HomeMy Public PortalAbout2022.110 (06-21-22) RESOLUTION NO. 2022.110 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA OPPOSING INITIATIVE 19-0029A WHEREAS, California initiative 19-0029 would amend the Constitution — authorizing roulette and games played with dice (such as craps) solely at tribal casinos; and WHEREAS, the initiative would also authorize sports wagering solely at tribal casinos and horse racing tracks; and WHEREAS, these changes to the Constitution guarantee tribal casinos a virtual monopoly on all gaming in California; and WHEREAS, California tribal casinos are an $8 billion-a-year industry, but are not subject to state income taxes, property taxes or local sales taxes, and WHEREAS, California tribal casinos promised they would contribute at least $9 billion to the state by 2030 in return for exclusivity on slot machine gambling, but instead sued California to avoid paying their fair share; and WHEREAS, California tribal casinos pay virtually nothing to the state or local governments to help fund critical needs like schools, public safety, and infrastructure; and WHEREAS, the fiscal analysis by the independent Legislative Analyst's Office found the tribal casino's monopoly on sports betting compared to other initiatives would result in a loss of hundreds of millions of dollars each year in taxes for the state that could go toward local programs; and WHEREAS, tribal casinos now want to give themselves a monopoly on sports betting — preventing online or mobile gaming that would generate $500 million each year in taxes for the state that could go toward local programs; and WHEREAS, the tribal casino initiative also changes the Constitution to allow tribal casinos to hire private trial lawyers and replace the role of the Attorney General to sue their non-tribal competitors; and WHEREAS, the potential for frivolous lawsuits could "negatively affects cardrooms, the local governments that receive revenues from cardrooms could experience a reduction in such revenues. In addition, the state and local governments could experience increased costs," according to the independent Legislative Analyst's Office analysis; and 1 WHEREAS, the Legislative Analyst's Office analysis said, "local governments could also experience decreased revenue," which could lead to higher taxes — hurting local taxpayers. NOW, THEREFORE, THE LYNWOOD CITY COUNCIL DOES HEREBY RESOLVE AND DETERMINE AS FOLLOWS: Section 1. The City Council of the City of Lynwood hereby finds and declares that the foregoing recitals are true and correct, and incorporates them herein as findings and as a substantive part of this Resolution. Section 2. The City Council of the City of Lynwood formally opposes Initiative 19- 0029 and urges California voters to reject the measure this November. Section 3. Authorize the Mayor to execute the Resolution for and on behalf of the City of Lynwood. Section 4. Authorize the Mayor to execute the Resolution for and on behalf of the City of Lynwood.
