HomeMy Public PortalAbout19760112CCMeeting1 1 Savannah Beach, Georgia January 12, 1976 The Regular Monthly Meeting of Savannah Beach City Council was held this evening at 7:00 P.M. at City Hall with Mayor M. J. Counihan presiding and a quorum consisting of the following Councilmen present: Edward Fahey, J. M. Agnew, Richard DeLoach, John Wylly and Bob Davenport. Councilman Jim Bond was absent from the meeting. City Attorney William H. Pinson, Jr. was also present at the meeting. The minutes of the meeting of December 8, 1975 were approved as written. COMMUNICATIONS: Under Communications the Clerk read a letter from Mr. Eugene J. Kirkland of 1214. Venetian Drive in which he complained that workmen of sewer project contractor had inadvertently damaged a retaining wall adjacent to his lot by knocking some boards out of it resulting in a cave -in of same. He requested the repair of this damage; also that he be connected to the new sewer line. Following the reading of this com- munication, Councilman Fahey moved that this matter be referred to the contractor. This motion was seconded by Councilman DeLoach and unanimously carried. A communication from Mrs. Kathleen Hutton was then read by the Clerk. In her letter Mrs. Hutton stated that on December 3, 1975 her.-water was turned off for about four hours in the middle of the day without advanced notice. She stated further that the following day the water was milky and unpalatable, and members of her household suffered diarrhea, stomach cramps and vomiting. She stated that approximately 1600 gallons of water was used to flush out their line and asked that this amount be adjusted off her bill. Councilman DeLoach recommended that this communication be turned over to the Water Department for their investigation and an adjustment be made if found in order. There being no objections to this procedure, it was so ordered. The next communication read was a copy of a letter from Mr. Joe Tanner addressed to Col. Edwin C. Keiser, D.E., U.S. Corps of Engineers, Savannah,with reference to the release by Governor Busbee of an additional $160,000 to fund the completion of the Tybee Beach Erosion Control Project; together with the terms and understanding which have justified the expenditure of the additional funds. This letter is attached to and forms 44 -2- a part of these minutes. TANNER LETTER AND MAYOR'S LETTER AND TELEGRAM The above letter was received as information. The next communication read was one from the Georgia State Firemen's Association addressed to "Firefighters ". It requested all Firefighters contact their State Senators and Representatives asking for their support for the following legislation: Pension (Actuary Bill) Pension - Georgia Fireman's Pension Fund Housecleaning Bill Workmen's Compensation Act Mutual Aid Act The Clerk informed Council that this communication had been passed along to him to be read to Council requesting that a letter concerning this legislation be sent to the local members of the General Assembly. The Mayor stated that he would handle this if there were no objections. There were none. The next communication was from Mr. Shuble A. Boling, Supervising Sanitarian of the Chatham County Health Department, . enclosing a report on the Housing Code inspections and enforce- ment work for the City of Savannah Beach for the year 1975; together with a proposed schedule for Housing Code Inspections_ and enforcement work for 1976. Following this reading, a motion was made by Councilman DeLoach that this service be discontinued, and the Health Department be so informed. This motion was seconded by Councilman Wylly and unanimously carried. Bills for the month of December were approved for payment. Copies of these bills as approved are attached to and form a part of these minutes. BILLS OF ALL DEPARTMENTS FOR MONTH OF DECEMBER With reference to the proposal of Chatham County for a joint animal control agreement, Councilman Fahey requested time to study the proposal and report his recommendation at the next meeting of Council. This was agreeable with Council. The next item on the agenda was the parking problem on Venetian Drive concerning Mrs. Berry. Councilman Fahey reported that at the insistence of Mrs. Berry, he had gotten permission from Council to ban parking in the curve of Venetian Drive -3- in front of her property. He stated that after this was done, it was pretty well accepted by the marina people, and then Mrs. Berry began planting shrubbery on the other side of the street which, in his opinion, she did not have the right to do. Mr. Fahey stated that he would like for some of the Councilmen to meet with him at the site to look into this matter again in an effort to resolve the situation. It was decided to meet at the site on Saturday at 4:00 P.M.. A discussion then followed on whether or not new parking meters should be purchased. Mr. Fahey stated that if new meters are not bought, a means other than meters would have to be used in the proposed new 15th Street Lot to collect