HomeMy Public PortalAbout19760510CCMeeting1 1 25 Savannah Beach, Georgia May 10, 1976 The Regular Monthly Meeting of Savannah Beach City Council was held this evening at 7:00 P.M. in the council room of Savannah Beach City Hall with Mayor M. J. Counihan presiding and a quorum consisting of the following Councilmen present: Edward Fahey, Joseph Agnew, James Bond, Fred de Borde, John Wylly and Richard DeLoach. Also present at the meeting were City Attorney William H. Pinson, John Price, Chief of Police and City Marshal Taylor. Before the meeting was formally opened for business, Mayor Counihan allowed the various petitioners present who had requested permission to do so to appear before Council. Mr. Leonard Guyer, a resident of the beach in the area of Seventeenth Street, appeared before Council to request help with the storm drainage problem in his area. His father, Mr. Clarence Guyer also added some remarks. Councilman de Borde, Chairman of D.P.W. was requested by Mayor Counihan to look into this to see what relief we could give them. Next to appear before City Council was Mr. Speir whose property lies between 8th and 9th Streets on the Strand. He stated that he filed an_application for a building permit approximately three months ago which has not yet been granted because he was told sewage could not be provided. City Attorney Pinson informed Mr. Speir that one of the hold ups had been in obtaining easement to run a sewer line over some adjacent property. He said that these easements had now been obtained and filed for record. Councilman Jim Bond, Chairman of Water and Sewer, was requested to look into this as quickly as possible. Mr. Bond stated that he would try to give Mr. Speir some definite information by Friday and try to get this sewer line run. Mr. Grosse asked Mayor Counihan if the question of the parking lots in Fort Screven would be discussed at this meeting. Mayor Counihan replied that he did not think so since there was nothing on the agenda concerning this. Mr. Walter Parker, Savannah Beach merchant, asked questions about the new parking lot arrangements. He stated that he and the other merchants felt $1.50 was too much for the visitors to pay 26 -2- because a lot of them did not want to stay all day and that this fee was too high for just an hour or two. Mayor Counihan informed Mr. Parker that this was being tried on an experimental basis. Mrs. Nancy Anderson and Mrs. Sally Bostwick appeared to complain about the condition of South Campbell Avenue following the sewer work done there by Griffin Construction Company. Mayor Counihan instructed Councilman Bond to pass this information along to the Construction as well as the Resident Inspector and bring a report back to Council as soon as possible. Mr. Irving Rubin, a beach resident, stated he wanted to suggest to Council that they help the senior citizens who want to . get to the beach and it is too far for them to walk. He felt that some form of transportation like a jeep might be helpful. Mr. Jack Coneff requested permission from Council to use the beach as access for Hobby Cat Craft and to stage a regatta for the Hobby Cat Fleet. Permission was denied. Mr. Carl Thompson, a Fort Screven resident, wanted to know if Council was going to try to a section of Fort Screven to allow parking lots. Councilman Fahey answered Mr. Thompson stating that it was not their intention to re -zone this property, all we were trying to do was to get out of a contract with the Corps of Engineers and when they found out it was against the rules, we stopped. While this Council Meeting was in progress, a meeting of the Savannah Beach Planning Commission was also in progress and when their meeting ended, Mr. Bert Barrett, Chairman, came in to the Council Meeting for the purpose passing along to City Council some of the action taken there. Mr. Barrett reported that a special meeting of the Planning Commission was called for 6:30 this evening for the purpose of taking some action on several items of business with the view of presenting to Council their recommendations at this meeting. He said the result was two recommendations to City Council, as follows: 1. That the Savannah Beach Zoning Ordinance be amended so as to allow a City - operated parking lot on the north end of the island, this to be accomplished by allowing City- operated parking lots in an R -1 zoning classifi- cation and that these lots be allowed an area zoned 1 1 1 -3- for commercial activity; thereby bringing the other City owned parking lots into conformity with said Zoning Ordinance. 2. Also, Chairman Barrett stated that a request had been received from Mr. David Thomas for a zoning change in approximately six acres of land more or less, bounded by Chimney Creek on the West, U.S. Highway 80 on the South; Lot 15, Fort Ward on the East and Naylor Street and its extension on the north. Mr. Barrett stated that the Planning Commission recommended that the zoning in this area be changed from C -2 and R -1 zoning classifications to an R -T to allow for the development of a residential subdivision. Chairman Barrett stated that since these recommendations were just approved at tonights meeting of the Planning Commission and these would be put in writing and forwarded to the City Council as soon as possible. The meeting was then opened by the Mayor for the conduct of business legally presented. The Minutes of the Meeting of April 12, 1976 were approved as written. 