October 13, 1975
The Regular Monthly Meeting of Savannah Beach City Council
was held this evening at 7:00 P.M. in the Council room at City Hall
with Mayor Michael J. Counihan presiding and a quorum consisting
of the following Councilmen present: Edward Fahey, J. M. Agnew,
Jim Bond, Richard DeLoach, John Wylly and Bob Davenport. City
Attorney William H. Pinson was also present.
The first petitioner to appear before Council was Mr. Jim
Aliffi who stated that he was the owner of eight lots situated on
an unnamed street in the vicinity of Naylor and Campbell Avenues
and he was appearing today to request the City to run a sewage
main into this area so that the houses he planned to build on these
lots could be hooked up to City sewerage. He informed Council
that the stubbing fees would more than pay for the cost of this
extension. He also stated that he needed this City service in
order to obtain appraisal of his land values. The request was
taken under advisement by Council.
Mrs. Lilly Berry, who lives in the area of Chatham Avenue
and Venetian Drive, informed Council that she was appearing
before them again to request "NO PARKING" signs for this area
due to the heavy traffic created by the Tybee Marina because
Mr. Fahey was absent when she requested them at a previous meeting.
The Mayor turned this matter over to Mr. Fahey and his committee
for their handling.
Next to appear before Council was Mr. Robert Exley who
stated that he was the owner of two businesses on Sixteenth Street
and that his water bills were too high and he also felt that he
was paying too much for garbage pick -up. He also stated that he
felt it unfair to assess a garbage charge during the winter months
when he was closed and there was no garbage to be picked up.
Mayor Counihan asked the City Attorney for his opinion as to the
legality of this charge when no collections were being made.
City Attorney Pinson replied that in reality this was actually two
questions. He stated further that inasmuch as the rates for water
and sewer were set by Council based upon what they felt was
necessary to offset the expenses incurred by these departments. As
for the legality of the Refuse Ordinance which required the
assessment of a charge all year round, he stated that he felt
this was a legal procedure since the City provided such service
on a year -round basis.
Mrs. Goldie Weitmon, a resident of Fourteenth and Lovell
Avenue, complained about the lack of drainage in frontrof her

property and wanted to know what Council intended to do about
her problem. She was assured by Councilman Bond that the streets
adjacent to her property would be sloped in such a way that would
enable the storm drains to carry off the water.
Mrs. Weitmon also complained that the sewage contractors
had destroyed the curbing that runs alongside her property and
that it was her understanding that they were not going to replace
it. She stated that she had paid for the installing of these
curbs. Councilman Jim Bond assured Mrs. Weitmon that these problems
would be taken care of.
Next on the agenda was Mr. Walter Brogdon who also complained
about the new sewer work, the paving and drainage in front of
his property.. He also complained about the number �f times they
have dug up his street interferring with the operation of his
rental units. Councilman Bond was requested by the Mayor to check
into Mr. Brogdon's complaints and problems with the view of
correcting same.
At this time, the Clerk introduced Mr. and Mrs. Ashley of
Scottsburg, Indiana whom he said were visiting in our City. He
also stated that Mr. Ashley was an elected County Councilman in
Scottsburg. Mr. Ashley informed Council that he operated a
foundry in Indiana and at this time they were making special cast
aluminum plaques in honor of the bicentennial celebration
which they were endeavoring to place in the Mayor's offices
of all the cities they visited. They presented one to the Mayor
and one to the Clerk of Council.
The Mayor then opened the meeting for the transaction of business
legally presented.
The first item of business was the administration of the oath
of office to Mrs. Elizabeth Daley and Mrs. Barbara McCoy, Deputy
Registrars. The oath was administered by William H. Pinson, Jr.,
Judge, Savannah Beach Recorders Court.

Bills of the various departments for the Month of September
were approved for payment. A list of these accounts with the
amounts due are attached to and form a part of the minutes of this
meeting.