a parking charge and the meters also eliminated from the 14th Street Lot, we would still be 13 meters short on Butler Avenue and the side streets. Mr. Fahey then moved that we make one continuous parking lot from 18th to 14th Street and transfer all these meters to the side streets, and that this work be started immediately. This motion was seconded by Councilman Davenport and unanimously carried. A Resolution was read by the Clerk fulfilling the various requirements of the State Code and the Municipal Charter in connection with the coming General Election for Mayor and Councilmen on April 5, 1976. These requirements concern the publication of notice of the election, the appointment of the Election Board, the closing time for registration, the opening and closing time for candidates to qualify. RESOLUTION Following the reading of this Resolution, Councilman Wylly moved its adoption. This motion was seconded by Council- man Fahey and unanimously carried. Concerning plans for a Bicentennial celebration at the Beach, Mayor Counihan appointed Councilman Agnew Chairman of a committee to work up plans for this affair. Mr. Agnew stated he would like to work up a committee to serve with him and would report further on this at the next Council meeting. Councilman Fahey informed Council that he was with Repre- sentative Tom Taggart in Atlanta today and was told by him that in order for us to get the necessary legislation enacted to amend the Charter to change the terms of office of the Mayor and Councilmen, it was necessary to insert an advertisement in the press giving notice of intent to introduce such legislation. 46 -4- Councilman Agnew moved that the Clerk be instructed to insert such ad. The motion was seconded by Councilman Fahey and unanimously carried. Councilman Agnew brought to -the attention of Council a problem that has come about due to a force main in our sewer project which is scheduled to run across property owned by Mr. Henry Hosti, of the Triangle Drive In. Mr. Agnew stated further that Mr. Hosti would like to trade with the City by giving us the right to cross his property if the City in return would quit -claim whatever right it may have in the land between his property and the right -of -way of both Butler Avenue and Inlet Avenue. Councilman Agnew then moved that, in exchange for the property we need on the north end of the triangle for this sanitary sewer force main, that the City convey to Mr. Hosti what interest we have in the property lying east of Inlet Avenue and the Triangle Drive -In property and west of the right -of -way of Butler Avenue and the Triangle Drive -In property. The motion was seconded by Councilman Fahey and carried by a vote of 4 to 0; Councilman Davenport abstained. The Mayor requested the records to show that he was opposed to the motion. Councilman Fahey stated that he would like to recognize Mr. Fred de Borde and thank him for his efforts in getting the additional funding for the.Erosion Project. Councilman Davenport requested the Mayor to write Mr. de Borde behalf of the citizens of Savannah Beach, thanking him for his efforts and accomplishments in getting the additional sand pumped on to the beach. Mr. Franklin Burnsed, Building Inspector, made the Annual Report of the City's building activities for 1975. This report is attached to and forms a part of these minutes. BUILDING INSPECTOR'S ANNUAL REPORT - 1975 Mr. Burnsed then recommended that Council amend the present Building Ordinance to change the permit fee from $5.00 for the first $1000.00 of value to $10.00; and change the $2.50 for each additional thousand or any fraction thereof, to $3.00. Councilman Agnew moved that the Ordinance be amended and that this amendment be prepared for adoption at the next meeting of Council. This motion was seconded by Cou Gilman Fahey and unanimously carried. There being no furthe business, the meeting was adjourned to the next regular or spe ial called meeting. Box 889 Savannah, Georgia 31402 Dear Colonel Keiser: As you are aware, Governor Busbee has approved the release of an additional $160,000 which you requested to fund the comple- tion of the Tybee Beach Erosion Control Project. These funds have been provided from the Department of Natural Resources budget and will require that other worthwhile projects be delayed until additional appropriations are made available. 1 want to take this opportunity-- with.Governor Busbee's concurrence - -to clarify to you the terms and understandings which have justified the expenditure of these additional funds. Mayor. Counihan and the City of Savannah Beach have provided assurances to the Governor and myself that the City will immediately alle- viate the drainage problems associated directly with the project and will also provide adequate access and parking at the north end of the beach by the Spring of 1976 (copy of letter and telegram attached). The State is funding the entire requested amount with the understanding that the City of Savannah Beach will carry out their commitment to alleviate these problems. We also understand that this additional funding will complete the entire project in accordance with the original design profile and plans and will ensure that the old seawall and other obstructions at the north end of the beach will be adequately covered by sand so as not to recur as a public safety hazard in the near future. 