March 18, 1975
The Regular Monthly Meeting of Savannah Beach City Council
was held this evening at 7:00 p.m. in City Hall Council Room
with Mayor Michael J. Counihan presiding and a quorum of the
following Councilmen present: Richard DeLoach, John Wylly,
Ernest Hosti, James Bond and Joseph Agnew. Councilman Ed.
Fahey absent. City Attorney William H. Pinson absent, his
place being taken by Mr. Luhr Beckman.
Visitors and petitioners present at the meeting were:
William Whelan, Richard Crosse, Laura Mackey, Mr. & Mrs.
Dixon, Mrs. Karen Losey, Mrs. Leon Case, Walter Parker and
Franklin Burnsed, City. Building Inspector.
. Councilman Agnew introduced Mr. & Mrs. Dixon who
had made application to the City for a business license for
a Food Service on Wheels. This proposed mobile food store
operation was outlined by Mr. & Mrs. Dixon.
The next speaker, Mrs. Laura Mackey, informed Council
that the parents of her students in her ABC School were not
able to get to the school to bring the children and pick
them up due to getting stuck in the mud and requested some
help from the City in correcting this situation. Councilman
Ernest Hosti informed Mrs. Mackey that Mr. Reed was supposed
to have done something about this already but that he would
check into it and see that it is taken care of.
Mr. Walter Parker, former Councilman, appeared before
Council to request that the traffic flow on Sixteenth Street
remain as it is. He also stated that he would like to see
the small salary restored to the Mayor and Councilmen.
Mr. Bill Saxman of the Metropolitan Planning Commission
explained to Council some of the problems we were experiencing
with our Sand Dune Ordinance and various zoning problems.

Councilman James Bond informed Council of a proposal
by Thomas and Hutton Engineering Co. to rehabilitate our
Sewer Department so that it would conform to the guide lines
of the Envoronmental Protection Agency. He then read the
following proposal from Thomas and Hutton.

Following the reading of the proposal, Councilman Bond
moved that it be accepted. This motion was seconded by
Councilman Richard DeLoach and unanimously carried.
Mayor Counihan then requested the Clerk to read the
proposed appointments to the Savannah Beach Planning Com-
mission which were as• follows:

A motion was then made by Councilman Hosti that these
appointments be confirmed. The motion was seconded by Council-
man Wylly and unanimously carried.
Councilman Joe Agnew read a letter of City of Savannah
City Manager informing us that our share of the Wastewater
Facilities Plan for Chatham County was $1,117.00. He then
read the following Resolution authorizing the City of.
Savannah Beach to participate with the City of Savannah in
planning for the construction of environmentally sound,
cost effective and implementable sewerage treatment facili-
ties adequate to meet the minimum Georgia and Federal waste-
water treatment requirements:
.RESOLUTION
Following the reading of the Resolution, Councilman
Agnew moved that it be adopted. .This motion was seconded by
Councilman Wylly and unanimously carried.
In the absence of Councilman Fahey, Councilman Bond
reported on the status of the Animal Ordinance and recom-
mended that a mixed group of citizens, both pros and cons
be selected to study this problem and see if they could
come up with a solution.
Mayor Counihan stated that the next item on the agenda
concerned a petition filed by a group of citizens and resi-
dents concerning the flow of traffic on Sixteenth Street,
requesting that it be returned to its former status. He
then asked Council for authority to appoint a committee to
review it, study it and act upon it immediately as the season
opening was rapidly approaching. Councilman Wylly then moved

