AN ORDINANCE RATIFYING THE PROFESSIONAL NEGOTIATION AGREEMENT BETWEEN THE
RICHMOND PROFESSIONAL FIREFIGHTERS INC., LOCAL 1408 AND THE CITY OF RICHMOND;
PROVIDING FOR LONGEVITY PAY FOR THE FIREFIGHTERS; AND AMENDING OR➢INANCE NO.
53-1985 TO SET SALARIES FOR CERTAIN APPOINTED OFFICERS AND EMPLOYEES
WHEREAS, the Board of Public Works and Safety through its negotiating team has
negotiated with the representatives of the Richmond Professional
Firefighters, Inc., Local 1408 of the International Association of
Firefighters, AFL-CIO representing members of the Richmond Fire
Department and Professional Firefighters Union of Indiana and in said
negotiations have agreed to enter into a Professional Negotiation
Agreement; and
WHEREAS, Indiana Code I.C. 36-8-3-3 authorizes the Common Council of the City of
Richmond, Indiana to ratify such an agreement; and
WHEREAS, the Board of Public Works and Safety and the Richmond Professional
Firefighters Union have set their hands and seals the 3rd day of April,
1986, to the Professional Negotiation Agreement; and
WHEREAS, such Professional Negotiation Agreement has been approved by Mayor
Frank H. Waltermann; and
WHEREAS, the Common Council of the City of Richmond, Indiana desires to ratify
such Professional Negotiation Agreement and to incorporate such
Professional Negotiation Agreement into this ordinance; and
WHEREAS, Ordinance No. 53-1985 which set salaries for 1986 for certain
appointed officers and employees of the City of Richmond needs to be
amended to include salaries for Battalion Chiefs of the Fire
Department, not covered by such Professional Negotiation Agreement;
and
WHEREAS, the Board of Public Works and Safety has negotiated with
representatives of the Richmond Professional Firefighters, Inc.,
Local 1408 of the International Association of Firefighters, AFL-CIO
representing certain members of the Richmond Fire Department and
Professional Firefighters Union of Indiana and in said negotiations
have agreed in the Professional Negotiation Agreement Addendum No. 1
to pay salaries and longevity pay to the members of the Richmond Fire
Department; and
WHEREAS, effective January 1, 1986, the longevity pay will be increased to the
amount of Five Hundred Dollars ($500.00) at each longevity level, and
a new longevity level added; and
WHEREAS, effective January 1, 1986, Ordinance No. 91-1984 shall be rescinded,
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Richmond,
Indiana that
SECTION I. The Professional Negotiation Agreement previously entered
into by the Union, and the City and dated the 3rd day of April, 1986, is
hereby adopted by reference, ratified and incorporated into this
ordinance.
SECTION I1. That Ordinance No. 53-1985 be amended to show that for
the fiscal year beginning January 1, 1986, and ending December 31,
1986, the following appointed officers and employees of the City of
Richmond, Indiana shall receive the following salaries for the
positions:

SECTION III. Effective the 1st day of January, 1986, any member of
the fire department on active duty shall receive in addition to such
member's base pay, longevity pay, which shall be determined on the
basis of the length of active service in the fire department, which
said longevity pay shall be as follows, to wit:
I. Any member of the Fire Department who shall have had not less than
three years and not more than six years of active service in such
member's department shall receive the sum of $900.00 per year in
addition to such member's base pay; the annual payment shall commence
upon the date upon which any such member shall have completed three
years of active service with such member's department;
2. Any member of the Fire Department who shall have had not less than
six years and not more than eight years of active service in such
member's department shall receive the sum of $1,000.00 per year in
addition to such member's base pay; the annual payment shall commence
upon the date upon which any such member shall have completed six years
of active service with such member's department;
3. Any member of the Fire Department who shall have had not less than
eight years and not more than ten years of active service in such
member's department shall receive the sum of $1,100.00 per year in
addition to such member's base pay; the annual payment shall commence
upon the date upon which any such member shall have completed eight
years of active service with such member's department;
4. Any member of the Fire Department who shall have had not less than
ten years and not more than twelve years of active service in such
member's department shall receive the sum of $1,200.00 per year in
addition to such member's base pay; the annual payment shall commence
upon the date upon which any such member shall have completed ten years
of active service with such member's department;
5. Any member of the Fire Department who shall have had not less than
twelve years and not more than fourteen years of active service in such
member's department shall receive the sum of $1,300.00 per year in
addition to such member's base pay; the annual payment shall commence
upon the date upon which any such member shall have completed twelve
years of active service with such member's department;
6. Any member of the Fire Department who shall have had not less than
fourteen years and not more than sixteen years of active service in
such member's department shall receive the sum of $1,400.00 per year
in addition to such member's base pay; the annual payment shall
commence upon the date upon which any such member shall have completed
fourteen years of active service with such member's department;
7. Any member of the Fire Department who shall have had not less than
sixteen years and not more than eighteen years of active service in
such member's department shall receive the sum of $1,500.00 per year
in addition to such member's base pay; the annual payment shall
commence upon the date upon which any such member shall have completed
sixteen years of active service with such member's department;
8. Any member of the Fire Department who shall have had not less than
eighteen years and not more than twenty years of active service in such
member's department shall receive the sum of $1,600.00 per year in
addition to such member's base pay; the annual payment shall commence
upon the date upon which any such member shall have completed eighteen
years of active service with such member's department;
9. Any member of the Fire Department who shall have had not less than
twenty or more years of active service in such member's department
shall receive the sum of $1,700.00 per year in addition to such
member's base pay; the annual payment shall commence upon the date
upon which any such member shall have completed twenty years of active
service with such member's department;
SECTION IV. It is intended that the eligibility for longevity pay and
the amount of longevity that is to be paid to each member of the Fire
Department shall be determined as upon that date upon which such member
shall have completed three years of active service with such member's
department, and upon that same calendar date in each ensuing year
thereafter.
SECTION V. It is further intended that any member of the Fire
Department who has not accumulated three years of active service shall
not be eligible for longevity pay.

