September 25, 1975
A Special Called Meeting of Savannah Beach City Council was
held this evening at 7:30 P.M. in the auditorium of City Hall for
the purpose of receiving the certified results of the Special
Election 'held on September 17, 1975 pertaining to local option
bar closing hours at Savannah Beach from the Elections Board of
Chatham County and to adopt a Resolution accepting the results
of this Special Election as certified and to adopt an Ordinance
amending the present Ordinance of the City of Savannah Beach
relating to business hours for establishments selling alcoholic
beverages by the drink accordingly.
In the absence of Mayor Counihan, the meeting was presided
over by Mayor Pro Tem J. M. Agnew and a quorum consisting of the
following Councilmen was present: Edward J. Fahey, James Bond,
Robert Davenport, John Wylly and Richard DeLoach. City Attorney
William H. Pinson was also present.
The meeting was opened by Mayor Pro Tem Agnew, who called
upon the Clerk to read the results of the Special Election held
on September 17, 1975 as certified by the Elections Board of
Chatham County, which he read as follows:
CERTIFIED RESULTS OF SPECIAL ELECTION OF SEPTEMBER 17, 1975
The Certified Results, as read by the Clerk, revealed that
the question of whether or not the local bars should be allowed
to remain open on Sunday morning until 2:55 A.M., received an
affirmative vote from Savannah Beach electors as follows: YES - 469
and NO - 168.
Following the reading of this certification, the Clerk read
the following Resolution:.
RESOLUTION
Following the reading of the Resolution, Councilman Fahey
moved its adoption. The motion was seconded by Councilman Davenport
and unanimously adopted. Councilman Agnew requested that the records
show that he was unable to vote in this balloting due to his
presiding as Mayor Pro Tem; however, he wanted the records to show
that had he been allowed to vote, it would have been a negative one.
The Clerk was then requested to read the following Ordinance
amending the present City Ordinance pertaining to the hours during
which alcoholic beverages by the drink may be sold:

ORDINANCE
Following the reading of this Ordinance a motion was made
by Councilman Fahey that this amending Ordinance be adopted on
first and second reading at this meeting by unanimous consent.
This motion was seconded by Councilman Wylly and unanimously
carried on first and second reading.
Following the adoption of the new closing hours,
instructed the Clerk to inform the news media of this
them at this evening's meeting.
There being no further business, the meeting was
to the next regular or special called meeting..

R E S O L U T I O N
WHEREAS, pursuant to Act Number 207 of the
recent Georgia Legislature, signed and approved by the
Governor of Georgia on April 17, 1975, the Election Board
of Chatham County, Georgia conducted a special election on
September 17, 1975 at Savannah Beach, Tybee Island, Georgia
for the purpose of determining whether business hours for
establishments selling alcoholic beverages or distilled
spirits by the drink should be extended on Sunday morning;
and,
WHEREAS, it appears that the certified result of
the special referendum for extending business hours for
establishments selling alcoholic beverages at Savannah
Beach, Tybee Island, Georgia were 469 votes for and 168
votes against.
NOW THEREFORE BE IT RESOLVED, by the Mayor and
Council of the City of Savannah Beach, Tybee Island, Georgia
in Council duly assembled and it is hereby resolved by
the authority of the same that the present Ordinance of
the City of Savannah Beach relating to Business hours for
establishments selling alcoholic beverages by the drink
be amended in accordance with the referendum hereinabove
noted.

O R D I N A N C E
AN ORDINANCE AMENDING CHAPTER 3, ARTICLE I, SECTION
3 -1, OF THE CODE OF ORDINANCES, CITY OF SAVANNAH
BEACH, TYBEE ISLAND, GEORGIA, PERTAINING TO ALCOHOLIC
BEVERAGES, BUSINESS HOURS, SO AS TO REDEFINE THE TIMES
THAT ALCOHOLIC BEVERAGES OR DISTILLED SPIRITS FOR
BEVERAGE PURPOSES BY THE DRINK MAY BE SOLD BY PERSONS
OR BUSINESSES HAVING LICENSES ISSUED BY THE MUNICIPALITY.
BE IT ORDAINED BY THE MAYOR AND COUNCILMEN in Council
duly assembled and it is hereby ordained as follows:
SECTION 3 -1, Chapter 3, Article 1 of the Code of Ordi-
nances, City of Savannah Beach, Tybee Island, Georgia, is stricken
in its entirety and the following is inserted in lieu thereof:
SECTION 3 -1. BUSINESS HOURS - SPECIFIED; AND RESPONSIBILITY
FOR COMPLIANCE.
The Mayor and Councilmen of the City of Savannah Beach,
Tybee Island, Georgia, in adopting this Ordinance hereby decree
that the provisions, rules and regulations herein shall be applic-
able to all establishments and bars within the limits of the
municipality; shall control and govern the operation of such
establishments, shall be reduced to written form, distributed
and served on all licensees of such establishments within the
City, and the violation of any such provisions, rules and regulations
shall be subject to the penalty herein prescribed.
(a) The following rules and regulations shall apply
for the retail sale of alcoholic beverages, distilled
spirits or spirituous liquors for beverage purpose by
the drink, such sales to be for consumption on the premises
only;
1. It shall be unlawful for any person or business
to sell or offer for sale any alcoholic beverages,
distilled spirits, or spirituous liquors for
beverage purposes by the drink for consumption on
the premises as such terms are defined by GA Code
section 58 -1011 during the following times:
SUNDAY 2:56 a.m. to 9:00 a.m. MONDAY
TUESDAY 4:01 a.m. to 9:00 a.m. TUESDAY
WEDNESDAY 4:01 a.m. to 9:00 a.m. WEDNESDAY
THURSDAY 4:01 a.m. to 9:00 a.m. THURSDAY
FRIDAY 4:01 a.m. to 9:00 a.m. FRIDAY
SATURDAY 4:01 a.m. to 9:00 a.m. SATURDAY

2. Said Business will close and shall not open
and operate between the hours of 2:56 a.m. on
Sunday and 9:00 a.m. on Monday of each week.
ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT
HEREWITH ARE REPEALED.
ADOPTED in Open Council Meeting this the 25th day
of September , 1975.
