PRESENT: Mayor Dan Gubler, Council President Rob Geray, Council Member Michael Thompson, Council Member Peter Wadsworth, Council Member Kathy McNamara, City Attorney Andrew Rawlings and City Clerk/Treasurer Keri West. ABSENT: Public Works Director Zech Prouse. VISITORS: Deputy Chris Williams, Daren Long and Ron Roberts. Mayor Gubler welcomed everyone and led the Pledge of Allegiance. A roll call was taken by Clerk West to open the meeting. CONSENT AGENDA: City Council Work Meeting and Regular Meeting Minutes of March 16, 2021 were reviewed. Council reviewed the finance reports for the period ending March 31, 2021 (50% of the fiscal year elapsed). The City had $1,363,561.13 in the bank and routine bills had been paid, "Exhibit A". Mayor Gubler entertained a motion. Council Member Thompson made a motion to approve the consent agenda as presented. Council President Geray seconded the motion. All in favor. Motion carried. ITEMS OF BUSINESS: Business License Application, Main Street Sales—Mayor Gubler stated this is a renewal for a business license that had been revoked for non-payment. Council President Geray asked what the applicant stated the reason was for not paying his permit on time. Clerk West stated he had forgotten. Mayor Gubler entertained a motion. Council Member Thompson made a motion to approve the Business License Application for Main Street Sales. Council Member Wadsworth seconded the motion. All in favor. Motion carried. Resolution 2021-02 —A Resolution changing the name of the West side of"Ball Circle" to "Ball Court"—Mayor Gubler explained this Resolution is for the City to change the name of the West side of the current "Ball Circle" to "Ball Court" for better accessibility and locating for emergency situations. He continued and stated to enable Bonneville County to include this name change on their Geographic Information System (GIS), the City is required to pass this Resolution and have it recorded. Mayor Gubler entertained a motion. Council Member Wadsworth made a motion to approve Resolution 2021-02, changing the name of the West side of "Ball Circle" to "Ball Court". Council Member Thompson seconded the motion. A roll call vote was taken: Council President Geray: YES Council Member Wadsworth: YES IONA CITY COUNCIL REGULAR MEETING—APRIL 20, 2021 Council Member McNamara:YES Council Member Thompson: YES Ordinance to Amend Iona City Code § 9-4-5(C); pertaining to Parking Vehicles on Public Streets (Ord. 255-04-21) — Attorney Rawlings stated this amendment clarifies a few issues regarding parking vehicles on public streets. He continued and explained the most significant change is the hours that vehicles are not allowed to park on the street during winter months, which has been updated to 5:00am-5:00pm. Clerk West stated this is an item that was discussed at last month's Work Meeting in detail. Mayor Gubler entertained a motion. Council President Geray made a motion to approve Ordinance No. 255-04-21, an Ordinance of the City of Iona, Idaho; amending Section 9-4-5 of the Iona City Code; revising regulations for vehicles parked on public streets in winter; providing methodology; preserving prior Ordinances in each instance; providing for severability; and establishing an effective date. Council President Geray also made a motion to dispense with the rule of reading the proposed Ordinance in full and on three separate occasions. Council Member Wadsworth seconded the motion. A roll call vote was taken: Council President Geray: YES Council Member Wadsworth: YES Council Member McNamara:YES Council Member Thompson: YES Ordinance to Amend Iona City Code § 9-4-10; pertaining to Impounding Fees (Ord. 256- 04-21) —Attorney Rawlings stated this amendment removes the requirement that a person must first pay the City Clerk a fee of $15, prior to retrieving their car and paying the fine at the impound lot, after having been issued a ticket for a parking violation. Mayor Gubler entertained a motion. Council Member Thompson made a motion to approve Ordinance No. 256-04-21, an Ordinance of the City of Iona, Idaho; deleting Section 9-4-10 of the Iona City Code; removing the requirement to pay an Impound Fee to the City prior to release of any impounded vehicle; preserving prior Ordinance; providing for severability; and establishing an effective date. Council Member Thompson also made a motion to dispense with the rule of reading the proposed ordinance in full and on three separate occasions. Council President Geray seconded the motion. A roll call vote was taken: Council President Geray: YES Council Member Wadsworth: YES Council Member McNamara:YES Council Member Thompson: YES Ordinance to Amend Iona City Code § 9-4-23; pertaining to Penalties for Public Parking Violations (Ord. 257-04-21) — Attorney Rawlings stated this amendment does not change anything specifically; it just clarifies and breaks down the timeline and fee schedule as suggested by Deputy Williams. Council President Geray asked Deputy Williams if he has seen this amendment and approves the changes suggested. Deputy Williams confirmed his approval. Council President Geray asked whether the fee schedule is appropriate and consistent with other law enforcement agencies. Attorney Rawlings stated he did notice a few line items that he would 2 IONA CITY COUNCIL REGULAR MEETING—APRIL 20, 2021 consider changing the penalty. Clerk West stated the option to table this amendment to allow more time to research appropriate penalty amounts. Council President Geray stated he would appreciate further clarification and additional research to determine the penalties. Mayor Gubler and all Council Members agreed to table this discussion until the May City Council Meeting. Ordinance to Amend Iona City Code § 5-7-5; pertaining to Fire Hydrants (Ord. 258-04-21) — Attorney Rawlings stated this amendment was recommended by Director Prouse and increases the distance obstructions can be near a fire hydrant from three feet to six feet. Mayor Gubler stated the fire code only requires three feet, but he understands this amendment will make it much easier for the Public Works Department to address problems as they arise with the water system. Mayor Gubler entertained a motion. Council Member McNamara made a motion to approve Ordinance No. 258-04-21, an Ordinance of the