Attached is the 1986 contract between the City and members of
Firefighters Local 1408, signed by the Union and the Board of
Works on April 3, as well as Ordinance No. 30-1986 which adopts
and ratifies the contract, makes changes in the fire longevity
ordinance necessitated b'y the contract, and also sets salaries
for the three Battalion Chiefs .who are not covered by the
contract but�who were not included in the 1986 salary ordinance
due to their inclusion at that time in the bargaining unit.
Under the 1986 contract, those Fire Department members covered,
and who are eligible for longevity, will receive increases in
total compensation .ranging from 3.27 to 4.2%. This is in the
form of an increase in salary which varies by rank, one
additional, holiday (for which all covered members are paid
additional compensation, regardless of work schedule), and an
additional $500.00 at each longevity level, as well as a new
longevity level created at 20 years' service.
The following is a synopsis of those articles changed from the
prior contract:
Article 3 -.Battalion Chiefs are no longer covered by the
agreement.
Article 6 _ Language was clarified to reflect that payroll
dues deductions are based on employees' individual voluntary
authorizations.
Article 7 - "national origin" was added as a prohibited
basis of discrimination by the City or the Union.
Article19 - Paid time off for union business was reduced
from twelve (12) to ten (10) days per calendar year £or.the
bargaining unit.
Article 10 - The grievance procedure was tightened to add
time limits at the first and, final steps of the procedure
and to make each step mandatory.

Article 11A - In Distribution of manpower, total manpower
covered by the contract was reduced to 78 from 81, to
reflect exclusion of the Battalion Chiefs. Certain
provisions restricting the City's operation of dispatch and
fire prevention functions were removed.
Article 12 - Dr. Martin Luther King, Jr's Birthday was added
as an additional paid holiday.
Article 19 - Overtime earned will be paid as required by the
F.L.S.A., instead of prior provision for double time off for
all emergency call-back service.
Article 20 - Instead of the prior practice of paying a cash
clothing allowance and requiring members to furnish their
own protective clothing and station dress from it, the City
will now directly furnish specified items as needed, in lieu
of a clothing allowance. $150.00 will also be paid to each
member for laundering and upkeep of all uniforms and
clothing.
•Article 23 - Prevailing rights of covered members are now
specifically subject to the management rights recognized in
Article 4.
Article 29 - Battalion Chiefs were excluded from the
seniority bidding promotion system.
Prior Articles 30 - Wage Addendum and
Articles 32 - Parity with Police - were omitted
in their entirety.
The contract is retroactive to January 1, 1986 and expires
December 31, 1986. The City and Union have agreed in it to meet
and bargain concerning an Agreement for 1987 beginning May 1,
1986.
The City's negotiation team consisted of myself, City Clerk Mary
Merchanthouse, and City Engineer Ralph Willis, with Council
member Lynn Morris and City Purchasing Director Rita Stout as
alternates. Local 1408's negotiating team consisted of William
Smith, David Harbin, and Ed Haller (wages), and Marshall Kern,
Jim Walters, and Oscar Abner (contract -working conditions).
An additional appropriation will be needed to fund the 1986 base
wage and longevity, in the approximate amount of $15,000.00 over
and above the 3% increase included in the 1986 Fire budget. This
appropriation will be prepared and forwarded to you in the near
future.
