 acres more or less. ALSO EXCEPTING THEREFROM, all that real estate appropriated for purposes of a public highway by the State of Indiana in an action in Cause No. 102 in the Wayne Circuit Court, State of Indiana, and confirmed by judgment entered in Order Book 121, page 549, said real estate so appropriated for highway purposes, being described as follows: Beginning at the Northwest corner of the Southwest Quarter of Section 25, Township 14 North, Range 1 West, Wayne Township, Wayne County, Indiana; thence South 965 feet along the west line of said section to a point; thence South, 151.8 feet to a point; thence East, 336.8 feet to the point of beginning of this tract; thence South 35 degrees and 24 minutes East, 250 feet to a point; thence South 33 degrees and 30 minutes East, 63.6 feet to a point; thence South 78 degrees and 15 1/2 minutes west, 347.8 feet to a point; thence North 39 degrees and 13 minutes west, 2.8 feet to a point; thence North 42 degrees and 6 minutes West, 100.1 feet to a point; thence North 39 degrees and 13 minutes West, 300 feet to a point; thence North 44 degrees and 56 minutes West, 3.4 feet to a point; thence North 0 degrees and 7 1/2 minutes East, 249 feet to a point; thence North 81 degrees and 34 minutes East, 193.2 feet to the place of beginning and containing 4.513 acres, more or less. ALSO EXCEPTING THEREFROM: Beginning at the Southeast corner of the West half of the Southwest quarter of Section 24, Township 14 North, Range 1 West, Wayne Township, Wayne County, Indiana; the point of beginning of this tract; thence West 79.4 feet to a point; thence North 39 degrees and 13 minutes West, 781.4 feet to a point; thence North 44 degrees and 56 minutes West, 603 feet to a point; thence North 39 degrees and 13 minutes West, 28.2 feet to a point; thence North 78 degrees and 15 1/2 minutes East, 340 1/2 feet to a point; thence South 33 degrees and 30 minutes East, 71 1/2 feet to a point; thence South 32 degrees and 5 1/2 minutes East, 201.6 feet to a point; thence South 36 degrees and 21 minutes East 200.3 feet to a point; thence South 39 degrees and 13 minutes East 661.9 feet to a point; thence South 219.1 feet to the place of beginning and containing 6.645 acres, more or less. ALSO EXCEPTING THEREFROM: Being part of the Southwest Quarter of Section Twenty five (25), Township Fourteen (14) North, Range One (1) West, in Wayne Township, Wayne County, Indiana and being more particularly described as follows: Beginning at a point one thousand two hundred sixty six and twenty two hundredths (1266.22) feet north of the southeast corner of the west one half of said southwest quarter, and in the southwardly right of way of the Penn Central Railroad, and running thence, from said beginning point, south seventy eight (78) degrees fifteen (15) minutes and thirty (30) seconds west, along said southwardly right of way, six hundred ninety eight and forty three hundredths (698.43) feet to the eastwardly right of way of Interstate Highway Number Seventy; thence north thirty three (33) degrees and thirty (30) minutes west. along said Highway right of way, one hundred twenty nine and six hundredths (129.06) feet; thence north thirty nine degrees and thirteen (13) minutes west, along said right of way, two hundred fifty (250) feet; thence north thirty five (35) degrees and twenty four (24) minutes west, along said right of way, one hundred fifty and eight tenths (150.8) feet; thence north thirty nine (39) degrees and thirteen (13) minutes west, along said right of way, one hundred ninety three and two tenths (193.2) feet; thence eastwardly one thousand one hundred nineteen and twenty one hundredths (1119.21) feet to the east line of the west one half of said southwest quarter; thence south, along said east line, four hundred twenty four and thirty seven hundredths (424.37) feet to the place of beginning, subject to the right of way of the Penn Central Railroad across the entire south side of said tract, containing an area of 9.183 acres, more or less. ALSO EXCEPTING THEREFROM: Being part of the Southwest Quarter Twenty-five, Township Fourteen (14) North, Range One (01) West, in Wayne Township, Wayne County, Indiana, and being more particularly described as follows: Being all of that part of the east one-half of the southwest quarter of Section Twenty-five (25), Township Fourteen (14) North, Range One (01) West, located North of the North right-of-way of the Penn Central Railroad and now owned by American Aggregates Corporation, described by beginning at the southeast corner of a tract now owned by William F. Longmire and Louis C. Hubble, eight hundred forty (840.00) feet south of the northeast corner of said southwest quarter, (directions used in this description are from railroad right of way plans and assume the east line of said quarter to run north and south) thence running west, along said Longmire and Hubble's south line, six hundred sixty (660) feet; thence south along said line, two hundred sixty-four (264.00) feet; thence west six hundred sixty-two and forth hundredths (662.40) feet to said Longmire and Hubble's southwest corner; thence south along the west line of a tract owned by American Aggregates Corporation, one hundred seventy-one and eleven hundredths (171.11) feet to the north right of way of the Penn Central Railroad; thence north seventy-seven (77) degrees and fifty-eight (58) minutes east, along said right of way, thirty and sixty-eight hundredths (30.68) feet to a point of curve; thence by a one (01) degree and forty-eight (48) minute curve to the right a distance of five hundred ninety-six and sixty-three hundredths (596.63) feet to a point of tangency; thence north eighty-eight (88) degrees and forty-five (45) minutes east, along said right of way, thirty-five and seventy-one hundredths (35.71) feet; thence north one (01) degree and fifteen (15) minutes east forty (40.00) feet; thence north eighty-eight (88) degrees and forty-five (45) minutes east, along said right of way two hundred four and seventy-one hundredths (204.71) feet to the east line of said southwest quarter; thence north, along said east line, three hundred sixty-two and forty hundredths (362.40) feet to the place of beginning, containing an area of seven and one hundred fifty four thousandths (7.154) acres, and being subject to any easements of record including an easement for a power line to Indiana -Michigan Transmission Line. SECTION 2. That as provided in Articles 25 and 48 of Chapter 154 of the Municipal Code, the following described use of the above described real estate is allowed as a special Use as a Commercial Recreation Facility. SECTION 3. As a condition of being granted the Special Use and as an additional restriction on said use, the following requirements shall hereafter and at all times be met by the owner of said real estate. a. The site plan and narrative regarding the design and characteristics of the Special Use Commercial Recreation Facility shall be marked Exhibit "A" and be made a part of this Ordinance. SECTION 4. This Ordinance shall be in full force and effect from and after its passage and approval as by law required.