COMMUNICATIONS: Under Communications, the Clerk read two
letters from the Corps of Engineers, one relative to the City
providing access and public parking for the Beach Erosion Project
and the other concerning the storm sewer drainage onto the beach
at several points. Copies of these two letters are attached
to these minutes.
TWO LETTERS FROM CORPS OF ENGINEERS
Concerning these two problems, Mayor requested Councilman
Davenport continue with his efforts to get these two problems
corrected. Councilman Davenport reported that in regard to the
drainage problem, Mr. Reed of the D. P. W. would endeavor to do
this job in accordance with the recommendations of the Corps of
Engineers. With reference to the access and parking plan to °be
submitted to the Corps, Councilman Davenport was requested by the
Mayor to secure a copy of this letter from Col. Keiser and review
it so that this plan can be submitted at an early date.
Mayor Counihan informed Council that, as required by law,
the real and personal property values had now been given to the
City by Chatham County in the form of a computer print -out of the
digest of all the values of Savannah Beach property as had been
approved by the Commissioner of the Department of Revenue of the
State of Georgia. At his direction, he stated, the Clerk had
prepared a Resolution for adoption by Council for the purpose
of accepting these valuations. Mayor Counihan stated that the new
digest revealed that the total market value of all Savannah
Beach property as furnished by the Chatham County Tax assessors
is, $24,265,250.00. The Assessed Value at 40% is $9,706,100.00.
There has been an increase in the Total Market Value in all
Savannah Beach property for 1975 (this year) over 1974 (last year)
of $4,607,480.00. This means that the value of 98% of the homes
on Savannah Beach has increased approximately 17%. I am recommend-
ing that we reduce our millage by two (2) mills which will still
produce $252,358.60 in gross taxes or $6,267.00 more than the
$246,091.00 shown in the Budget as anticipated income from Real
Estate Taxes.
Mayor Counihan stated that he was, therefore, recommending
to the Council that the tax millage be reduced by two mills and
be set for taxing purposes at twenty -six (26) mills. He then
requested the Clerk to read the following Resolution:
RESOLUTION
Following the reading of this Resolution, Councilman Richard
DeLoach moved that it be adopted. The motion was seconded by
Councilman Davenport and unanimously carried.
Following the adoption by Council of this Resolution to reduce
the millage to twenty -six mills for the purpose of taxing real
and personal property for the tax year 1975 -1976, it becomes
necessary to amend the existing millage rate by amending the
present City Tax Ordinance. To accomplish this, the following
Ordinance to amend the present taxation, Ordinance was then read
by the Clerk:
ORDINANCE
Following the reading of this Ordinance, Councilman DeLoach
moved its adoption. The motion was seconded by Councilman Fahey
and unanimously carried on first and second reading at this meeting
by unanimous consent.
Councilman J. M. Agnew informed Council that the City had
again accumulated a lengthy list of delinquent taxes and moved
that the necessary steps to collect these delinquent taxes after
proper notification through the legal steps available to us.
The motion was seconded by Councilman Fahey and unanimously carried.
Councilman DeLoach told Council that he would like to transfer
$2,200.00 in Revenue Sharing Funds which amount was being held
for the credit of the Fire Department for a hose drying rack to
the General Fund to be used for communications expense since
there was no provision in the budget for communications expenses
for the account of the Fire Department. Councilman DeLoach then
so moved that he be authorized to transfer these funds. The
motion was seconded by Councilman Wylly and unanimously carried.
City Attorney William H. Pinson, Jr. "stated that at the last
meeting of City Council a recommendation was made by a committee
of Council that the present Surfing Ordinance be amended simply
to delete the reference to the jetties as coundry markers. He
stated further that an amending Ordinance had been drawn reflecting
this change only and requested the Clerk to read the Ordinance:
ORDINANCE
Following the reading of the Ordinance, Councilman Bond moved
that it be adopted. This motion was seconded by Councilman Wylly
and unanimously carried.
Mayor Councilman then called up for the action by Council the
request of Mr. Aliffi to have City sewerage extended to his proposed
development in the area of Campbell Avenue and Naylor Street. A
motion was made by Councilman Fahey that this sewer line extension
be made while the present sewer project is going on. The motion

Mr. Aliffi the money to spend for this work. Mr. Aliffi was
questioned by Council on several points and it was brought out
that he owns eight lots in the area which are 60' X 90' and he
plans to build on each of them. Mr. Aliffi also pointed out to
Council that the projected revenue to be derived by the City
in extending these new lines more than offset the initial cost
of the extension.

