HomeMy Public PortalAbout11-03-2003 Emergency Session Closed SessionMinutes unsealed by town attorney on April 16, 2019 It was decided that Town Attorney Hornik will get the Temporary Restraining Order and that Police Chief Nathaniel Eubanks, Commissioner Michel Gering, and Assistant Town Manager Demetric Potts will meet with Mr. Roeser to offer $15,000 after work is done, then $5,000 within 30 days, and then discuss $5,000 contingency payment. The Temporary Restraining Order will be served, if necessary, by the Orange County Sheriff's Department and/or the Hillsborough Police Department. The Clock Committee Members were excused from the meeting. Town Attorney Hornik updated the Board that the attorney for Corbinton Commons stated that they plan to sue the Town because they believe the protest petition requiring the super majority vote that terminated the project was not valid because they claim they submitted a second application and a new protest petition was not filed. Hornik stated that he believes the Town followed proper procedure and the Town's action are valid and would likely be upheld in Court. Hornik stated that he will tell the Corbinton Attorney that the Town Board does not want to negotiate or alter its position. Upon a motion by Commissioner Dancy, seconded by Commissioner Lloyd, the Board moved to return to Open Session by a vote of 5-0. The motion was declared passed. w� Donna F.
