Savannah Beach, Georgia
December 8, 1975
The Regular Monthly Meeting of Savannah Beach City Council
was held this evening at 7:00 P.M. in the Councilroom of City
Hall with Mayor Michael J. Counihan presiding and the following
Councilmen present: J. M. Agnew, Edward Fahey, James Bond, John
Wylly, Bob Davenport and Richard DeLoach. Also present were
City Attorney Bill Pinson, City Marshal Loran Taylor and Building
Inspector Franklin Burnsed.
Mrs. Berry of Venetian Drive appeared before Council to
complain about the stopped up storm drain adjacent to her home
on Venetian Drive. She also objected to the concrete blocks which
she had placed on the streets being removed by City forces.
Councilman Fahey answered Mrs. Berry by stating that these blocks
were not put there by the City and to his knowledge no one else
had permission to put them there and they were, therefore removed.
Former Councilman Earl Anderson requested Mayor Counihan to
appoint a committee for the purpose of reviewing our present
Charter and making some revisions which seemed to be necessary
at this time.
The minutes of the meetings of November 10 and November 12, 1975
were approved as written.
Under communications the Clerk read a letter from Mr. F. V.
George, Jr. of Thomas and Hutton Engineering Company explaining
the engineering services which would be necessary to overcome
the problems encountered in the City's storm drainage system
caused by raising the beach with erosion control nourishment.
The Mayor requested that this letter be attached to and made a
part of the minutes of this meeting.
LETTER - THOMAS AND HUTTON
DECEMBER 1, 1975 - STORM DRAINAGE PROBLEMS
The next communication read by the Clerk was from Dr.
Quarterman of the Humane Society of Chatham - Savannah, Inc.
terminating the present Animal Control Program between that
organization and the City of Savannah Beach. With reference to
the above, Councilman Fahey requested permission to contact the
County Commissioners with the view of becoming a part of their
Animal Control Program. There was no objection to this.

The next communication read by the Clerk was a copy of a letter
written by Col. Edwin C. Keiser of the U.S. Corps of Engineers to the
Honorable George Busbee, Governor of the State of Georgia with
reference to the provision by the local sponser of public access
and parking facilities for the reach of the restored beach north
of First Street to the terminal groin and the elimination of the
present drainage pattern of storm sewer drainage onto the restored
beach.
Following the reading of the communication, Councilman Agnew
stated that he did not feel we should entice or attract bathers
to this beach with the hazard of the old sea wall and any construc-
tion in this direction should be held in abeyance until this
situation was cleared up. City Attorney Pinson explained the
legal questions which may arize as a result of such action. He
stated the legal question would be who breached which portion of
the contract first. Councilman Agnew then moved that the construc-
tion of the access parking road be held in abeyance until the old
sea wall hazard is removed. The motion was seconded by Councilman
Davenport and unanimously carried.
With reference to the storm sewage drainage•problem,r;it
was brought out that this problem was being thoroughly studied
at the present time.
The next communication read by the Clerk was from Mr. H. M.
Dunn, Jr. who made a request that Mayor and Council reassess
the location of the Dune Protection Area boundary line in the
Bay Ward Area and also that consideration be given to defining
"Environmental Impact Statement" as required by the Ordinance
so that the procedures for obtaining a building permit in Dune
Protection Areas would be simplified. With reference to this
request by Mr. Dunn, Councilman Agnew stated that after a close
inspection of this area with Councilman Wylly it was his opinion
that the Dune Protection Line in this area should be a set distance
back from the sea wall in those instances where there is a sea wall;
or the base of the first dune in instances where there is no sea
wall. And where there is neither a sea wall or a sand dune, the
tidal line could be used,,he stated. City Attorney Pinson stated
that he had been in touch with both Mr. Agnew and Mr. Wylly and
would have something ready for the next Council meeting.
A letter read by the Clerk from Mr. Hans Newhauser of the
Georgia Conservancy requesting a copy of the current Sand Dune
Ordinance and any modification being considered was received as
information.