After a further discussion, Councilman Fahey amended his
motion that this project be approved providing enough funds
remain to cover the cost of same after completion of the project.
After more discussion, Councilman Fahey withdrew this motion and
requested. the Mayor to have the sewer committee determine what
the cost would be and that when the cost of doing this work is
known, the question would be acted upon at the next Council meeting.
There were no objections to this procedure and it was so ordered.
Councilman Fahey requested permission of Council to place
"NO PARKING" signs on Chatham Avenue and Venetian =Drive in the
vicinity of Tybee Marina. There were no objections to this and
permission for this action was granted.
Mayor Counihan then requested the Clerk to read an Ordinance
to amend the present sewer ordinance so as to provide a system of
cost recovery in the treatment of industrial waste, which was
a requirement of the Environmental Protection Agency prior to
making the final payment to the City or the grant for the Treatment
Plant.
ORDINANCE
Following the reading of this Ordinance, Councilman Wylly
moved that it be adopted on both first and second readings at this
meeting by unanimous consent of all Councilmen present. This
motion was seconded by Councilman Agnew and unanimously carried
on first and second reading.
Councilman Jim Bond, Chairman of Water and Sewer Committee,
informed Council that Change Order No. 3 on the Sewer Project
had been received. He stated that in this Change Order, which
concerns the re- paving of Savannah Beach streets which are torn
up by the sewer work, there was a difference of $22,558.00 in
addition to the original contract and that it was an estimated
figure and not a firm one and was submitted over the signatures
of Mr. Vreelin George, Jr. of Thomas and Hutton Engineering and
Mr. C. M. Mason of Griffin Construction Company. Mr. Bond stated
that he did not quite understand this change order because he had
received another letter from Mr. Durham of Griffin Construction
Company stating that the maximum over the original estimate of the
paving would be $5,000.00 and this called for re- surfacing rather
than merely patching the streets following the completion of the

work on the various streets. It was recommended that action
upon this change order request be delayed until further study could
be made and the original estimate determined.
Councilman Fahey stated that at the open meeting held recently
on the Beach Erosion Project which was conducted by Col. Keiser,
of the U.S. Army Corps of Engineers, a specific question was
asked in regard to the land west of the sea wall and north of
First Street (Highway 80) and the answer made by a member of Col.
Keiser's staff was that fill would be pumped in behind the sea
wall in this area and it is not being done. Mr. Fred DeBoarde,
a citizen and a visitor at the meeting informed Council that he
was the one who asked the question and his concern was that it was
to the City's advantage to have this fill behind the sea wall as
this was the area that the City must provide access parking for
the project. Mayor Counihan stated that he felt this should be
looked into right away. Councilman Davenport agreed to do this.
At this point in the meeting a discussion developed in regard
to the wording of a letter concerning the Erosion Project which
was directed to Col. Keiser by Mayor Counihan. Councilman Agnew
stated that a mis- statement was made by the Mayor in this letter
to Col. Keiser when he said that he was not informed of the problem
that had arizen until ten days after some of the Councilmen had
been informed. Councilman Agnew stated that this was not true
because Mayor Counihan was informed about the problem at an informal
meeting of the Council. Mayor Counihan contended that he was
not officially informed of this problem until receipt of the letter
from Col. Keiser. Councilman Bond stated that he would like to
go on record as stating that the letter in question which was sent
to Col. Keiser was an injustice and not right. He stated further
that he wanted his remarks on the official record of this meeting.
Councilman DeLoach stated to Council that he felt the City of
Savannah Beach was most fortunate to have a volunteer Fire Department
of the caliber that we have. He stated further that the depart -
ment now consisted of about thirty men who were well trained
to as high a degree as the paid department of Savannah. Councilman
DeLoach pointed out that in a recent competition of all the area
fire departments, the Savannah Beach group walked away with all
the top honors, coming out a good fifty points ahead of any other
department. Councilman Fahey asked that the Clerk be instructed
to write a letter to the Chief of the Savannah Beach Fire Department
expressing the appreciation of the Mayor and City Council on behalf
of the citizens and residents of the City of Savannah Beach for
the untiring efforts that have been made by the entire personnel
of the Savannah Beach Fire Department which have resulted in this
achievement and the over -all quality attained by the Savannah Beach
Fire Department. This was so ordered by the Mayor.

