Call to Order and Introduction of Members, Ex -officio Members and Staff The Chairman and seven regular members were present. A quorum was present. 2. Procedural Matters and Procedures Explained Mr. Barron explained the procedures for the meeting. The following documents were entered as exhibits. Mr. Barron advised that copies of the exhibits are available through the City Clerk or the Department of Planning and Protective Services: The City Code of the City of Jefferson, as amended Comprehensive Plan and Land Use Map Copies of applications under consideration A list of property owners to whom notices were sent Affidavit of publication of the public notice in the newspaper Rules of Procedure, Planning & Zoning Commission Mr. Barron submitted the following items for the record: Staff reports Minutes of proceedings Copies of drawings, plans, and/or renderings under consideration Letters or memoranda from staff Materials submitted by the public or applicants pertaining to the cases under consideration Designation of Voting Alternates The Chairman announced that all regular members are eligible to vote. Mr. Nunn will be abstaining from voting on Case No. P14011. 3. Adoption of Agenda Mr. Nunn moved and Mr. Dutoi seconded to adopt the agenda as printed. Approval of Minutes from the Regular Meeting of June 12, 2014 Mr. George moved and Mr. Dutoi seconded to approve the minutes of the Regular Meeting of June 12, 2014 as written. The motion passed 7-0 with the following votes: Aye: Deeken, Dutoi, George, Lester, Nunn, Vaughan, Yarnell S. Communications Received Correspondence was received for Case No. P14011. 6. New Business/Public Hearings Case No. P14011 — 2104 Industrial Drive, Rezoning from RS -3 to C-2 and Comprehensive Plan Amendment. Staff initiated proposal to rezone 1.1 acres from RS -3 Single Family Residential to C-2 General Commercial and an associated amendment to the Comprehensive Plan Development Plan Map to show the property as Commercial. The property consists of Old Fire Station Number 3 and is located on the north side of Industrial Drive 1000 feet west of Dix Road. The property is described as part of the Southeast Quarter of Section 2, Township 44 North, Range 12 West, Jefferson City, Missouri. Mr. Barron described the proposal and explained that the City of Jefferson owns the subject property and has operated a fire station on the property since the 1960's. He stated that a cellular tower is also located toward the rear of the property. Mr. Barron explained that with the construction of new Fire Station Number Three on Rock Hill Road/Highway 179, the existing fire station on this property is no longer required. He stated that the City intends to split the property so that the fire station and cellular tower will be on separate tracts. Mr. Barron explained that the fire station would then be offered up for sale and the tract with the cellular tower is planned to be retained by the City. He stated that the property is zoned RS -3 Single Family Residential, which would prohibit any commercial utilization of the fire station building to a future buyer. He stated that in order to allow the building to be used commercially, staff is proposing a rezoning of the fire station portion of the property to C-2 General Commercial and an associated comprehensive plan amendment to support the commercial rezoning. Mr. Barron explained that the RS -3 zoning for the rear portion of the property, including the cellular tower, is not proposed to change. Mr. Dutoi expressed concerns that the proposed C-2 zoning designation would allow businesses such as gas stations that could create significant amounts of light and noise that would have a negative impact on the adjoining residential neighborhood. After additional discussion, Mr. Barron suggested a C-1 Neighborhood Commercial zoning district. He explained that this would address concerns of a gas station or drive through restaurant which is a prohibited use in the C-1 zoning district. Mr. Barron stated that a contractor trade shop, which is a potential use of the building, is allowed with a conditional use permit in the C-1 zoning district. Mr. Robinett inquired whether this case needs to be re -advertised since the zoning designation is being amended. Mr. Barron explained that the proposed zoning designation can be amended without having to be re -advertise as long as it is going from a more intensive to a less intensive zoning district. He stated that if it was going from a less intensive to a more intensive zoning district or changing categories then it would have to be re -advertised. Mr. Robinett inquired whether the zoning could be amended to C -O Office Commercial. Mr. Barron explained that if zoned C -O the use of the building would be limited to office type uses. He stated that a contractor trade shop is a fairly common use along Industrial Drive and a C -O zoning would eliminate that use. Mr. Barron also stated that a C -O zoning would be much less intense than many of the existing uses and zoning designations on this section of Industrial Drive. No one spoke in opposition to this request. Correspondence in opposition to this request was received from Deborah Holzer, Richard A. Howerton Properties and Development Inc.,720 Heisinger Road. Mr. Dutoi moved and Mr. Lester seconded to approve the comprehensive plan amendment to show the property as commercial on the development plan map. The motion passed 6-0 with the following vote: Aye: Deeken, Dutoi, George, Lester, Vaughan, Yarnell Abstain: Nunn Mr. Dutoi moved and Mr. Lester seconded to recommend approval to rezone the property from RS -3 to C-1 to the City Council. The motion passed 6-0 with the following vote: Aye: Deeken, Dutoi, George, Lester, Vaughan, Yarnell Abstain: Nunn 7. Other Business A. Discussion of Zoning Code Amendments Pertaining to On -Street Parking Mr. Barron explained that the Zoning Code does not reflect on -street parking as being able to meet a properties parking requirement, especially in the older sections of the City. He proposed the following options: (1) reduce parking based on street frontage; (2) reduce parking based on use; (3) blanket reduction in parking; and (4) location —where in City to reduce parking requirements. Mr. Lester suggested conducting a study to implement these options. Staff indicated that they would continue to research parking options and return to the P&Z Commission with proposals. B. Scheduled Reports —Environmental Quality Commission Mr. Lester reported that the Commission is focusing on the Make Your Mark Campaign. C. Appointment of Representative to the Environmental Quality Commission Chairman Robinett re -appointed Mr. Lester as Representative to the Environmental Quality Commission. a. Adjourn.
