AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, CHANGING,
AMENDING, AND MODIFYING THE ZONING MAP OF THE ZONING CODE OF THE
CITY OF JEFFERSON, BY REZONING 11.41 ACRES FROM M-1 LIGHT INDUSTRIAL
TO M-2 GENERAL INDUSTRIAL, FOR LAND ADDRESSED AS 355 NORTH
SHAMROCK ROAD, DESCRIBED AS PART OF NEW MADRID PRIVATE SURVEYS
NO. 2680 AND 2906 TOWNSHIP 44 NORTH, RANGE 11 WEST, JEFFERSON CITY,
COLE COUNTY, MISSOURI.
WHEREAS, It appears that the procedures set forth in the Zoning Code relating to
zoning have in all matters been complied with.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE CITY OF
JEFFERSON, MISSOURI, AS FOLLOWS:
Section 1. The following described real estate, containing 11.41 acres, in all, is
rezoned from M-1 Light Industrial to M-2 General Industrial:
Tract 1 (10.72 Acre Tract): A part of New Madrid Private Survey No. 2906, all in
Township 44 North, Range 11 West, Cole County, Missouri, said part of New
Madrid Private Survey No. 2906, being a portion of a tract labeled A2 on a plat
attached to the Will of Thomas Walter of record in Book 13, Page 140, Cole
County Recorder's Office, more particularly described as follows: From the
southwest corner of said Private Survey No. 2906; thence N84°51'25"E, along
the southerly line of said Private Survey No. 2906, and being the southerly line of
the tract labeled A2 in said Book 13, Page 140, 732.89 feet to the southeasterly
corner thereof; thence N01°15'09"E, along the easterly line of said tract A2,
1347.67 feet to a point in the center of a creek and the POINT OF BEGINNING
for this description; thence along the center of said creek the following courses:

Tract 2 (0.69 Acre Tract): A part of New Madrid Private Survey No. 2680 and a
part of New Madrid Private Survey No. 2906, all in Township 44 North, Range 11
West, Cole County, Missouri, that part of New Madrid Private Survey No. 2680,
being a portion of a 78 acre tract labeled No. 1, W. G. Robinson on a plat
attached to Report of Commissioners of record in Book 10, Page 523, Cole
County Recorder's Office, and said part of New Madrid Private Survey No. 2906,
being a portion of a tract labeled A2 on a plat attached to the Will of Thomas
Walter of record in Book 13, Page 140, Cole County Recorder's Office, all of

of-way, 5.43 feet to the southerly line of a tract conveyed for additional Algoa

Office; thence leaving the boundary of the aforesaid tract described in Book 362,

westerly line of the aforesaid Shamrock Road right-of-way; thence Southerly,
along said Shamrock Road right-of-way line, on a curve to the left, having a
radius of 408.81 feet, an arc distance of 277.37 feet, (the chord of said curve

New Business/Public Hearings
Case No. P14012 — 355 N. Shamrock Road, Rezoning from M-1 to M-2. Application filed by
JC Chamber of Commerce, property owner, to rezone 11.41 acres from M-1 Light Industrial to M-
2 General Industrial. The property is located at the intersection of N. Shamrock Road and Algoa
Road and is described as part of New Madrid Private Surveys No, 2680 and 2906, Township 44
North, Range 11 West, Jefferson City, Missouri.
Mr. Barron described the proposal and explained that the Jefferson City Chamber of Commerce
constructed a spec industrial building on the property in 2007. He stated that in order to allow for
more marketing flexibility and to attract a prospective new manufacturer, the Chamber is requesting
a rezoning from M-1 to M-2. Mr. Barron explained that permitted uses within the M-2 General
Industrial zoning district include recycling centers with outdoor storage and operations, industrial
uses with hazardous materials, outdoor freight storage, and asphalt plants. He stated that rezoning
of the property to M-2 would seem appropriate given the industrial nature of the Algoa Area and
proximity to high intensity industrial uses such as the Scholastic warehouse and the landfill.
Mr. Vaughan arrived at 5:24 p,m. Since Mr. Vaughan arrived after Case No. P14012 was
presented, he will participate in discussion but will not vote. Mr. Fitzwater was designated to vote in
his place.
Mr. Randy Allen, President and CEO, Jefferson City Area Chamber of Commerce, 213 Adams
Street, spoke regarding this request and explained that a spec building was constructed on the
subject property in 2007. He stated that in the first year and a half they had five prospects that did
not follow through because of the economy. Mr. Allen explained that recently there has been more
interest but it appears that the type of manufacturer that is looking for this type of use requires a
significant amount of outdoor storage. He stated that they are requesting to rezone the property in
order to attract a prospective manufacturer.

Mr. Barron gave the Planning Division staff report,
Mr. Nunn moved and Mr. George seconded to recommend approval to rezone the property from
M-1 to M-2 to the City Council. The motion passed 8-0 with the following votes:

applicable city wide and not dependent onthe specific zoning designation,

It's sometimes difficult tojustify why the AlgoaIndustrial park area bzoned "|'ht" rather than
"general" industrial. The M-1 Light Industrial District is meant to accommodate limited, light industries
whereas the M-2 General Industrial District is meant to permit more intensive manufacturing and
processing nfraw materials.