Bills of the various departments for the month of November were
approved for payment. An itemized list of all of these bills
by departments is attached to and form a part of these minutes.
BILLS OF VARIOUS DEPARTMENTS FOR MONTH OF NOVEMBER, 1975
Councilman J. M. Agnew informed Council that our Refuse
Ordinance as presently written carries an excessive charge for
duplexes by changing more than twice as much for a family dwelling.
To correct this he offered the following amendment to the Refuse
Ordinance:
ORDINANCE
Following the reading of this amendment, Councilman Agnew
moved its adoption. This motion was seconded by Councilman Fahey ,
and unanimously carried: The amended Ordinance was made effective
as of January 1, 1976.
The Clerk then read a Resolution with reference to the proposed
re- zoning by Chatham County of some land on Tybee Island adjacent
to the City of Savannah Beach to allow house trailers, as follows:
RESOLUTION
Following the reading of this Resolution, a motion was made
by Councilman Richard DeLoach that this Resolution be adopted
by Savannah Beach City Council and that a copy be furnished to
each and every member of. the Chatham County Commissioners. This .
motion was seconded by Councilman J. M. Agnew. In the discussion
that followed, Mr. Franklin Burnsed explained to Council the back-
ground of this petition which he stated, if passed, would allow,
not only house trailers in this area, but also animals. Mr.
Burnsed stated that his home was in this area and he was strongly
opposed to this re-zoning. The vote was then taken and the
Resolution was unanimously adopted.
City Attorney Pinson informed Council that in accordance
with the tax laws of the State of Georgia, municipalities are
required to adopt a Resolution prior to December 31st of each
calender year authorizing the manner in which their ad valorem
would be assessed for the succeeding year and also setting the
millage. He further stated that this Resolution had now been
prepared which he read as follows:

Following its reading, .a motion. was inade. by Councilman
Fahey that it -.be adopted. .This motion was seconded by
Councilman Wylly and unanimously carried.

City Attorney Pinson stated that he had been called upon to
prepare a Resolution to authorize the borrowing of the necessary
money through a temporary loan in the sum of $100,000.00 in order
to meet its obligations. He then read the following Resolution:

Councilman Jim Bond moved the adoption of this Resolution.
The motion was seconded by Councilman Bob Davenport and unanimously
carried.
Mayor Counihan then referred back to a request made earlier
in the meeting by former Councilman Earl Anderson, that a committee_
be named to check into the feasability of making certain changes
in the present Town Charter. He at first named the entire Council
as a committee to study the Charter but some of the Councilmen
felt it would be better to have an outside committee make this
study and recommendations.. Former State Senator Wiley Wasden's
name was mentioned as someone who would be well suited for this
work. Councilman Wylly felt that the proposed changes would be
more acceptable by the community if the study and proposals were
made by a non - political group of citizens in the community. This
thought was concurred on by most of the other Councilmen. Mayor
Counihan then appointed Mr. Wiley Wasden as Chairman to head a
committee to be appointed later.
Councilman Fahey, Chairman of the Police Committee requested
permission of the Mayor and Council to make three promotions in
the Police Deparment as follows:
Police Lieutenent Samuel Weatherly to Police Captain
Police Corporal James C. Brown to Police Sergeant
Police Corporal James Aaron to Police Sergeant
In outlining his reasons for requesting these promotions,
Commissioner Fahey stated that it was not only because these men
had done an outstanding job but through advancements of this nature
he was endeavoring to prevent turnovers in the department of good,
experienced men. Then, too, he added the additional expense
to the City was only about $10.00 per week per man and he was
working on some curtailments in the operating expense of his
department which he hoped would compensate for this additional
expense. Mr. Fahey requested also that this increase be effective
with the next pay period. Councilman Davenport then moved that
these promotions be approved. This motion was seconded by
Councilman Wylly and unanimously carried.

Councilman Wylly informed Council that the City had purchased
some piling to replace the deteriorated ones under the municipal
pier on the back river based upon the promise of Mr. Ed Cohen
of the American Dredging Company to put them in place for us but
thus far the Dredging Company had not done this. He also stated
that he was a little afraid they might leave without placing these
pilings for us. Councilman Davenport stated he was convinced that
the Company would take care of this before leaving. Mayor Counihan
stated that he and Bob Davenport would get together with Mr. Cohen
and try to get him moving on this.
There being no further business, the meeting was adjourned to
the next regular or special called meeting.