that the Mayor appoint a committee to make a study of this
problem and the petition. The motion was seconded by Council-
man Bond and unanimously carried. The Mayor then appointed
Councilman Ernest Hosti, Richard DeLoach and John Wylly as
a committee to look into this and stated they had power to
act. Several other Councilmen indicated their desire to
serve on this committee so the Mayor announced that all six
Councilmen would serve as a committee.
Mayor Counihan then called upon the Clerk to read the
following letter dated March 11, 1975, received from the
Department of Housing and Urban Development in Washington,
D.C. via Certified Mail.
LETTER FROM HUD
Following the reading of this letter, Council recommen-
ded that this be turned over to our City Attorney for the
necessary legal procedure to put the City of Savannah Beach
in compliance with these regulations.
With reference to the application of Mr. & Mrs. Dixon
for a license to operate a mobile food service vehicle for
the sale of pizzas and related products, Mayor Counihan
appointed Councilman Ernest Hosti, Richard DeLoach and John
Wylly to examine this thoroughly; look into the ordinance
and come back in with a decision. Councilman Agnew reminded
the committee that an amendment to our Business License
Ordinance would be necessary to grant this license.
The Clerk then read the following letter from City
Attorney William H. Pinson, addresed to the Mayor and Council
concerning the proposed change to our Charter relating to the
election of Mayor and Councilmen and terms of each.
LETTER FROM CITY ATTORNEY
In explanation of this letter, Attorney Luhr Beckman
stated they were merely trying to find out the wishes of
Council on this matter - what direction they as the City's
attorneys should take in the matter. It was the opinion of
Council that they should contact Senator McDowell or take
whatever steps they felt necessary to carry this forward.
It was brought out that in order to carry out the re-
quirements of our Weed Ordinance it would be necessary to
appoint a Health Officer from the City of Savannah Beach.
To accomplish this, the following Resolution appointing
Mr. Loren E. Taylor was read for Council's adoption:

RESOLUTION
Following the reading of this Resolution, Councilman
Agnew moved its adoption. The motion was seconded by
Councilman Hosti and unanimously adopted.
The Clerk then announced that the Schedule for Chatham
County Rabies Vaccination Clinics had been received and the
clinic for Savannah Beach was to be held on Wednesday, April
2nd at Savannah Beach. Post Office conducted by Dr. Case.
A letter from Mr. Richard. Grosse was then read by the
Clerk in which several complaints were registered by Mr.
Grosse in regard to a violation of Savannah Beach Zoning
Ordinance which was now in existance at the Rivers End
Campgrounds. He stated that the campgrounds had been know-
ingly leasing trailer spaces on a long term basis and accept-
ing payment for this thereby making said trailers full time
residents. He requested that the City enforce its zoning
laws which would outlaw this practice. There seemed to be
some conflict as to what constituted a resident in the State
of Georgia and Mr. Grosse stated that a resident was defined
as a person who ends his children to a public shcool and who
has resided in on place for thirty days or more. Mr. Grosse
continued stating that- me of the residents of this trailer
park were attending our pb,blic schools at the present time.
Mayor Counihan appointed tpe Health Officer and the Building
Inspector to go over to this campsite, check those who are
staying there at the pres nt time to determine if any of
them were permanent residents and report back at the next
Council Meeting.
Mr. Grosse informed Council that he would be glad to
give the City an easement across his property in order that
the various lines in that area might be connected.
Councilman Bond stated to Council that he would like to
go on record concerning the Beach Erosion Project that if
the State of Georgia fails to come up with $350,000.00, they
will be in violation of a contract that they have with
Savannah Beach, Chatham County and the United States of
America. Mayor Counihan requested our City Attorney to
look into this matter as explained by Councilman Bond and
give Council a report in writing.
Councilman Wylly stated that he felt this matter called
for burther discussion. He said they had tried to contact
Senator Riley and that over the week -end we had a visit and
an inspection from a representative of Congressman Bo Ginn's
office; together with two attorneys representing the House
Public Works Committee and the Federal Government has a

couple of million dollars in Washington waiting on us to
get our re- nourishment program underway. He added that if
our delegates up in Atlanta fail to get our State money put
back in the budget we will lose all of our Federal money
for the second phase of our Beach Erosion Project. Council-
man Hosti stated that we should see if we can go ahead without
this $350,000.00. Attorney Beckman stated that the problem,
as he understood it, was as follows: Phase II begins with a
contract for three years which doesn't necessarily mean that
the project is going to take three years and it is possible
that this same work could possibly be done in one year at a
cheaper cost. A lengthy discussion followed during which the
Clerk reported on several telephone conversations received
from Senator McDowell. Councilman Agnew gave an interpreta-
tion of the stipulations in the contract and agreement with,
reference to the land to be acquired for the project and
Attorney Beckman reported on the aspects of the so- called
"scenic easement" and that the contract does not provide
for the Federal Government to hold title to all of this land
acquired for the Project. Councilman Agnew stated further
that Senator McDowell had been informed that if he would
contact Attorney Silverman of the Corps of Engineers, he
would straighten him out on the acquisition and title of
this land.
Councilman Johy Wylly complained that Chatham County had
promised us two all new tennis courts to replace our one bad
one. He stated he is now informed by the County Recreation
Department that instead of two new courts, they are going to
re -paint the lines on the existing court and probably replace
the fence on either end. He stated further -that he could
not understand what the County does with all of our tax dollars
if they can't put a couple of tennis courts down here. Mr.
Wylly stated further that Savannah Beach was supposed to be
a recreation area for Chatham County and we don't even have
a place to play tennis - not to mention all the other things
we DON'T get . from the County.
Bills of the various departments for the Month of February
were approved for payment.
Councilman Agnew stated that he had been contacted by
Mrs. George Chandler who stated that her son had been injured
last summer while on duty as a life guard and that workmens
compensation had paid for everything except $11.00 and re-
quested payment of this $11.00 by the City. Payment of this
claim was agreeable with Council; however, Attorney Beckman
felt that even though the $11.00 was a small amount the City

