ORDINANCE NO. 1 ST -g 3
AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, RELINQUISHING A SANITARY SEWER
EASEMENT ACROSS TRACT B OF WESTVIEW HEIGHTS SUBDIVSION, SECTION 9, BAGNALL
DRIVE AND JASPER LANE
WHEREAS, by an easement recorded in Book 282, Page 627, of the Records of Cole County, Missouri, a
sewer easement was granted to the City of Jefferson, a Municipal Corporation, to excavate
within, install, construct, maintain and repair structures for the routing of conveyance of
sewer in, under and through the lots, tracts of parcels of land described in Section 1.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF JEFFERSON, MISSOURI,
AS FOLLOWS:
Section 1. The Council of the City of Jefferson, Missouri, hereby declares it necessary,
reasonable and proper to discontinue and forever vacate the following EASEMENT, finding the following
described EASEMENT surplus property of the City and no longer needed for any public purpose:
All of the easement described in Book 282, page 627, Cole County Recorder's Office that lies
within the boundary of"Tract B, Westview Heights Subdivision Section 9, per plat of record in Plat
Book 11, page 152, Cole County Recorder's Office; said Westview Heights Subdivision Section 9,
being a subdivision of the East Half of Section 13, Township 44 North, Range 13 West, and all of
Lots No.s 394, 395 and 396 of Westview Heights Subdivision Section 7."
See attached "EXHIBIT A."
Section 2. The EASEMENT described in Section 1 is hereby relinquished, and the City does
hereby release and abandon whatever interest it has in the easement.
Section 3. The Mayor and City Clerk of the City are hereby authorized to execute any necessary
legal documents required to confirm the relinquishing all of the City's interest in the tract described in
Section 1.
Section 4. This Ordinance shall be in full force and effect from and after the date of its passage
and approval.
