CLOSED SESSION MINUTES
Board of Commissioners Monthly Workshop
Monday, July 26, 2004 at 7:30 PM
Town Barn
The Hillsborough Town Board held a Closed Session during their monthly Workshop on July 26,
2004 at 7:30 PM in the Hillsborough Town Barn. Present for the Workshop’s Closed Session
were Mayor Joe Phelps, and Commissioners Mike Gering, Frances Dancy, and Evelyn Lloyd.
Absent from the Workshop were Commissioners Brian Lowen, and L. Eric Hallman. Staff
present were Town Manager Eric Peterson, Planning Director Margaret Hauth, Assistant Town
Manager/Public Works Director Demetric Potts, and Town Attorney Bob Hornik.
Closed Session as authorized by North Carolina General Statute Section 143-318.11.(a)(3) to
consult with Town Attorney concerning the position to be taken on behalf of the Town
regarding a Code Enforcement Issue and updates on litigation
Planning Director Margaret Hauth provided an update on a Zoning Violation at 518 Joyce Road.
She said she has been working with the tenant to have a junked car removed, but has been
unsuccessful. The members indicated a willingness to authorize Town Attorney Bob Hornik to
proceed with enforcement.
Town Attorney Hornik provided updates on the various lawsuits. The members spent some time
discussion options in the Kenion Grove case. Mayor Joe Phelps suggested approaching the
owner to negotiate an improved design in return for not appealing. The members discussed this
option at length and the items they would like changed in the plan. The members agreed that the
primary concern was with the pavement width and safety risk of on street parking. Options that
might be acceptable include wider pavement (27 feet was suggested as a possibility), double-
width driveways, curb and gutter to protect the sidewalk. The desire for a wider sidewalk was
also discussed, but not as a sole improvement. Hauth asked if reconfiguring the front lots was
important, and after discussion, the members agreed that the trade-off of protected open space or
larger lots was not desirable. The members directed Hornik and Hauth to work with the
applicant and his advisors to see if an alternative plan that is mutually acceptable can be found.
Upon a motion by Commissioner Dancy, seconded by Commissioner Lloyd, the Board moved to
return to Open Session by a vote of 3-0. The motion was declared passed.