City of Iona, Idaho; amending Section 5-7-5 of the Iona City Code; specifying distance around fire hydrants to be kept free of obstructions; providing methodology; preserving prior Ordinances in each instance; providing for severability; and establishing an effective date. Council Member McNamara also made a motion to dispense with the rule of reading the proposed Ordinance in full and on three separate occasions. Council Member Wadsworth seconded the motion. A roll call vote was taken: Council President Geray: YES Council Member Wadsworth: YES Council Member McNamara:YES Council Member Thompson: YES Ordinance to Amend Iona City Code § 5-5-5 and § 8-3-2; pertaining to damage to public streets (Ord. 259-04-21) — Attorney Rawlings stated this amendment was also proposed by Director Prouse to include specific language in Section 5-5-5, which is a criminal code. He continued and stated Section 8-3-2 is the civil code and holds the violator civilly responsible for the damage done to public streets. Council President Geray asked whether this violation is worthy of the misdemeanor penalty, or if it should be changed to an infraction. Attorney Rawlings stated the City still has the discretion to pursue the penalty as a misdemeanor. Mayor Gubler entertained a motion. Council Member Wadsworth made a motion to approve Ordinance No. 259-04-21, an Ordinance of the City of Iona, Idaho; amending Section 5-5-5 of the Iona City Code; regarding damage to public streets; amending Section 8-3-2 of the Iona City Code; regarding civil liability for non-permitted excavation or damage to public streets; providing methodology; preserving prior Ordinances in each instance; providing for severability; and establishing an effective date. Council Member Wadsworth also made a motion to dispense with the rule of reading the proposed ordinance in full and on three separate occasions. Council President Geray seconded the motion. A roll call vote was taken: Council President Geray: YES Council Member Wadsworth: YES Council Member McNamara:YES Council Member Thompson: YES 3 IONA CITY COUNCIL REGULAR MEETING—APRIL 20, 2021 Ordinance to Amend Iona City Code § 8-4-10; specifying regulations for planting street trees (Ord. 260-04-21) — Attorney Rawlings stated this is a minor correction suggested by Director Prouse. He continued and stated the only change is a reference made to a corrected section. Mayor Gubler entertained a motion. Council President Geray made a motion to approve Ordinance No. 260-04-21, an Ordinance of the City of Iona, Idaho; amending Section 8-4-10 of the Iona City Code; specifying regulations for planting street trees; providing methodology; preserving prior Ordinances in each instance; providing for severability; and establishing an effective date. Council President Geray also made a motion to dispense with the rule of reading the proposed ordinance in full and on three separate occasions. Council Member Thompson seconded the motion. A roll call vote was taken: Council President Geray: YES Council Member Wadsworth: YES Council Member McNamara:YES Council Member Thompson: YES Ordinance to Amend Iona City Code § 8-2-4; providing a definition of "emergency" pertaining to private emergency wells in R-1 Zones (Ord. 261-04-21) — Attorney Rawlings stated this amendment relates to the discussion regarding the emergency wells that was discussed and enacted at last month's Council Meeting. He continued and stated this includes the definition of emergency in the context of"emergency wells". Mayor Gubler added this allows the City to declare an emergency and utilize private wells within the City. Mayor Gubler entertained a motion. Council Member Thompson made a motion to approve Ordinance No. 261-04-21, an Ordinance of the City of Iona, Idaho; amending Section 8-2-4 of the Iona City Code; providing a definition of"emergency" in the context of private emergency wells allowed within the City under specified conditions; providing methodology; preserving prior Ordinances in each instance; providing for severability; and establishing an effective date. Council Member Thompson also made a motion to dispense with the rule of reading the proposed ordinance in full and on three separate occasions. Council Member McNamara seconded the motion. A roll call vote was taken: Council President Geray: YES Council Member Wadsworth: YES Council Member McNamara:YES Council Member Thompson: YES STAFF REPORTS: Clerk West reported she is having knee surgery the following business day and will be in a straight brace for six weeks. She continued and stated she will be mostly working from home and her office assistants, Rylea and Heather, will be covering the office during business hours. Clerk West also reported planning is in full swing for Iona Days and the committee is desperately looking for volunteers to help. Mayor Gubler agreed and stated events cannot happen without the public's help. 4 IONA CITY COUNCIL REGULAR MEETING—APRIL 20, 2021 Deputy Williams reported the radar sign is ready and is currently placed on Olsen Avenue. He continued and stated it has the capability to gather data and generate reports to address specific timeframes that present the biggest concerns. He also stated he has begun addressing more animal control issues that have come up with the warmer weather, such as owners allowing dogs off leash on walks, etc. Council Member Wadsworth expressed his gratitude to Deputy Williams and the great service he is providing the City. Council President Geray requested feedback on the Easter Egg Hunt. Clerk West stated it went very smoothly and had a great turnout. She stated they received a lot of good feedback and positive responses about doing it later in the afternoon and making it a longer event. She added the City only used $150 from City funds for this event because of all the donations received. She stated there are always areas for improvement, but overall it was a great event. Council Member Thompson stated nothing to report. Council Member McNamara stated the Iona Historical Museum will be holding their meeting on Friday and she will be able to report more next month. Clerk West stated she has heard from the Museum directors and they will be doing an Open House towards the end of May. SUGGESTED AGENDA ITEMS: No suggestions made.