Gentlemen:

In response to your request for engineering services needed to overcome the
problems in the storm drainage system caused by raising the beach, we offer the following
comments:
The sump created by the higher beach and the natural rise in the ground a couple
of hundred feet west of the Seawall might be drained westward to the river by installing
catch basins and pipes from the dunes to the river. However, this would require very
large pipes because of the flat slope, would disrupt all the utilities and paving, and
would create a serious maintenance problem due to sand settling in the pipes and
structures.
Another alternate would be to install storm water pumps that would discharge to
the creek. This scheme would be expensive to install and to maintain.
A less positive method would be to puncture the Seawall and install a perforated
pipe in a coarse stone drainage field on the beach a few feet below the surface. This
would permit the storm runoff to seep into the beach sand provided the water table was
!ow enough to accept the storm water. While this method would not provide the quick
disposal that the other two methods would, the cost of the more positive methods makes
them virtually impossible for the City's financial capability.
The gravity pipes or pumping system would probably cost about $500,000 and
the Seepage method about $200, 000. These are very prelimiary estimates offered only
to show you the scope of the problem.
It is not certain that the seepage method would work well because it depends upon
the ability of the sand under the beach surface to absorb the storm flow. This would
have to be determined by testing the capacity at the elevation required and then sizing
the stone drains accordingly. The elevation at which the drains would be placed depend
upon the elevation of the ground surface of the area to be drained.

In order to arrive at the best method, it would be necessary to make profiles of
the streets draining to the beach and to test the absorbability of the beach sand at the
elevations necessary to drain the low areas. The amount of time needed for this investi-
gation and surveying cannot be ascertained precisely so our fee for the work would be
based upon the time our personnel spent obtaining this information. A preliminary
estimate of the engineering cost is:

AN ORDINANCE TO AMEND SECTION 6 OF THE
CODE OF ORDINANCES, CITY OF SAVANNAH
BEACH, TYBEE ISLAND, GEORGIA, PERTAINING
TO "REFUSE DISPOSAL ORDINANCE ", TO
PROVIDE CHARGES FOR THE SERVICES PRO-
VIDED BY THE CITY OF SAVANNAH BEACH
FOR THE COLLECTION AND DISPOSAL OF RE-
FUSE; TO PROVIDE FOR AN EFFECTIVE DATE;
AND TO REPEAL ALL CONFLICTING ORDINANCES
AND FOR OTHER PURPOSES.
BE IT ORDAINED by the Mayor and Council of the
City of Savannah Beach, Tybee Island, Georgia, in regular
monthly Council duly assembled, and it is hereby ordained
by authority of the same that Sub - Paragraph C of said Section
6 of the Code of Ordinances, City of Savannah Beach, Tybee
Island, Georgia, pertaining to "Refuse Disposal Ordinance"
is hereby deleted in its entirety and in lieu thereof, a new
Sub - Paragraph C is inserted as follows:

R E S O L U T I O N
WHEREAS, it has come to the attention of the Mayor and
Council of the City of Savannah Beach that the Chatham County
Commission has been petitioned to consider the rezoning of cer-
tain property lying on Tybee Island, Georgia, near the corporate
limits of the City of Savannah Beach, said application bearing
the Identification as follows: Dewey W. Shealy; MPC File No.
75- 2902 -C; Lots 6, 7, 8, Block 11, Garden Ward, #3 Laurel Avenue,
Savannah Beach, Georgia; and,
WHEREAS, it has come to the attention of the Mayor and
Council of the City of Savannah Beach that this petition will be
considered by the Chatham County Commission in the near future
and probably on December 19, 1975; and,
WHEREAS, the Mayor and Council of the City of Savannah
Beach have demonstrated their substantial concern for and interest
in the future development of all areas lying on Tybee Island,
Georgia, including the area in question, as evidenced by previous
efforts to annex it into the corporate limits of the City of
Savannah Beach; and,
WHEREAS, the City of Savannah Beach has in the past and
continues to provide police and fire protection to said area when
necessary to protect the lives, health, and property of residents

within the corporate limits of the City of Savannah Beach, or
when said protection was not immediately available from the
County due to the relatively remote location of this area in
comparison with other areas served by the County; and,
WHEREAS, the area in question has or will be served by
City of Savannah Beach water and sewerage facilities; and,
WHEREAS, the.arpa in question lies immediately outside
the corporate limits of the City of Savannah Beach and provides
many visitors and, tourists to Savannah Beach with their first
visual impression of this resort which is of substantial economic
value to all of Chatham County, as well as the State of Georgia.
NOW THEREFORE, It Is Resolved that the Mayor and Council
of the City of Savannah Beach respecfully request the Chatham
County Commissioners to consider its views on this matter; spe-
cifically, that the proposed zone and the proposed use are incom-
patible with the zoning ordinance and land use pattern for the
City of Savannah Beach, and further that approval of the petition
would create demand for approval of similar applications to the
detriment of land values in the area and to the detriment of the
visual approach to this resort, as well as the general welfare and
safety of the inhabitants of the affected area; and
IT IS FURTHER RESOLVED, that the Mayor and Council of the
City of Savannah Beach strongly urge the defeat of this request
for rezoning and make their views on this issue known by placing
a copy of this Resolution in the Minutes of the proceedings of the

