A Special Meeting of City Council was held this afternoon
at 4:00 P.M. for the following purposes:
1. To act upon the request of Mr. Jim Aliffi for the City
to extend a sewer main to the site of a proposed development by
him, the site being an unnamed street in the area of North. Campbell
and Naylor Avenue.
2. To discuss a request from Mr. George Spirides, propietor
of the Veranda Motel, for the City to run the sewer line to the
site of his proposed new restaurant adjacent to the Veranda Motel.
3. Meeting with Mr. Fred de Borde in accordance with an
agreement made with him at the regular Council Meeting on November 10th.
This is in regard to a request made by Mr. de Borde with reference
to the Beach Erosion control Project.
The meeting was presided over by Mayor M. J. Counihan.and a
quorum consisting of the following Councilmen was present: Edward
Fahey, J. M. Agnew, Bob Davenport, John Wylly and Jim Bond. Councilman
Richard DeLoach was absent.
Following the formal opening of the meeting by Mayor Counihan,
at the request of the Mayor, the Clerk read a copy of a letter
from Thomas and Hutton to Eastern Construction Company requesting
payment from them in the amount of $2,529.70 ($2,429.70 repairs to .
force main and $100.00 replacing paving) the cost of repairing
force main at Jones Avenue and First Street because the original
work done by Eastern Construction Company was not performed in
accordance with the specification. The Mayor stated the letter
would be received as information and requested that it be spread
upon the minutes of this meeting.
Councilman J. M. Agnew reported to Council on the feasibility
of extending City sewerage to the proposed new restaurant adjacent
to the Veranda Motel as requested by Mr. George Spirides. Councilman
Agnew stated that preliminary estimates of the cost of running this
sewer line were in the neighborhood of $8,000.00.
Following a lengthy discussion as to the various possibilities
of providing sewage for this structure, Councilman Fahey moved that
the City extend a sewer line at least far enough to take care of
the restaurant and then if it were found that the cost to go all

the way was prohibitive and not feasible, the remainder could be

done at a later time. This motion was seconded by Councilman Wylly
and unanimously carried.
The next item of business brought up for discussion was the
petition of Mr. Jim Aliffi requesting on extension of the City sewer
lines to the site of his proposed development in the area of Naylor
and Campbell Avenue. Councilman Fahey then made a motion that the
City extend a sewer line adjacent to the site of Mr. Aliffi's
proposed development. The motion was seconded by Councilman Wylly.
Councilman Fahey then amended his motion to put a ceiling of
$3,800.00 in the amount to be expended for this project. This
amended motion was also seconded by Councilman Wylly and when put
to a vote was passed unanimously.
Following the passing of the motion that the City extend a
sewer line for Mr. Aliffi's development, Councilman Fahey then
moved that the City endeavor to get at least three bids on the sewer
extensions to Mr. Aliffi's development and to Mr. Spirides's
restaurant. This motion was seconded by Mr. Davenport and unanimously
carried.
Mayor Counihan then called upon Mr. Fred de Borde to outline
the manner in which he would like the Council to help in regard to
pursuing the problems encountered with the Beach Erosion. Project.
Mr. de Borde informed Council of several areas where he felt the
Corps of Engineers was responsible for over -run of beach fill and
through poor design and lack of supervision, has let the project
get into trouble and necessitate the height and berm of the beach to
be reduced. Mr. de Borde emphasized the safety hazard which would
be created by not covering the old 1912 sea -wall and this, he stated,
was definitely the fault of the Corps of Engineers. He also read
some comments which were made by Mr. Joseph Hutton, a beach
resident and also an engineer familiar with the project, who stated
that in his opinion the problems with the project were due to errors
by the Corps of Engineers in design and computation of fill necessary
to restore the beach to the height and berm as called for in the
General Design Memorandum.
Another area pointed out by Mr. de Borde where he felt the
Corps of Engineers was in error was by not appointing someone to
act as laison between the town and the Corps-of Engineers in order
that problems could be dealt with as they arize. He also brought
out the fact that if the bid deductibles not been mishandled, the .
over -run might have been prevented. Mr. de Borde concluded his
presentation by requesting City Council to act as a committee and
seek legal advice either from Mr. Pinson, City Attorney, or from

some other attorney as to whether or not the City has any legal
resources against the Corps of Engineers and whether or not in
some way the City may be able to keep the dredging equipment
here until a determination can be made as to whether or not the
Federal Government can be made to correct the obvious errors on
the part of the Corps of Engineers.
Following the presentation by Mr. de Borde, Councilman Wylly
moved that Mr. Pinson, City Attorney, be requested to look into
this question and give us a legal opinion as to whether or not the
City has any legal recourse and can pursue it. This motion was
seconded by Councilman Davenport and unanimously carried.
There being no further business, the meeting was adjourned to
the next regular or special called meeting.