Councilman Bond informed Coiincil that he had received an
estimate from Griffin Construction Company of $100.00 to repair
the pavement in front of the 7 -11 Store on the corner of Highway 80
and Jones Avenue which was necessary due to the repairs made to
a sewer line at that point. Councilman Bob Davenport moved that
Griffin Construction be permitted to make these repairs to the
paving. The motion was seconded by Councilman Fahey and unanimously
carried.
There being no further business, the meeting was adjourned
to the next regular or special called meeting.

Dear Mayor Counihan:
Progress on the beach nourishment portion of the Tybee island Beach
Erosion Control Project has resulted in inquiry from several persons
and concern by the Corps as to the effect of storm sewer drainage on
the project at several points along the beach front. [iy attention has
been directed toward several present and potential problems that are
believed to exist.
In a letter of 14 August 1975 to Mr. Joseph M. Agnew, City Councilman,
I discussed storm sewer drainage and the storm outlet in the vicinity
of Seventeenth Street and the beach. I also pointed out the detrimental
effect which the Seventeenth Street sewer outlet would undoubtedly have
on the restored beach and suggested several alternative solutions to
that problem.
It is apparent, from a recent investigation conducted by members of my
staff, that the City has excavated a large hole in the restored beach
approximately fifteen feet in diameter and of an approximate depth of
five feet in the vdci ni ty of the Seventeenth Street outlet. A ditch has
also been excavated from this hole in a southerly direction parallel with
the sea wall in an apparent attempt to carry water from the hole.
Excavation of the hole and ditch is very unsightly, seriously damages the
restored beach and creates a safety hazard. The Corps cannot allow
makeshift storm drainage of this nature to continue without abatement.
The City should take steps to immediately provide alternative drainage
which will not damage the restored beach. The aforementioned hole and
ditch should then be immediately filled with sand and the beach restored
to its condition before excavation of these structures.

Since our investigation of the drainage outlet at Seventeenth Street,
members of my staff have conducted a study of storm drainage along the
entire length of the proposed restored beach from Eighteenth Street to the
terminal groin. Our investigation indicates that ponds ng of storm water
is occurring on the west side of the sea wall at those points where
8th, 9th, 10th, 11th, 12th and 13th Streets abut the sea wall. Excavations
have been made through the sand dunes at llth and 12th Streets to aid
drainage. At 10th Street, a hole in the beach has been excavated on the
seaward side of the sea wall and an opening made in the sea wall itself
to allow water to drain from a pond occurring after heavy rainfall at the
end of the street. These excavations through the sand dunes and on the
beach itself are very damaging to the restored beach. Alternative drainage
remedies should be provided immediately and the damages to the restored
beach and dunes should be repaired.

Our investigation has also revealed that there exists a depression along
the west side of the sea wall in the area north of 7th Street. Ponding
is continuing to occur in this depression after periods of rain. Some
drainage has been provided in this area by pipes through the sea wall.
However, since the berm of the restored beach will result in sand being
placed within approximately one foot of the top of the sea wall as beach
restoration continues, this particular method of drainage will no longer'
be effective. The aforementioned depression should be filled.in order
to alleviate the ponding.
The Agreement for Local Cooperation for the Tybee Island Beach Erosion
Control Project between the United States and the City of Savannah Beach,
Chatham County and the-State of Georgia as 'local sponsors clearly defines
in paragraph la. that the local sponsors are responsible for relocations
made necessary-by project 'conttruction. Storm sewerage systems are clearly .
relocations necessitated by construction of this project. The continued
pattern of storm drainage with its detrimental effects upon the project
should not be allowed to continue.