Mayor and Council of the City of Savannah Beach and further,
by providing certified true copies of said Resolution to each
and every member of said Chatham County Commission and to those
officials or employees of the City of Savannah Beach who may
choose to appear at said meeting in opposition to the petition.
This Resolution having been adopted by unanimous vote of the
Mayor and Council of the City of Savannah Beach at its regularly
scheduled meeting held on December 8, 1975, at the Savannah Beach
City Hall.

ORDINANCE
TO PROVIDE THE DATE FOR THE 1976 SAVANNAH
BEACH, TYBEE ISLAND, GEORGIA AD VALOREM TAXES
TO BECOME DUE AND PAYABLE AND TO FURTHER .
PROVIDE WHEN THE SAME SHALL BECOME DELIN-
QUENT AND SUBJECT TO PENALTIES AND INTER-
EST; TO PROVIDE, REQUIRE AND SET THE PAY-
MENT OF SAID TAXES IN TWO INSTALLMENTS,
THE FIRST INSTALLMENT TO BE DUE AND PAY-
ABLE ON MAY 1, 1976. AND THE SECOND INSTAL-
MENT TO BE DUE AND PAYABLE ON NOVEMBER 1,
1976; AND TO PROVIDE THE TERMS UPON WHICH
SAID INSTALLMENT SHALL BE DUE AND PAYABLE;
TO PROVIDE A SEVERABILITY CLAUSE; TO PRO-
VIDE AN EFFECTIVE DATE; TO REPEAL CONFLICTING
ORDINANCES AND FOR OTHER PURPOSES:
BE IT ORDAINED by the Mayor and Councilmen of the
City of Savannah Beach, Tybee Island, Georgia, in Council

SECTION I. By striking section one of the existing ordin-
ance providing for taxation of real and personal property
in Savannah Beach, Tybee Island, Georgia and inserting in
lieu thereof the following:
"Section 1. Dates When Taxes Are Due.
The 1976 Savannah Beach, Tybee
Island, Georgia Ad Valorem Taxes shall be due
and payable in two installments. The first in-
stallment shall be due and payable on May 1,
1976, and the second installment shall be due
and payable on November 1, 1976."
SECTION II. By striking section two of the existing ordin-
ance providing for taxation of real and personal property
in Savannah Beach, Tybee Island, Georgia and inserting in
lieu thereof the following:

"Section 2. Tax Digest And Rendition Of
Statements of Taxes Due.
The first installment of taxes for
the year 1976 shall be paid on statements pre-
pared and rendered on the basis of one -half of
the total tax billed on said property in 1975
by the tax -payer of said property for the calen-
dar year 1975; with the updating of ownership and
other necessary corrective changes in order to
issue said tax bills."
The second installment shall be
due and payable on November 1, 1976 and the tax
statement for this payment shall be made on
the basis of the 1976 tax digest approved by
the State Revenue Commissioner with the billing
taking into consideration the adjustments, cre-
dits, and changes made necessary by the final
assessment as approved on the 1976 tax digest
giving due and proper credit for the payment
made on May 1, 1976.
The rate of taxation upon real es-
tate and business personal property within the
limits of said town of Savannah Beach, Tybee
Island, Georgia shall be two and six - tenths per
cent(2.6 %) upon the assessed or returned value
of same, bearing forty per cent (40 %) of true
market value, of real estate improvements to
be ascertained from the returns of the com-
mittee on assessments of said Mayor and Coun-
cilmen, and the valuation of business personal
property to be ascertained . from the returns
of the owners thereof in pursuance of the ap-
plicable laws and ordinances providing for the
assessment and valuing of taxable property in
the town of Savannah Beach, Tybee Island, Georgia
and to carry into effect the provisions of
the act of the General. Assembly of the State
of Georgia approved August 19, 1922, Section
21, as amended."

