A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD
APPROVING THE FOURTH AMENDMENT TO THE AGREEMENT WITH
WILLDAN ENGINEERING IN THE AMOUNT NOT TO EXCEED $39,100
WHEREAS, the State of California Natural Resources awarded the City grant
funding under the Urban Greening Grant Program for $2,853,000 for the development
of the Lynwood Urban Bicycle Trail (Project) along Caltrans Right of Way adjacent to
the 1-105 Freeway; and
WHEREAS, the San Gabriel and Los Angeles Rivers and Mountains
Conservancy (RMC) awarded the City grant funding for $841,180 for the Lynwood
Urban Bike Trail and Water Quality Improvements Project related to the bike trail
extension, and
WHEREAS, on July 3, 2018, the City Council approved a contract with Willdan
Engineering (Willdan) for $183,000 for the design of the Urban Bicycle Trail and
authorized the City Manager to amend the Agreement with the Consultant in an amount
not to exceed 25 percent of the contract price; and
WHEREAS, the Agreement with Willdan has been amended three times relating
to additional services relating to Caltrans requirements, such as preparation of Natural
Environmental Study with Minimal Impacts (NES-MI), Environmental Assessment (ESA)
Phase 1, Section 106 cultural resources studies and Right of Way Data Sheet, arsenic
impact excavation plan, soil management plan, and utility policy certification; and
WHEREAS, Caltrans is now requiring the preparation of additional documents
from the City including a Storm Water Pollution Prevention, Lead Compliance Plan, and
Quality Management Plan before it issues a construction permit; and
WHEREAS, staff anticipates oversight by Caltrans during construction; and
WHEREAS, Willdan can provide these additional services; and
WHEREAS, the parties seek to enter into a Fourth Amendment increasing the
contract award amount by $39,100 to secure the performance of these additional
services.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES
HEREBY FIND, PROCLAIM, ORDER AND RESOLVE AS FOLLOWS:
Section 1. The City Council of the City of Lynwood hereby finds and declares
that the foregoing recitals are true and correct, and incorporates them herein as findings
and as a substantive part of this Resolution

Section 2. That the City Council authorizes the Mayor to execute the Fourth
Contract Amendment to the Professional Services Agreement, in a form approved by
the City Attorney, with Willdan Engineering.
Section 3. Authorize the Mayor to execute the Resolution for and on behalf of
the City of Lynwood.
Section 4. That this Rresolution shall take effect immediately upon its
adoption.

3
