The regular meeting of the Fraser Town Council was called to
order by Mayor Leonard 7 :30 p.m. Trustees present were Bickle,
Miller, Edwards,Timkum and Baker, Clif Clayton absent, being out
of town. Attorney Doucette, Vicky Winter, Monte Rogers.
Minutes of the previous meeting were approved as written.

One bill from the fire district to replace a window was in question.
John Miller contends that the snowblower being used for the ice rink
broke in an already cracked window at the fire house. Board will pay
it.Baker made a motion to pay the warrants, 2nd Edwards, Motion carried.
Don Smith approched the Board to get approval to condimumize a 3 -plex
he owns on Norgren Rd. Smith gave the Board drawings of the units.
A forth unit is planned for the building. Zoning ok for 4 -plex.
Mr. Smith will be liable to pay the difference on water rate. Apt. were
on a graduated fee, cham.ging to Condo. would mean a whole unit charge,
also apply for a tap one the fourth unit. Board gave Smith approval.

Judge Larry Petersen gave the court report. One traffice ticket may

Boar d discussed the Waldow property.Ctiuestionwas raised that more
living units exist at this property then zoning will allow. Orginally
before zoning went into effect there were 3 tnijrs, also 3 inits on the
water. Doucette has written the Waldows to get an explanitation of
what is at that location. At this time no word has been recieved on this,
Only 4 s/f units will be allowed on this property, as these w re there
before zoning.
Ric Davis has not responded to a letter fttom Doucette, explaing the position
of the Board to charge 4 units at the offiOO building and a signed agreement
to extend the main as agreed upon by Davis more than a year age. It is the
feeling of the Board that they have discussed with Mr. Davis all of the
terms concerning the extention 66 the water main since Nov. 1976 the Board
will stand firm on their dfcission that the main will be extended by
Davis to provide water for the structure of an office building, and that
this building will be coneccted to the new main.
Bickle made a motion to order the Town Clerk to start turn off prucedure
to this building for delinquent tap fees and usage fees, as no water can
be provided to this building as no water main exists, instructing Davis
tp provide a written agreement to extend this main if he wishes to
be serviced with water fnom the Town. 2nd Miller. motion carried.
Robert fl.orquist of Public Cervice gave the Board a map of the Town
with proposed numbering systems. The "oard will study these maps and
approve or change them at the next meeting. The street runing North and
outh on the West side of the tracts does not have a name. Board voted to
name this street Leonard Lane.

Mayor Leonard then advised that the next item of business
was a public hearing on the proposed adoption of an Ordinance entitled:

IN THE TOWN OF FRASER, COLORADO; ADOPTING BY REFERENCE
THERETO THE UNIFORM BUILDING CODE, 1976 EDITION;

The Ordinance having been read in its entirety, Trustee

indicated that publication of Notice as required by law

and that copies of the proposed Building Code, together with copies
of the Uniform Building Code Standards, the Uniform Mechanical Code,
the Uniform Code for the Abatement of Dangerous Buildings, and the
Uniform Fire Code, all of them being the 1976 edition, along with the
1978 Accumulative Supplement to the above Codes, as prepared by the
International Conference of Building Officials and the Western Fire
Chiefs Association, 5360 South Workman Mill Road, Whittier, California,
90601, and the State of Colorado Energy Conservation Standards, 2nd
Edition, adopted in November, 1977, had been available for purposes
of public inspection for at least fifteen (15) days prior to the public
hearing.
Thereupon, the presiding officer indicated to all those
present that the matter was open for general discussion.

After thorough discussion by all present of the merits and
disadvantages of the proposed Ordinance, and its adopted Codes, there
being no objections from those present to the passage of the same,
Trustee j, moved the adoption of said Ordinance and
the Codes incorporated therein by reference and that all rules of the
Board which might prevent unless suspended, the final passage and
adoption of this Ordinance at this meeting, be, and the same are here-
by suspended, for the purpose of permitting the final passage and
adoption of said Ordinance at this meeting. The foregoing motion was
seconded by Trustee

The presiding officer thereupon declared that the said motion
was carried and the said Ordinance duly passed and adopted.
Mr. Doucette, Town Attorney, then pointed out that on May
12, 1975 the Board of Trustees of the Town of Fraser had previously
adopted the 1973 Uniform Building Code and was enforcing said Code by
virtue of a Contract with Grand County. He indicated that since the
adoption of the 1976 Code with the 1978 Supplements was really an
amending and updating of Ordinance No. 57 that no changes in officials
or Boards as provided in 1975 need be made. He advised that pursuant
to Section 1601 of the Uniform Building Code Ordinance No. 59 had

been adopted and remained in effect establishing fire zones in the
Town of Fraser, all of the Town being Fire Zone No. 3. Under Section
204 of the Uniform Building Code a Board of Appeals had been appointed
whose members were Duane Roberts, Robert E. Morrow, Frank Baker,
Everett Tucker, and Darvin Welch. This same Board also served as
Board of Appeals under the Fire Code, that Board being pro