Re: Tybee Island Beach Erosion Control Project
Dear Mayor Counihan:
Reference my letter of 17 September 1975 and your reply by letter of
29 September 1975 relative to the necessity of providing public access
and parking facilities for that portion of the restored beach north of
First Street. It is felt that further elaboration upon this point may
be of assistance in defining the position of the Corps relative to beach
access and parking facilities.
The Agreement for local cooperation between The United States and The
City of Savannah Beach, Chatham County and the State of Georgia provides
in paragraph 1(k) that the three local sponsors will "Provide, without
any cost to the Government, access and parking facilities necessary for
realization of public benefits upon which Federal participation is based
and maintain continued public use of the beach and administer it for
public use during the life of the Project."
The responsibilities of the local sponsors to provide public access
and parking facilities as outlined in the aforementioned paragraph 1(k)
of the contract is of particular and immediate concern to me at this time.
Public access and parking is considered to be adequate along the beach
south of First Street. However, public access and parking is not available
to the reach of the beach north of First Street to the terminal groin.
The deficiencies in this area have been pointed out tc the local sponsors
both before and after the beginning of Project construction. I do not
believe that the local sponsors are adequately fulfilling the terms of
the aforementioned contract since I am unaware of any steps which have
been taken to provide the required public access and parking.

A great deal of Federal funds have been expended upon the project to date
in reliance upon the local sponsors completely fulfilling their contractual
responsibilities. The Beach Erosion Control Project is a continuing
project with a fifty year life. Federal cost sharing participation has
been authorized for the first ten years of the project life. However,
further Federal funding, after completion of the beach restoration contract
now in progress, will not be recommended by this office if the local
sponsors do not provide necessary access and parking facilities.
It is equally the responsibility of each of the local sponsors to provide the
necessary access and parking facilities. Accordingly: I am also advising
officials of Chatham County and the State of Georgia of sty concern. The
local sponsors should coordinate together in order to immediately finalize
plans for the construction of an access road and parking area for the
aforementioned reach of the beach. Please submit a copy of your plans and
specifications and schedule of construction for these facilities at an
early date.
We at the Corps of Engineers are vitally interested in doing our part to
aid the completion of the Project for the initial ten year period during
which Federal cost sharing participation will be available. However,
a prerequisite to continued Federal participation must of necessity be the
fulfillment of the contract requirements by the local sponsors.

RESOLUTION
WHEREAS, under date of January 27, 1975 the City of
Savannah Beach, in Council assembled, duly adopted an Ordinance
requiring the payment of Real Property Taxes in two (2) install-
ments with the final installment to be adjusted to the new approved
valuation as received, from the Chatham County Tax Assessors for
the year 1975; and
WHEREAS, the City of Savannah Beach has now received the
new valuations for the year 1975 from the Chatham County Tax
Assessors which reflect the one hundred percent (100 %) clear
market value of all Real Estate to be $ 24,265,250.00 , the
assessed value at 40% of all Real Estate to be $ 9,706,100.00 ,
and the gross tax bill at 26 mills to be $ 252,358.60 ;
and
WHEREAS, valuations for Personal Business Property for
the year 1975 have also been received from the Chatham County Tax
Assessors which reflect the one hundred percent (100 %) market
value of all Personal Business Property to be $ 793,822.00 , the
assessed value at 40% of all Personal Business Property to be
$ 317,528.00 , and the gross tax at 26 mills to be $ 8,255.73
NOW, THEREFORE, BE IT RESOLVED that THE CITY OF SAVANNAH
BEACH, in council assembled, does hereby adopt these new valuations
for purposes of payment of the final installment of Real Property
Taxes.
The within resolution is adopted and approved this
13th day of October, 1975.

PROVIDING FOR TAXATION OF REAL AND PERSONAL
PROPERTY IN SAVANNAH BEACH, TYBEE ISLAND,
GEORGIA, AS ADOPTED JANUARY 27, 1975, BY AMEND-
ING THE RATE OF TAXATION UPON SAID PROPERTY:
BE IT ORDAINED by the Mayor and Councilmen of the
City of Savannah Beach, Tybee Island, Georgia, in Council
duly assembled, and it is hereby ordained by the authority
thereof this 13th day of October, 1975, as follows:
By striking that portion of Section 2 of the existing
Ordinance providing "the rate of taxation upon real estate
and business personal property within the limits of said Town
of Savannah Beach, Tybee Island, Georgia, shall be two and
eight tents per cent (2.8 %) upon the assessed or returned
value of same ..." and inserting in lieu thereof the following:
"The rate of taxation upon real estate and business personal
property within the limits of said Town of Savannah Beach,
Tybee Island, Georgia, shall be two and six tenths per cent
(2.6 %) upon the assessed or returned value of same."
All ordinances or parts of ordinances in conflict here-
with are hereby repealed.