1 v P11. Keiser Page Two January 7, 1976 The Governor is also going to discuss with the Honorable "Bo" Ginn the possibilities of-obtaining Congressional authori- zation to extend the federal involvement in this project from ten years to forty years. This extended authorization would ensure continued Corps assistance in the maintenance of this project as a long-term asset to Georgia's citizens. I have initiated an aerial photography monitoring program to periodically evaluate the effect of this project. I suggest that the Corps of Engineers and the Department of Natural Resources work together to establish an adequate, on-going monitoring program. This will also assist you in periodically reporting to the Governor the impact and effectiveness of the project as he requested in his letter. Sincerely, Joe D. And we also appreciate your sincere efforts to find some additional funds to complete this project as planned. Please be advised that the drainage problem at 17th Street which resulted from this project will be alleviated by the City immediately. We realize this is necessary due to the fact that public welfare and the safety of the residents of Savannah Beach requires it. There has been a question raised concerning the proposed parking facility at the north end of the beach. Please be assured that if the extra funding is obtained and the project completed accordingly, thus insuring that a safety hazard no longer exists, the City will provide an adequate parking facility • and access road by the Spring of 1976. When the Project has been completed we will begin preparing plans for the parking facility and supply them to both your office and the Corps of Engineers. TOTAL $13.90 1 1 1 RESOLUTION A RESOLUTION BY THE MAYOR AND COUNCILMEN OF THE CITY OF SAVANNAH BEACH, TYBEE ISLAND, GEORGIA, TO CONDUCT AN ELECTION FOR THE OFFICE OF MAYOR AND SIX COUNCILMEN IN ACCORDANCE WITH THE APPLICABLE LAWS OF THE 'STATE OF GEROGIA AND CHARTER OF THE MUNICIPALITY BE IT RESOLVED by the Mayor and Council of the City of Savannah Beach, Tybee Island, in Council duly assembled and it is hereby resolved as follows: WHEREAS, every two years on the first Monday in April of each even year the City shall call an election for the purpose of electing a Mayor and six Councilmen of the municipality who are qualified to hold such office as is provided in said City Charter and in accordance with the Georgia Municipal Election Code; and WHEREAS, in accordance, furthermore, with the provisions of Section twenty -three and twenty -four of the Charter of said municipality various election officers are created and are to be appointed by the governing body of the City in connection with the conduct of said election; and WHEREAS, public notice of such election shall be published by the governing authority in a newspaper of general circulation in the municipality at least thirty days prior to the election stating: (a) The dates and hours of such election (34A -702) (b) Opening and closing time for qualification of can- didates for the various elected offices together with the amount of the qualifying fee, if any. (34A -904) (c) Cut off dates for the registration of electors (34A -507) NOW, THEREFORE, BE IT RESOLVED, AND IT IS HEREBY RESOLVED as follows: 1. The City of Savannah Beach, Tybee Island, shall conduct an election on April 5, 1976 from seven a.m. to seven p.m. for the purpose of electing a Mayor and six Councilmen to hold office from the first Monday in July, 1976, until the first Monday in July, 1978, or until their successors have been duly elected and qualified. 1 -2- 2. The Election Board of Chatham County shall be requested to act as Municipal Election Superintendent of said election and shall be authorized to incur such expenses as are found to be necessary for the conduct of such election as authorized by Section twenty -four of the Charter of the municipality. 3. Furthermore, the City Clerk shall be authorized to publish notice of such election as required by law. 4. Qualifications for all offices shall begin at Nine A.M. on Friday, February 20, 1976 and shall close at Five P.M. on Saturday, March 6, 1976. 5. Registration books shall be closed Saturday, March 6, 1976 at Five P.M. 6. That the method of casting votes shall be by voting machines and absentee ballots will be available for those desiring same in accordance with the rules and regulations of the Georgia Municipal Election Code and the Ordinances of the City of Savannah Beach. 7. Election Managers and Clerks shall be appointed at the regular meeting of City Council on February 9, 1976. ADOPTED IN OPEN COUNCIL this 12th day of January, 1976.
