CALL TO ORDER The City Council Regular Meeting Closed Session of the City of Lynwood met in the Council Chambers, 11350 Bullis Road Lynwood, CA 90262 or Web conference via ZOOM -To participate via Zoom or by telephone: 1-669-900-9128 or 1-253-215-8782 Meeting ID: 835 2029 8238 on the above date at 5:00 p.m. Meeting called to order at 5:02 p.m. Mayor Pro Tem, Solache presiding. 02. CERTIFICATION OF AGENDA POSTING BY CITY CLERK City Clerk Quinonez announced the Agenda had been duly posted in accordance with the Brown Act. 03. ROLL CALL OF COUNCIL MEMBERS PRESENT: COUNCIL MEMBERS FLORES, SOTO AND MAYOR PRO TEM SOLACHER CASANOVA ABSENCE: COUNCIL MEMBER SANTANA AND MAYOR CASANOVA Mayor Pro Tem Solache indicated that Mayor Casanova will arrive late. STAFF PRESENT: City Manager Hernandez, City Attorney Tapia, City Treasure Camacho, City Clerk Quinonez, Interim Community Development Director Yonai, Human Resources Director Matson, and Technology Director Han. 04. PLEDGE OF ALLEGIANCE — Deferred to Regular Meeting PUBLIC ORAL COMMUNICATIONS (Regarding Agenda Items Only) NONE NON-AGENDA PUBLIC ORAL COMMUNICATIONS NONE Closed Session 05. CONFERENCE WITH LEGAL COUNSEL —ANTICIPATED LITIGATION AND PUBLIC Mayor Pro Tem Solache requested City Attorney Tapia to read City Council into closed session. The City Attorney Tapia read the City Council into closed session. 1 A. With respect to every item of business to be discussed in closed session pursuant to Government Code Section 54956.9: CONFERENCE WITH LEGAL COUNSEL —ANTICIPATED LITIGATION Significant exposure to litigation pursuant to paragraph (4) of subdivision (d) of Section 54956.9: Number of Cases: One (1) B. With respect to every item of business to be discussed in closed session pursuant to Government Code Section 54956.9: CONFERENCE WITH LEGAL COUNSEL - EXISTING LITIGATION - Government Code section 54956.9(d)(1) 1. Name of Case: 11680 Wright Road LLC v. City of Lynwood, Case No. 19cmcv00348 C. With respect to every item of business to be discussed in closed session pursuant to Government Code Section 54957: PUBLIC EMPLOYEE PERFORMANCE EVALUATION Title: City Manager MOTION: It was moved by Council Member Flores, seconded by Council Member Soto to open Closed Session. Motion carried by 3-0 vote. AYES: COUNCIL MEMBERS FLORES, SOTO AND MAYOR PRO TEM SOLACHE NOES: NONE ABSTAIN: NONE ABSENT: COUNCIL MEMBER SANTANA AND MAYOR CASANOVA The City Council recessed into closed session at 5:05 p.m. The City Council reconvened into regular session at 6:04 p.m. Mayor Casanova requested City Attorney Tapia to read City Council back into regular session. The City Attorney Tapia reported on the following items out of closed session: With all five (5) members of City Council being present the City Council met in closed session to discuss the following items: With respect to item 5A: City staff made a presentation, City Council provided feedback and no final reportable action was taken. With respect to item 513: City Council met on May 3rd 2022 in closed session to consider a settlement proposal of 11680 Wight Road, LLC v. City of Lynwood litigation and the City Council voted unanimously to approve a 2 settlement agreement. That settlement agreement has been executed by all parties, litigation involves a claim by a property owner of inverse condemnation property rights. The settlement agreement will be on record with the City Clerk. The case has been settled unanimously by the City Council. With respect to item 5C: City staff made a presentation, City Council provided feedback and no final reportable action was taken. The City Attorney Tapia indicated completion of his report out of closed session. Mayor Casanova requested a motion to adjourn closed session. MOTION: It was moved by Council Member Soto, seconded by Mayor Pro Tern Solache to adjourn closed session. Motion carried by 5-0 vote. AYES: COUNCIL MEMBERS FLORES, SANTANA, SOTO, MAYOR PRO TEM SOLACHE AND MAYOR CASNOVA NOES: NONE ABSTAIN: NONE ABSENT: NONE Mayor Casanova announced for the record that Council Member Santana and himself were present in closed session. ADJOURNMENT Having no further discussion, it was moved by Council Member Soto seconded by Mayor Pro Tern Solache to adjourn the Closed Session meeting.
