A RESOLUTION CANVASSING THE RETURNS AND DECLARING THE
RESULTS FOR THE RICHLAND HILLS SPECIAL ELECTION HELD ON
NOVEMBER 7, 2023 FOR THE LEGAL SALE OF ALL ALCOHOLIC
BEVERAGES FOR OFF-PREMISE CONSUMPTION ONLY; AS
PRESENTED BY THE CITY SECRETARY.
WHEREAS, the City Council of the City of Richland Hills, Texas, held a Special
Election on November 7, 2023, for the purpose of allowing voters to consider voting for or
against the following proposition: the legal sale of all alcoholic beverages for off-premise
consumption only; and
WHEREAS, it is hereby found and determined that notice of the election was duly
given in the form, manner and time required by law, and said election was in all respects
legally held and conducted in accordance with applicable laws of the State of Texas and
the proceedings governing the holding of such elections; and
WHEREAS, a Canvass of the Special Election returns was conducted on
November 20, 2023; and
WHEREAS, pursuant to Section 67.004 of the Texas Election Code, two members
of the City Council of the City of Richland Hills, Texas, constitute a quorum for purposes
of canvassing an election; and
WHEREAS. the election results have been tallied by Tarrant County Elections and
are as follows:
For: 518 (66.84%)
Against: 257 (33.16%)
775 (100%)
The proposition was approved by a difference of 261 and was therefore approved by the
voters of the City of Richland Hills, Texas.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF RICHLAND HILLS, TEXAS, THAT:
SECTION 1.
The findings set forth above are incorporated into the body of this resolution as if
fully set forth herein.
SECTION 2.
A majority of the residents and qualified electors of the City of Richland Hills,
Texas, voting in a Special Election for the purpose of voting for or against the legal sale
of all alcoholic beverages for off-premise consumption only have cast a combined
Absentee, Early Voter and Election Day total of 775 votes, with 6 absentee voters, 271
early voters, and 498 Election Day voters.
SECTION 3.
It is hereby declared that the City of Richland Hills approves and accepts the
results of the Special Election and as set forth in the Election Returns Sheet attached as
Exhibit A, as determined by the majority vote of the qualified voters of the City of Richland
Hills, Texas.
SECTION 4.
All ordinances and resolutions, or parts thereof, which are in conflict or Inconsistent
with any provision of this resolution are hereby repealed to the extent of such conflict, and
the provisions of this resolution shall be and remain controlling as to the matters resolved
herein.
SECTION 5.
Should any court of competent jurisdiction declare any section, subsection, clause
or phrase of this resolution unconstitutional or invalid, it is expressly provided that any
and all remaining portions of this resolution shall remain in full force and effect. Richland
Hills hereby declares that it would have passed this resolution, and each section,
subsection, clauses and phrases be declared unconstitutional or invalid.
SECTION 6.
It is officially found, determined, and declared that the meeting at which this
resolution is adopted was open to the public and public notice of the time, place, and
subject matter of the public business to be considered at such meeting was given.
SECTION 7.
The City Secretary is hereby authorized and directed to make the appropriate
entries of information appearing in the tabulation of precinct results shown in Exhibit A
attached hereto in the election register maintained by the City in accordance with
provisions of Section 67.006 of the Election Code.

SECTION 8.
The City Manager, City Secretary, and City Attorney are hereby authorized and
instructed to take all actions necessary to give effect to this ordinance and the election, as
provided by law.
SECTION 8.
This resolution will become effective immediately upon its passage by the City
Council of the City of Richland Hills, Texas.
APPROVED AND ADOPTED at a special called meeting of the Richland Hills City
Council on November 20, 2023, by a vote of 3 ayes, ,—_> nays, and
abstentions.
