The Council of the City of Medina met in regular session on Tuesday, March 6, 1990 at
7:30 P.M.
Present: Mayor,Thomas Anderson; Councilmembers, Robert Mitchell, Stephen Schmit,
Wilfred Scherer; Clerk -Treasurer, Donna Roehl; Public Works Director,
James Dillman; Police Chief, Rick Rabenort; Zoning Administrator, Loren
Kohnen; Attorney, Ron Batty; Engineer, Glenn Cook
Absent: Councilmember, Anne Theis

2. MINUTES OF FEBRUARY 20, 1990
Moved by Schmit, seconded by Scherer to approve the minutes of February 20, 1990, as
presented.

3. POLICE DEPARTMENT
Truck Weighing Scales
Rick Rabenort explained that the scales for weighing trucks were not working properly,
new scales could be purchased for $1300 each or possibly they could borrow some from
another department.
Stephen Schmit asked how much fine money had been generated in 1989, from
Rick Rabenort stated that $13,000 had been received.
Robert Mitchell stated that the city has been able to function with four scales,
are needed, but maybe the work could be done with only two.
Stephen Schmit stated that scales will not cost any less in 1991 so they should
now if they cannot be repaired. The city should protect the roads because money
spent to repair them.
Donna Roehl stated that roads were scheduled to be posted on March 19th.
Moved by Anderson, seconded by Schmit to borrow scales if the city -owned scales
repaired, if not look into buying two.

4. PUBLIC WORKS DEPARTMENT
Hamel Well # 4
Glenn Cook stated that the radium test on Hamel Well # 4 was 4.9 pic. per liter, with the
proper level recommended to be no more than 5. He suggested that the well be pumped for
48 hours and then retested.
Moved by Schmit, seconded by Scherer to authorize
Hamel well # 4 for radium.

5. PLANNING AND ZONING DEPARTMENT
* Lawrence and Yvonne Alan, Final Subdivision Approval
Moved by Scherer, seconded by Schmit to adopt Resolution 90-8, granting final subdivision
approval to Lawrence and Yvonne Alan for subdivision of property east of Willow Dr.

Eugene Dabrowski, Lot line Rearrangement
Loren Kohnen explained that Eugene Dabrowski had made application to combine Lots 6,7,18
and 19, Block 19, Independence Beach and then subdivide into two parcels. He stated that

Wilfred Scherer conducted this portion of the meeting (7:50 P.M.)
Loren Kohnen stated that a portion of the TRA property had not been included in the
original subdivision application and would need to be included as Outlot B and approved
by the city.
Robert Mitchell stated that the preliminary subdivision resolution did not contain some
of the items that were discussed at the February 20th meeting, that is; how the street
and utilities would be paid for and when they would be constructed; is Hennepin County
going to share in the cost of constructing the storm sewer; and what is the bonding
capacity of the city if some of the work is to be done by the city.
He stated that Medina has had a policy of not participating in constructing streets
and utilities in developments and if that is to change a city policy is needed. He
explained that Plymouth has a very liberal policy, while Orono is more restrictive and
that Medina might want to have something in between.
Ron Batty stated that a policy with_'good controls should b written so that if a project
is not satisfactory it could be rejected.

special emphasis on the fill that has been placed on the property and the elevation
of the lots as compared to the elevation of the sewer line in the street. He suggested
that both houses be constructed at the same time because of the elevation problems.
Moved by Mitchell, seconded by Schmit to authorize preparation of a resolution granting
lot line rearrangement to Eugene Dabrowski for two parcels, comprised of Lots 6,7,18
and 19, Block 19, Independence Beach, according to Planning Commission recommendations
and that houses on both lots be constructed at the same time.

Timothy Olson, Final Subdivision
Loren Kohnen reported that items contained in the preliminary subdivision approval for
Timothy Olson, had been met and he recommended final approval with a park dedication
fee of $2685.
Moved by Schmit, seconded by Scherer to authorize preparation of a resolution granting
final subdivision approval to Timothy Olson to subdivide property at 3882 Chippewa Rd.,
into two parcels.

