AN ORDINANCE AMENDING THE CODE OF THE CITY OF
GREENCASTLE, INDIANA, AND ESTABLISHING A
SPECIAL NON - REVERTING CAPITAL AND A
SPECIAL NON - REVERTING OPERATING FUND
FOR THE DEPARTMENT OF PARKS AND RECREATION
WHEREAS, the Board of Parks and Recreation of the City of Greencastle, Indiana,
(the 'Board "), under the provisions of the Indiana Code 36- 10 -4 -16, is empowered to charge
a reasonable fee where necessary in order to provide a particular park and recreation activity;
and
WHEREAS, the Common Council of the City of Greencastle, Indiana, under Indiana
Code 36- 10 -4 -16 is empowered to create a special non - reverting capital fund for the purpose
of acquiring land or making capital improvements; and
WHEREAS, the Council is also empowered under Indiana Code 36- 10-4-16 to create
a special non - reverting operating fund into which monies procured by such activities shall be
deposited with the Clerk- Treasurer; and
WHEREAS, the Council is empowered to provide by ordinance that expenditures may
be made from the special non - reverting operating fund by appropriation by the Park Board.
NOW THEREFORE be it ordained by the Common Council of the City of
Greencastle, Indiana, as follows:
Section 1. There is hereby established a special non - reverting capital fund created
for the purpose of acquiring land or making improvements for parks and recreation purposes
from which expenditures may be made by appropriation by the Council.
Section 2. The non - reverting capital fund shall be funded from monies and fees
procured from the operation of the Greencastle Aquatics Center (the "Center ") to the extent
that such monies and fees annually exceed the budgeted revenues of the Center.
Section 3. Disbursements shall be made from the special mon- reverting capital fund
only upon claims allowed and signed by the President and Secretary of the Board.
Section 4. There is hereby also established a special non - reverting operating fund
created from monies and fees procured from park and recreation activities other than the
regular day to day monies and fees generated by the Center.
Section 5. That portion of the annual monies and fees (season passes, rentals,
concessions, swim lessons and daily fees) from the Center not exceeding the annual projected
® revenue of the Center shall be deposited by the Clerk- Treasurer in the general park fund. All
other monies and fees from other recreational activities procured from the Center or otherwise
shall be deposited by the Clerk- Treasurer in the special non - reverting operating fund.
Section 6. The Board may from time to time direct the transfer of funds from the
special non - reverting operating fund to the non - reverting capital fund.
Section 7. Expenditures may be made from the special non - reverting operating fund
by the Park Board upon approved claims allowed and signed by the President and Secretary
of the Board.
Section 8. This ordinance shall be in full force and effect from and after its passage
as approved by law.