SECTION III. By striking section three of the existing or-
dinance providing for taxation of real and personal property
in Savannah Beach, Tybee Island, Georgia and inserting in
lieu thereof the following:
"Section 3. Transfer of Owner ship by Deed -
Notice to Chief Tax Assessor
Each purchaser of property located
in Savannah Beach, Tybee Island, Georgia shall
give notice to the Chief Tax Assessor of Chatham
County, Georgia, that ownership of real property
or personal business property has been changed.
Said notice shall be given upon a form duly ap-
proved by the Chief Tax Assessor of Chatham County
and the notice shall be filed in the office of
the Chief Tax Assessor."
SECTION IV. By striking section four of the existing ordin-
ance providing for taxation of real and personal property in
Savannah Beach, Tybee Island, Georgia, and insertingin lieu
thereof the following:
"Section 4. Penalties and Interest.
Taxes which are not paid on the
regular due date of each installment for the
calendar year 1976 shall bear penalties and
interest as are authorized under the general
laws of the State of Georgia. The interest
rate on all delinquent payments shall be nine
percent (9%) per annum."
SECTION V. Purpose and Intent of Ordinance:
The purpose of this ordinance is to require the
payment of taxes in the calendar year 1976 in two regular
installments, as hereinabove set forth. The earlier receipt
of tax monies will save Savannah Beach, Tybee Island, Georgia
interest on borrowed funds.
SECTION VI. Executions:
Executions will be issued as provided by the
general law of the State of Georgia on all properties for
which the 1976 taxes are not paid at the installment due
date, that is May 1, 1976 and November 1, 1976.
SECTION VII. Severability:
The provisions of this ordinance are severable.
If any section of this ordinance is declared unconstitutional,
illegal or void, it shall not affect or impair any of the re-
maining sections of this ordinance.
SECTION VIII.
All ordinances or parts of ordinances in conflict
with this ordinance are hereby repealed.
ADOPTED in open Council Meeting this 8th day of

R E S O L U T I O N
AUTHORIZING TEMPORARY LOAN BY THE CITY
OF SAVANNAH BEACH, TYBEE ISLAND, GEORGIA
UNDER THE CONSTITUTION OF THE STATE OF
GEORGIA, ARTICLE VII, SECTION VII, PARA-
GRAPH IV, AND FOR OTHER PURPOSES.
WHEREAS, under and by virtue of the Constitution of
the State of Georgia, Article VII, Section VII, Paragraph IV
(Section 2 -6004 of the Georgia Code of 1933, Annotated) each
County, Municipality or Political Subdivision of the State
authorized to levy taxes is given the authority to make tem-
porary loans between January 1, and December 31, in each
year to pay expenses for such year, upon certain conditions;
and
WHEREAS, such conditions have been fulfilled by the
City of Savannah Beach, Tybee Island, Georgia as hereinafter
appears; and
WHEREAS, the said City of Savannah Beach, Tybee Is-
land, Georgia has now outstanding no temporary loan, or loans,
made in the current year, or in any prior year; and
WHEREAS, the total gross income of said City of
Savannah Beach, Tybee Island, Georgia from taxes in the last
preceeding fiscal year (1974 -75) was $220,322.00; and
WHEREAS, the total anticipated revenue of the City
of Savannah Beach, Tybee Island, Georgia for the year 1975-
76 exceeds $622,526.00; and
WHEREAS, the amount to be borrowed, $100,000.00,
plus all other contracts or obligations for current expenses
of the City of Savannah Beach, Tybee Island, Georgia for
the year 1975 -76 are less than the total anticipated revenue
from all sources for such fiscal year; and
WHEREAS, under the aforesaid authority, the City of
Savannah Beach, Tybee Island, Georgia may make such temporary
loan, or loans, in the fiscal year 1975 -76 in a total amount
not to exceed $100,000.00; and

WHEREAS, the Mayor and Council constitute the govern-
ing body of the City of Savannah Beach, Tybee Island, Georgia.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Coun-
cil of the City of Savannah Beach, Tybee Island, Georgia in
a legally called meeting, assembled December 8, 1975:'
That the City of Savannah Beach, Tybee Island, Georgia
is hereby authorized to borrow from Savannah Bank & Trust
Company of Savannah the sum of $100,000.00 to be represented
by a Promissory Note bearing interest at the prevailing and
best obtainable rate of interest per annum, and the entire
amount, together with interest, to be repaid on or before
December 31, 1976. The Promissory Note evidencing said loan
shall be executed in the name of the City of Savannah Beach,
Tybee Island, Georgia and signed by the Mayor and /or Pro
Tem and Clerk of Council at any time subsequent to January
1, 1976.