Holy Name Church Parking
William Rudolph representing Holy Name Church, explained that the congregation has grown
from 450 families in 1983 to 1650 families in 1990; that there is room for 420 cars in
the parking lot, which is not nearly enough space.
Thomas Anderson stated that he had counted 100 cars in unmarked areas.
William Rudolph stated that Holy Name will be having a meeting on Thursday night to
discuss expanding the lot to accomodate at least 150 additional cars. He asked if Council
would allow them to use the lot north of Co. Rd. 24 until the new lot is completed, some-
time in the summer.
Stephen Schmit asked how many cars could be parked in that area.
William Rudolph stated that at least 50 cars could be parked on that property.
Wilfred Scherer asked if the city could be sued if parking was approved and an accident
occurred.
Ron Batty stated that the city could argue that they were not liable.
Robert Mitchell asked if they could have crossing monitors.
Rick Rabenort stated that they would need to hire police if they were going to stop
traffic.
William Rudolph stated that it might be possible to have people act as ushers at the
crosswalk.
Loren Kohnen stated that the change in use of the property should be reviewed by the
Planning Commission as it is a change from the conditions in the Conditional Use Permit.
Moved by Schmit, seconded by Scherer to grant a temporary permit to Holy Name Church to
us property on the north side of Co.Rd. 24 for parking, on the condition that plans for
expansion of the parking lot on the south side of the church are submitted to the city
by May 30th and the new lot is completed by August lst.

William Rudolph asked what the church could use the proper+y north of Co. Rd.24 for as
they were interested in some long range usage.
Wilfred Scherer stated that the Planning Commission could also discuss that property.
6. YARDWASTE DISPOSAL
Jim Dillman suggested that the city negotiate with the three garbage haulers to pickup
leaves from residents, bring to city hall or to a field where they could be landspread.
Wilfred Scherer stated that:he would work the leaves into the ground.
Thomas Anderson asked what the plans were for grass clippings.
Wilfred scherer stated they were trying to find out if they could be spread on set -aside acres.
Moved by schmit, seconded by Scherer to designate a site on city property as the cities
compost and transfer site where debagged leaves will be brought by the -three dity haulers,
plus debagged leaves that will be brought by residents on city clean-up day.

7. I.ANDSPREADING JOINT POWERS AGREEMENT
Ron Batty reported that he had sent information .to the other rural Hennepin County cities
regarding a joint powers agreement for disposal of yardwaste. He asked the council to
read the material and comment.
Thomas Anderson asked if the council wanted Medina to be part of an agreement.
Moved by Mitchell,seconded by Scherer to direct staff to investigate the Joint Powers
Agreement.

8. RECYCLING FUNDING
Donna Roehl asked if council wished to send the letter regarding recycling funding as the
County Commissioners were discussing changing their funding policy for recycling programs
by eliminating paying for administration.
Moved by Schmit, seconded by Anderson to send the letter regarding recyling funding to
the Hennepin County Commissioners.
Motion declared carried
9. INDEPENDENCE BEACH AREA PARKING
Stephen Schmit explained that the Lake Independence Citizens Association had met and asked
him if the city wouldexpand the "No parking" area near the boat landing.
Jim Dillman asked that they be reminded that the boat landing is for everyone to use.
Stephen Schmit stated that they object to boat trailers being left along streets.
Jim Dillman stated that there is not much parking area near the Medina Morningside park and
many cars are parked on the streets in the area.
Donna Roehl stated that arrangements have already been made by Orono Community Education to
use the Medina Morningside park every night from May through July.
Moved by Schmit, seconded by Scherer to table the matter for•two weeks.

10. WRIGHT-HENNEPIN ELECTRIC
Council discussed letter from Wright -Hennepin Electric regarding placement of their radio
antenna on the Willow Dr. water tower.
Jim.Dillman stated that Don Wendling, who services the cities radios, had suggested that
the water tower be used by safety and public service groups.
Moved by Mitchell, seconded by Scherer to enter into negotiations with Wright -Hennepin
Electric for placement of antenna on the Willow Dr. water tower.
Motion declared carried
11. RILLS
Moved by Schmit, seconded by Scherer to pay the bills; Order Checks # 8399-8461
in the amount of $263,259.19 and Payroll Checks # 11448-11470 in the amount of
$14,193.01 and Payroll Checks #8869-8878 in the amount of $467.50.

12. COMPEAT
Council discussed reports that rats have been seen on, or near, the Compeat site.
Staff was advised to continue to monitor the area.
