RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD
ACCEPTING LYNWOOD ROAD, OLIVE STREET, MCMILLAN STREET,
COOKACRE AVENUE AND RAYBORN STREET, STREET
IMPROVEMENT PROJECT, PROJECT NO. 4011.68.090 AS
COMPLETE; AUTHORIZING THE FILING OF THE NOTICE OF
COMPLETION WITH THE LOS ANGELES COUNTY RECORDER'S
OFFICE AND THE RELEASE OF THE 5% RETENTION 35 DAYS AFTER
THE ACCEPTANCE.
WHEREAS, Lynwood Road, Olive Street, McMillan Street, Cookacre Avenue and
Rayborn Street, Street Improvement Project, Project No. 4011.68.090 consists of cold
milling/removing the existing pavement and applying fresh coat of asphalt pavement,
replacement of concrete sidewalks, curb and gutters, driveways approaches, cross
gutters, and curb ramps, traffic striping, and other miscellaneous improvement; and
WHEREAS, the Project limit is along Lynwood Road; from Monrovia Avenue to
Lindbergh Avenue, from School Street to Olive Street, and from Bullis Road to Fir Street,
Olive Street; from Lynwood Road to Louise Street, McMillan Street; from City limits east
of Harris Avenue to City limits west of Waldorf Drive and from Atlantic Avenue to City
limits east of Gibson Avenue, Cookacre Avenue; from McMillan Street to Carlin Avenue,
and Rayborn Street; from Wright Road to Edgebrook Avenue; and
WHEREAS, on September 29, 2020, the Notice Inviting Bids for the Project was
advertised in the Daily Journal, Bid America, and on the City's web site (PlanetBids); and
WHEREAS, the bid opening took place in the PlanetBids Platform on Monday,
October 12, 2020; and
WHEREAS, November 17, 2020, per Resolution 2020.154, the City Council awarded
the Project construction to Excel Paving, Inc.in the amount of$688,841.00; and
WHEREAS, the total project budget approved was $953,841.00. The funding sources
approved were from Measure M Bonds; and
WHEREAS, the construction of the Project started on November 30, 2020. The
project completion was on December 2021; and
WHEREAS, the City Manager approved Five (5) contract change orders for the total
amount of$98,291.66 (See attachment A); and
WHEREAS, staff conducted the final inspection on May 2021 and found that all work
was completed in accordance with the project plans and specifications

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES
HEREBY FIND, PROCLAIM, ORDER, AND RESOLVE AS FOLLOWS:
Section 1. The City Council of the City of Lynwood hereby finds and declares
that the foregoing recitals are true and correct, and incorporates them herein as findings
and as a substantive part of this Resolution.
Section 2. That the City Council of the City of Lynwood accepts Lynwood Road,
Olive Street, McMillan Street, Cookacre Avenue and Rayborn Street, Street Improvement
Project, Project No. 4011.68.090 as complete in accordance with contract documents and
authorizes the Direct of Public Works or his designee to process the recordation of the
Notice of Completion, and authorizes staff to release the 5% retention 35 days after the
Project acceptance.
Section 3. This Resolution shall go into effect immediately upon its adoption.
Section 4. The City Clerk shall certify as to the adoption of this Resolution.
