HomeMy Public PortalAbout2022.261 (09-20-22)RESOLUTION NO. 2022.261 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD APPROVING AN AGREEMENT BETWEEN THE CITY OF LYNWOOD AND MUNIENVIRONMENTAL TO PROVIDE SOLID WASTE MANAGEMENT TECHNICAL SUPPORT SERVICES IN AN AMOUNT NOT TO EXCEED $150,000 ANNUALLY BY WAY OF A 4/5THS VOTE OF ITS MEMBERS TO ALLOW FOR AN EXCEPTION TO THE FORMAL BIDDING PROCESS WHEREAS, over the years, CalRecycle has imposed unfunded mandates onto cities and counties to divert waste from the landfill and to reduce GHG emissions; and WHEREAS, in 2016, the Governor signed into law Senate Bill (SB) 1383 establishing methane emissions reduction targets in a statewide effort to reduce emissions of short-lived climate pollutants; and WHEREAS, SB1383 imposes certain collection and processing, edible recovery, and procurement requirements onto cities and counties; and WHEREAS, MuniEnvironmental has assisted the City with negotiations with the City's hauler, coordinating the roll -out of the Assembly Bill (AB) 1826 commercial organic waste recycling, waste and recycling rate setting, SB 1383 grant submittal, and submittal of the capacity planning to the County to name a few; and WHEREAS, MuniEnvironmental has the capacity and technical ability to provide services immediately to comply with SB 1383; and WHEREAS, Lynwood Municipal Code Section 6-3.13(a)(3) allows for an exception to the formal bidding process or request for proposal or qualification process if the City Council finds by resolution adopted by not less than four -fifths of its members that such an acquisition may be more economically and efficiently effected through the use of an alternate procedure. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND, PROCLAIM, ORDER, AND RESOLVE AS FOLLOWS: Section 1. The City Council of the City of Lynwood hereby finds and declares that the foregoing recitals are true and correct, and incorporates them herein as findings and as a substantive part of this Resolution. Section 2. That the City Council approves an Agreement with MuniEnvironmental in a form approved by the City Attorney. The City Council authorizes the Mayor to execute said Agreement with MuniEnvironmental and to execute this Resolution for and on behalf of the City of Lynwood. 1 Section 3. That the City Council by at least 4/5 of its members finds that obtaining immediate technical services to comply with State mandates on waste management and recycling without a competitive bidding process is more economical and more efficiently effected by this procedure. Section 4. This Resolution shall take full force and effect immediately upon adoption by the City Council. Section 5. The City Clerk shall certify as to the adoption of this City Council Resolution.