AN ORDINANCE TO AMEND SECTION 13 -8 OF THE
CODE OF ORDINANCES, CITY OF SAVANNAH BEACH,
TYBEE ISLAND, GEORGIA, PERTAINING TO THE
AREAS, HOURS, AND DATES WHEREIN SURFING
SHALL BE PERMITTED; TO REPEAL CONFLICTING
ORDINANCES; AND FOR OTHER PURPOSES.
BE IT ORDAINED by the Mayor and Councilmen of
the City of Savannah Beach, Tybee Island, Georgia in
Council duly assembled, and it is hereby ordained by
the authority of the same that Section 13 -8 of the
Code of Ordinances, City of Savannah Beach, Tybee
Island, Georgia is hereby stricken in its entirety
and a new section 13 -8 inserted in lieu thereof
which shall read as follows:
SECTION 13 -8 Same - Areas, Hours, and Dates Permitted.
Surfing in the surf and ocean as herein described
adjacent to the Beach within the City shall not be
permitted except in the following areas at the desig-
nated time:
1. Between THIRD STREET as projected and extended
eastwardly as the Northern boundary, and SEVENTH STREET
as projected and extended eastwardly as the Southern
boundary, from May 1, through Labor Day of each year
between the hours of 10:00 a.m. and 7:00 p.m.
2. Between THIRD STREET as projected and extended
eastwardly as the Northern boundary and FOURTEENTH
STREET as projected and extended eastwardly as the

Southern boundary, from May 1, through Labor Day of
each year between the hours of 7:00 p.m. and 10:00 a.m.

AS TO DEFINE CERTAIN TERMS: TO ADD SECTION
20 -54, ARTICLE III, SEWERS OF THE CODE OF OR-
DINANCES, CITY OF SAVANNAH BEACH, TYBEE IS-
LAND, GEORGIA SO AS TO PROVIDE A SYSTEM OF
EQUITABLE COST RECOVERY FOR THE TREATMENT OF
INDUSTRIAL WASTE IN ACCORDANCE WITH THE RULES
AND REGULATIONS AS SET FORTH IN 18 CFR 601.34;
TO REPEAL ALL CONFLICTING ORDINANCES AND
FOR OTHER PURPOSES.
BE IT ORDAINED by the Mayor and,Councilmen of the
City of Savannah Beach, Tybee Island, Georgia, in council
duly assembled, and it is hereby ordained by the authority
thereof as follows:
SECTION 20 -45 (c) 9 is amended by adding the following:
"Including hydrogen sulfide, nitrous oxide, and sulfur
dioxide which should be limited to one (1.0) mg /1.
By amending Section 20 -45 (c) 5 to add the following;
"This provision also includes ground or shredded paper pro-
ducts".
By adding Section 20 -54, Chapter 20, Article III, Sewers
of the Code of Ordinances, City of Savannah Beach, Tybee
Island, Georgia, as follows:
SECTION 20 -54 Industrial Waste
For industries desiring to use the waste water treat-
ment plaints an agreement shall be executed for payment on

behalf of the participating industry for its pro -rata share
of the cost. These cost to include the cost of building the
plant, including debt service, as well as to provide for
operational and maintenance cost on a regular basis. (a)
The general formula for establishing charges for treating of
Industrial Wastes is computed as follows:

Where Ci = Charge to industrial users, $ /yr.
v0 = average unit cost of transport and treatment
chargeable to volume, $ /gal.
b0 = average unit cost of treatment, charge-
able to BOD, $ /lb.

sludge treatment) chargeable to SS (Su-
spended Solids). $ /lb.
Vi = volume of waste water from industrial
users, gal /yr.
Bi = weight of BOD from industrial users, lb /yr.
Si = weight of SS from industrial users, lb /yr.
(b) Method of Payment
The formula as set forth deals with annual amounts
based on information as supplied from bid data, industrial
estimates, etc., for the purpose of maintaining a cash flow
to cover cost of operation, this estimate is to be made
in twelve equal installments, based on the figures of the

preceding year as adjusted. This is to allow for increases
in operational and maintenance cost.
(c) In the event future industries are allowed, all rules
and regulations of 40 CFR 128 must be complied with.
(d) Repealing clause.
All ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed.
