Motion by Nielsen second by Lindaman to approve the minutes of the April meeting. All ayes, carried. Motion by Van Heiden second by James to approve the Treasurer’s Report for April. All ayes, carried. Motion by Nielsen second by Meints to approve the following bills for payment. Motion by Nielsen second by Lindaman to approve the Sheriff’s Contract for FY2006. All ayes, carried. The Mayor declared that this was the time and place for a public hearing on the proposed FY 2005 budget amendment. Being there were no oral or written objections the Mayor declared the public hearing closed. Motion by Van Heiden second by James to approve Resolution 05-2005-1 a resolution approving a budget amendment for FY 2005. Roll call of votes. All ayes, carried. Meg Harms and Sara Winkowitsch gave a report on the swimming pool. Greg Riebkes, Library Board, presented the library report. Terry Babcock, Community Club President, thanked the council for their support and presented information regarding the 125th Celebration. Motion by James second by Meints to approve a firework’s permit for the City of Wellsburg for Wellsburg Daze. All ayes, carried. The Mayor declared that this was the time and the place for the public hearing on the Interstate Power Franchise Agreements. Being there were no oral or written objections the Mayor declared the public hearing closed. Council Member Lindaman offered Ordinance No. 05-2005 an ordinance granting Interstate Power and Light Company the right to erect and maintain an electric distribution system in the City of Wellsburg. It was moved by Lindaman seconded by Meints that said ordinance be placed upon it first reading. Roll call of votes. Ayes: Lindaman, James, Meints, Nielsen, and Van Heiden. Five Members of the Council being present and having voted yes, Mayor declared said motion carried, and said Ordinance was placed upon its first reading and was read the first time. Thereupon, it was moved by Council Member Lindaman, and seconded by Council Member Meints that the laws and rules providing that ordinances shall be fully and distinctly read on three different days be suspended and dispensed with, and the Ordinance 05-2005 be placed on its last reading. Roll call of votes. Ayes: Lindaman, James, Meints, Nielsen and Van Heiden. Five members of the Council being present and having voted yes, Mayor Fox declared the motion carried, or Ordinance 05-2005 was placed upon its last reading and was read the last time. Thereupon, it was moved by Lindaman and seconded by Meints that Ordinance 05-2005 be placed upon its final passage and passed. Roll call of votes. Ayes: Lindaman, James, Meints, Nielsen, and Van Heiden. Five Members of the Council being present and having voted yes, Mayor Fox declared the motion carried, and the Ordinance passed and adopted. Council Member Lindaman offered Ordinance 05-2005-2, an ordinance granting Interstate Power and Light Company the right to franchise a gas distribution system in the City of Wellsburg. It was moved by Lindaman seconded by Meints that said ordinance be placed upon it first reading. Roll call of votes. Ayes: Lindaman, James, Meints, Nielsen, and Van Heiden. Five Members of the Council being present and having voted yes, Mayor declared said motion carried, and said Ordinance was placed upon its first reading and was read the first time. Motion by Nielsen second by Van Heiden approve Resolution 05-2005-2 a resolution concerning acceptance and compliance with various requirements to obtain financial assistance from the United States of America, acting through the United State Department of Agriculture, Rural Development. Roll call of votes. All ayes. Carried. Motion by Van Heiden second by Meints to approve Resolution 05-2005-2 a resolution setting date of public hearing on plans, specifications, form of contract, estimate of cost, and notice to contractor for receipt of bids. Roll call of votes. All ayes, carried. Motion by Nielsen second by James to approve building permit for Lee Boomgarden. All ayes, carried. Motion by Nielsen second by Lindaman to approve building permit for Tom Eiten. All ayes, carried. Motion by Lindaman second by James to approve building permit for Roland Van Deest. All ayes, carried. Motion by Nielsen second by James to approve a building permit for an apartment complex for Roland Van Deest and allowing for a front yard variance. All ayes, carried.
