PETITIONER: Bret Hurley /Bretland Ridge LEGAL OWNER OF PROPERTY: Bret and Beth Hurley, husband and wife (name title is held) LOCATION: Bretland Ridge Subdivision, Section 15, Township 14, Range 4 West LEGAL DESCRIPTION: Commencing at a brass rod marking the southeast corner of the southeast quarter of section 15, township 14 North, Range 4 West, thence north 00 degrees 05 minutes 38 seconds West 1580.45 feet with the East line of said southeast quarter to a pk nail marking the centerline of Round Barn road; thence South 89 degrees 20 minutes 54 seconds West 175.00 feet to a 5/8" diameter rebar with cap marking the existing northwest corner of Lot A and the true point of beginning of the real estate described herein; thence South 000 degrees 05 minutes 38 seconds East 184.92 feet to a 5/8" diameter rebar with cap marking the existing Southwest corner of Lot A; thence South 89 degrees 15 minutes 08 seconds West 50.00 feet to a point on the South line of the drainage easement; thence North 00 degrees 05 minutes 38 seconds West 185.04 feet to a point on the north line of the drainage easement; thence North 89 degrees 20 minutes 54 seconds East 50.00 feet to the point of beginning, containing 0.21 acre, more or less. SUBJECT: Rezoning from R -2 to R -P WHEREAS, the Greencastle City Council received a favorable recommendation to rezone the property known as the frontage of Bretland Ridge Subdivision from R -2 to R -P at its public hearing concerning the above matter on the 28th day of May, 1996, after proper notice was given by publication in the Banner - Graphic, Greencastle, Indiana; and WHEREAS, the Greencastle Plan Commission paid reasonable regard to the following factors as enumerated in I.C. 36 -7 -4 -603 in consideration of a recommendation to the City Council: 1. the comprehensive plan; 2. current conditions and character of the current structures and uses in each district; 3. the most desirable use for which the land in each district is adapted; 4. the conservation of property values throughout the jurisdiction; 5. responsible growth and development. THEREFORE, BE IT ORDAINED that the subject area be rezoned from R -2 to R -P subject to a deceleration lane being installed on the Northside of Bret Lane. This ordinance shall be in full force and effect from and after its passage, promulgation, approval by the Mayor and publication in accordance with the law.