might be setting a bad precedent and the act on the part
of the. City paying this claim might be illegal. Mayor
Counihan then turned this matter over to the City Attorney
for his investigation.
Attorney Luhr Beckman reported that the Flood Insurance
Ordinance was being prepared and should be ready for adoption
by the next Council Meeting.
Attorney Beckman stated that Mr. Joseph Hutton, in a
letter to their firm dated February 17, 1975, stated that
he had reviewed the proposed sewer ordinance and found it
satisfactory except in two respects. The letter went on
to say that the Ordinance as written permits concrete sewer
pipe which has been troublesome at Tybee and does not. permit
P.V.C. pipe which is now used most frequently. Mr. Hutton
suggested that these conditions be corrected by making the
following changes:
Section 20 -44 (e) delete "or concrete pipe ASTM Specification
C -14" Add "or Polyvinyl Chloride with integial
wall bell and spigot joints with a rubber ring
gasket. Pipe and fittings shall conform to
ASTM D-3-34".
Section 20 -44 (j) delete in 3rd paragraph "All joints etc."
substitute "All joints in vetrified clay shall
be made by using rubber gaskets or preformed,
factory applied couplings having resilient
properties in accordance with ASTM Specification
C -425 for vetrified clay pipe ".
Attorney Beckman then stated that Council should actually
amend the ordinance adopted on February 17, 1975 to reflect the
changes made by Joe Hutton in his letter. Attorney Beckman
stated that they had gotten together with the City Clerk and .
already made the necessary correction in the Ordinance to
reflect these changes but needed to be formally adopted by
unanimous consent at this meeting. Councilman Bond then moved
that these amendments be adopted on first and second readings
at this meeting by unanimous consent. The motion was seconded
by Councilman Agnew and unanimously carried_

Mr. James S. Bond III has asked for our assistance in setting up a
Sewer Department capable of operating and maintaining the sewage treatment
plant, pumping stations and collection system in accordance with State and
E.P.A. Guidelines . He has also asked that we assist in getting the existing
plant and pumping stations into a condition that will meet the requirements of
the State and Federal agencies.
In our opinion this assistance would include the following services:
1. Prepare a table of organization that will be required to
maintain and operate the system.
2. For each position list the following:
a. Functions to be performed and responsibility.
b. The minimum qualifications for the starting
grade within each position.
c. The skills and experience that would qualify
a man for the top grade in each position.
d. Range of salary that would be paid to those who
qualify for the starting up to the top grade.
3. When you have filled the key positions, we would then:
a. Instruct each man in the essential duties of
his position.
b. Show each man how to make minor repairs,
operate, and maintain each piece of equipment
for which he is responsible.
c. Instruct the treatment plant operator in the theory
and operation of the plant with particular emphasis
on in -plant monitoring to save power consump-
tion and chemicals and to get maximum
efficiency from the plant.
d. Point out the problems that are apt to occur and
the probable solutions.
e. Prepare lubrication and maintenance schedule
of all equipment with check list for recording
compliance with the schedule.

4. Prepare plans and specifications for rehabilitation of the
treatment plant. and pumping stations to bring this equipment into
condition where they can perform as designed. Prepare advertise-
ments for bids that the City can send to contractors qualified to do
the work. Supervise the rehabilitation work.
It is impossible to determine in advance the time our personnel must
spend to perform the above services because so much depends upon the capability
of the men you select for the key positions. We will therefore charge for these
services at the hourly rates of the personnel required plus the cost of telephone,
travel, etc. Invoices will be submitted monthly and the services can be termi-
nated whenever you desire.
If this proposal is satisfactory, please sign it where indicated and return
one copy to us.