27 The following Communications were then read by the Clerk: A letter from Mr. Martin Kent, Attorney for Mr. J. Grant Mann who received several injuries while participating in a bicycle race held at Savannah Beach on March 20, 1976. A letter from Attorney Alton Kitchens who represents Ester L. Watson; and John W. McGee, Jr., two minor children who sustained injuries on April 25, 1976 by stepping on a piece of protruding jetty in the vicinity of 18th Street. A letter from Mr. Foley of the Savannah Beach. Fire Department requesting that certain itemized fire plugs be replaced or repaired. A letter from Col. Edwin C. Keiser, Corps of Engineers, stating his appreciation for the action taken by the City in remedying the problem created by the storm drainage in the vicinity of Seventeenth Street and the sea wall. A letter from Mr. Jerry Rogers of W.S.G.A. requesting permission from the Mayor and Council to present a Battle of the Bands in the Fourteenth Street Parking Lot on May 29th which was granted. -4- A letter to the Mayor and Council from Councilman Fred de Borde in regard to acquiring ambulance service for the City of Savannah Beach. Bills of the various departments for the month of April were approved for payment. Approved copies of these bills are attached to and form a part of these minutes. The next item on the agenda was the scheduled hearing on the appeal of Mr. William S. Lovell on his right to vote in Savannah Beach Municipal Elections. This hearing was formally opened by Mayor Counihan following which Mr. Lovell was permitted to present his reasons why he felt that he should be allowed to vote in Savannah Beach Municipal Elections. Among the reasons given for feeling he should be allowed to vote in Savannah Beach elections were the following: 1. He has owned a house down here since 1925. 2. No specific reasons were given him by the Savannah Beach Registrars as to why he could not vote in Beach Elections. 3. He has spent three or four months out of the year at his Savannah Beach home every year of his life. He stated further that he had owned this home here since 1925. 4. He was a Savannah Beach Councilman from 1934 to 1965. 5. He voted at the Beach as a non - resident property owner until 1970 at which time the state law was changed to allow only domiciled residents of the beach to vote in beach elections. 6. He appealed to Superior Court and was allowed to vote in 1972 and 1974 after which the Savannah Beach Board of Registrars took him off the voting list stating that they did not feel that he was a domiciled resident of Savannah Beach. 7. He did not own any property anywhere except the house he lived in at Savannah Beach on Lovell Avenue. 8. Mr. Lovell stated that the only reasons the. Savannah Beach Board. of Registrars could give him for denying his right to vote was that his wife owned their home in Savannah and had their Homestead Exemption on this piece of property. 1 1 29 -5- Several questions were propounded to Mr. Lovell by members of the Council and then Mr. Fabrikant, Chairman of the Board of Registrars which prompted them to take Mr. Lovell's name off the list of qualified elections of Savannah Beach. Mr. Fabrikant stated that the principal reasons for denying Mr. Lovell a vote were: 1. Mr. and Mrs. Lovell owned two homes, one at the beach and one in Savannah. They saw fit to secure their homestead exemption on the Savannah house and NOT the beach house; and, as most people know, in order to . get a homestead exemption, the home owner must state under oath that he considers that particular house his home or domicile. Also, Mr. Fabrikant continued, since most of the law that he had read placed a great deal of importance on the intent of the person, his board used the homestead exemption as one of their criteria for extablishing residency. After Mr. Fabrikant's remarks, Mrs. Shaw and Mrs. Butler the remaining members of the Board of Registrars also gave several of their reasons for voting to deny Mr. Lovell's vote. Mrs. Butler cited one instance in the Georgia Law that states a woman may have a separate domicile from that of her husband but the husband may not have a separate domicile from that of his wife. Following more discussion, Councilman de Borde made a motion that this matter be held in abeyance for further study. The motion was seconded by Councilman Fahey and unanimously carried. In responce to a request from Mr. Bert Barrett to fill two vacancies on the Planning Commission, Mayor Counihan appointed Mr. Lloyd Hauser and David Thomas for one year terms. Upon motion made by Councilman Edward Fahey, Police Commissioner, City Council approved the following malt beverage licenses: The Sandwich Shop The Country Store The Riptide The Port Royal East - Charles H. Morse - Sammy Long - E. Dean O'Neal - David Thomas - Donna Kay Dean There being no further business the meeting was adjourned to the next regular or special called meeting.