Section 2. Section 409 of the Uniform Building Code shall
to incorporate therein the following definition of "HEIGHT 0
HEIGHT OF BUILDING is the vertical distance above
"Grade" as defined herein to the highest point of
the structure. The measurement may be taken from
the highe:t adjoining sidewalk or ground surface
within a 5 -foot horizontal distance• of the
exterior wall of the building, when such a side-
walk or ground surface is not more than 10 feet
above grade. The height of a stepped or terraced
building is the maximum height of any segment of
the building.
All other provisions of Section 409 shall remain as set for
Code.
Section 3. Section 417 of the Uniform Building Code shall
to incorporate therein the following definition of "PERSON"
PERSON means any individual, partnership, corpo-
ration, association, company, or other public
or corporate body, including the Federal Govern-
ment, and includes any political subdivision,
agency, instrumentality, or corporation of the
State or the United States Government.

Section 4. Chapter 53 entitled "Energy Conservation" of the 1978
Accumulative Supplement to the Uniform Building Code is hereby deleted
in its entirety, said Chapter being replaced by The State of Colorado
Energy Conservation Standards for Residential and Non Residential
Buildings, 2nd Edition, November, 1977.
Section 5. All sections of the referenced Codes not specifically
amended by this Ordinance are adopted as published in said Codes.
Section 6. Any and all Ordinances, particularly Ordinance No. 57, or
parts of Ordinances of the Town of Fraser in conflict or inconsistent
herewith to the extent of such conflicts or inconsistencies are here-
by amended, provided, however, this Ordinance shall not affect the con-
struction of buildings for which Permits were issued prior to the
effective date of this Ordinance and all buildings now under con-
struction pursuant to existing Permits shall be constructeF3 in conform-
ance with the Building Code applicable at the time of the issuance of
said Permit, provided further however that no construction authorized
by an existing Permit shall be altered without complying with the
newly adopted Building Codes. Nor shall the adoption of this Ordinance
prevent the prosecution of violations of Ordinance No. 57 which
occurred prior to the effective date of this Ordinance. Where this
Ordinance and the Codes adopted herein by reference are in conflict with
other Ordinances of the Town of Fraser, the more restrictive provisions
shall apply.
Section 7. Any provision to the contrary notwithstanding, no Building
Permit shall be issued for construction within the Town of Fraser,
Colorado unless and until all applicable water connection taxes, fees
and charges have been paid in full.
Section 8. At least three (3) copies of each of the Codes hereby
adopted, all certified to be true copies, are now and shall remain on
file with the Town of Fraser. The Building Code as finally adopted
by this Ordinance shall be available for sale to the public through
the office of the Town Clerk. The fee for such Code shall be the same
as the cost to the Town of Fraser, plus Ten Dollars ($10.00) handling
charge.
Section 9. In addition to all legal remedies available for the enforce-
ment of the Building Code, such as injunctions and mandatory Restrain
ing Orders and any other relief; any violation of this Ordinance and
the Building Code adopted hereby, from and after the effective date
hereof shall be punishable by a fine not exceeding Three Hundred
Dollars ($300.00) or imprisonment for a term not exceeding ninety (90)
days or by both such fine and imprisonment.
Section 10. If any part, section, sub section, sentence, clause or
phrase of this Ordinance or the Building Code adopted hereby is for
any reason held to be invalid, such decisions shall not affect the
validity of the remaining sections of this Ordinance or of any such
Building Code; the Board of Trustees hereby declares that it would have
passed this Ordinance and adopted said Building Code in each part,
section, sub section, sentence, clause or phrase thereof, irrespective
of the fact that only one or more parts, sections, sub- sections,
sentences, clauses or phrases be declared invalid. Should any p ortion
of this Ordinance or the Code adopted hereby be declared invalid then
to the extent of such invalidity the amendment of Ordinance No. 57
shall be modified to limit said repeal so as to continue the provisions
of Ordinance No. 57 in effect for any portions of this Ordinance and
the Code adopted hereby which may be declared invalid or unenforceable.
Section 11. This Ordinance and the Building Code adopted by reference
shall become effective thirty (30) days after publication of this
Ordinance.

Bids on a new Backhoe for the Town were reviewed by the Board.
A11 of the bids are for the same size hoe. Baker made a motion to accept
the bid for the Case l ailkhoe contingent upon the right financiid plan
to fit the budget, 2nd Bickle- Baker aye. Tinkum- aye- Bickle aye-