R E S O L U T I O N
WHEREAS, the City of Savannah Beach, Georgia proposes to
construct projects for the abatement of water pollution consist-
ing of wastewater treatment works, and
WHEREAS, Public Law 92 -500, Title II Regulations (40 CFR
35.917) require facilities planning as an element of the con-
struction of publicly owned wastewater treatment works, and
WHEREAS, it is necessary and in the public interest that
the City of Savannah Beach, Georgia participate with the City of
Savannah in planning for the construction of environmentally
sound, cost effective, and implementable sewerage treatment
facilities adequate to meet the minimum Georgia and Federal waste-
water treatment requirements, and
WHEREAS, the Georgia Department of Natural Resources,
Environmental Protection Division has designated a facilities
planning area and allocated, from Georgia's 1974 federal allotment,
funds to pay for 75% of the cost of preparing the plan, and
WHEREAS, the City of Savannah Beach has now been informed
by Mr. Arthur A. Mendonsa, City Manager of the City of Savannah,
Georgia, that a cost distribution chart prepared by the consulting
engineers indicates that the Savannah Beach share of the local
cost of the Facilities Plan to be $1,117.00 and that this payment
shall be made at the completion of the project.
NOW THEREFORE, BE IT RESOLVED by the Mayor and Councilmen
of the City of Savannah Beach, Tybee Island, Georgia, in Council
duly assembled, that the Mayor of the City of Savannah Beach is
hereby authorized and directed to enter into agreement with the
City of Savannah to pay its proportionate share of the local cost
of this project to the City of Savannah, Georgia, lead applicant
of this project.

When the City of Savannah Beach applied for eligibility for the sale
of subsidized flood insurance under the National Flood Insurance
Program, it made the statutory commitment to us and to its citizens
that it would adopt adequate flood plain management measures with
effective enforcement provisions to require local builders and
developers to take the necessary steps to reduce or avoid needless
flood damage in connection with future construction. '
On February 23, 1973, we notified the City of Savannah Beach that
based on a review of the City's submitted data we found that the City
had not adopted flood plain management measures in accordance with the
provisions of Section 1910.3 of our regulations. In response to this
notification, the City sent us a letter dated May 18, 1973, stating
the authorities of the City had contacted the Georgia Department of
Natural Resources to obtain advice regarding the necessary actions
the City would have to take to meet the standards of the program
regulations. Due to a delay on the State's part in preparing a
proposal, the City requested an extension of time in order for the
necessary actions to be taken. Since this request was made, we have
not been advised that the City of Savannah Beach has taken any steps
towards complying with the program regulations.
We are enclosing with this letter a statement detailing the specific
deficiencies in the City of Savannah Beach's submitted flood plain
management measures.

You are advised that unless, within 90 days of receipt of this letter,
you fully comply with the requirements of our regulations, the City
of Savannah Beach's eligibility for the sale of flood insurance will
be suspended pursuant to Section 1909.24 of the regulations. No
floo insurance may be sold or renewed in any suspended community.

methods, materials and be anchored to minimize flood

In Re: Proposed Change to Charter Relating
to Election of Mayor & Councilmen
and Terms of Each.
Dear Mayor & Council:
Several months ago, I was requested to look into the possibility
of amending our charter and to submit a proposed amendment
for adoption by the legislature allowing the change of terms
of, office for Mayor and Council to place it on a staggered basis.
I did prepare the amendment and submit it to Council. I also
provided Council with copies to submit to our legislative dele-
gation.
After a delegation of our Council went to Atlanta for Mayor's
Day activities, I was informed that several Councilmen had
met with our legislative delegation and that the proposed change
had been taken care of with our local legislators and legis-
lative council. Therefore, I was requested not to proceed any
further on this project.
The purpose of this letter is simply to remind you of the status
of this project so that you can take whatever action you feel
necessary.

R E S O L U T I O N
WHEREAS, the Code of Ordinances, Savannah Beach,
Tybee Island, Georgia, Sec. 2 -10, provides that a City Health
Officer shall be elected by the governing body; and
WHEREAS, it is necessary to appoint a Health Officer,
and it is the desire of the present Mayor and Council that
LORAN E. TAYLOR be so appointed;
NOW, THEREFORE, BE IT RESOLVED that the City of
Savannah Beach, in Council assembled, pursuant to the authority
invested in it by the Code of Ordinances, does hereby appoint
LORAN E. TAYLOR as the City Health Officer, Savannah Beach,
Tybee Island, Georgia.
The within resolution is ADOPTED and APPROVED this
18th day of March, 1975.
