AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING
ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE
OF THE CITY OF RICHMOND, INDIANA, PROVIDING FOR THE REZONING OF
THE PROPERTY LOCATED IN THE 2500 BLOCK OF NATIONAL ROAD WEST
FROM R-2 SINGLE-FAMILY RESIDENCE DISTRICT AND C-2 COMMERCIAL
DISTRICT TO C-4 GENERAL BUSINESS DISTRICT.
WHEREAS, the Zoning Map which is a part of Ordinance No.
2325-1968 designates and describes as R-2 Single -Family
Residence District and C-2 Commercial District, the
property located in the 2500 Block of National Road
West; and,
WHEREAS, it is the intent and purpose hereof to change the
zoning classification of said property from R-2
Single -Family Residence District and C-2 Commercial
District to C-4 General Business District; and,
WHEREAS, a study of this Ordinance was conducted by the Richmond
City Plan Commission the a8� day of
1986, at which time remonstrances were heard from all
parties interested in or affected by this Ordinance;
and,
WHEREAS, the vote of the Richmond City Plan Commission was /D
to p in favor of/in recommending the
passage of Ordinance No. 77-1986.
NOW THEREFORE BE IT ORDAINED by the Common Council of the City
Richmond, Indiana, as follows:
SECTION 1. That the zoning classification of the property
described below, and the same is hereby changed to C-4
General Business District, and that said property be
regulated in accordance with the Zoning Ordinance of
the City of Richmond, Indiana and all amendments
thereto.
Being a part of Fractional Section 1, Township 13,
North, Range 2 West, in the City of Richmond, Indiana,
and being more particularly described as follows:
Beginning at an end post set in concrete said post
being 154.25 feet south 88 degrees east of the
northwest corner of Meadowbrook Acres Addition, as
recorded in Plat Book #9, page 59 in the records of the
Wayne County, Indiana, Recorder's Office, and running
thence, from said beginning point, north eighty-eight
(88) degrees west, a distance of 618.65 feet to a fence
corner post set in concrete; thence north 2 degrees
west, 115.75 feet to an iron pipe; thence north 81
degrees and 50 minutes east, parallel to the centerline
of United States Highway #40, a distance of 181 feet to
an iron pipe; thence north 72 degrees and 59 minutes
east, 311.20 feet to an iron spike in the south
right-of-way line of said United States Highway #40;
thence north 81 degrees and 50 minutes east, along said
south right-of-way line, 154 feet to an iron pipe;
thence south 1 degree and 30 minutes west, along an
established fence line, 272.50 feet to the place of
beginning, containing an area of two and seventy-six
hundredths acres more or less, being the same real
estate as conveyed to Frank Martin & Lizzie Martin,
husband and wife, as shown in Deed Record 178, page 393
of the records of Wayne County, Indiana.

AND ALSO;
Being a part of Fractional Section 1, Township 13
North, Range 2, West in the City of Richmond, Indiana
and being more particularly described as follows:
Beginning at an iron pipe at the northwest corner of a
2.76 acre tract of land owned by Clyde and Marie Martin
and Frank and Lizzi Martin, as described in Deed Record
193, page 285 in the Office of the Wayne County
Recorder, Wayne County, Indiana, said beginning point
being more particularly described as follows:
Beginning at the intersection of the centerline of
United States Highway Number 40 with the east line of
said Fractional Section 1, and running thence
westwardly, along said centerline, 1972.91 feet to the
centerline of the Toschlog Road, thence south 2 degrees
west, along the centerline of said Toschlog Road 431
feet, thence north 88 degrees west 645.25 feet to an
end post set in concrete at the southeast corner of
said Martin tract, thence continuing north 88 degrees
west, along the south line of said Martin tract, 618.65
feet to a corner post set in concrete at the southwest
corner of said tract, thence north 2 degrees west,
along the west line of said tract, 115.5 feet to the
beginning point of this description, and running
thence, from said beginning point, north 2 degrees west
9.05 feet to a point in the south right-of-way line of
said United States Highway Number 40; thence north 81
degrees and 50 minutes east, along said right-of-way
line, 188 feet to a concrete right-of-way monument;
thence north 70 degrees and 31 minutes east, along said
right-of-way line, 203.97 feet to a concrete
right-of-way monument; thence north 81 degrees and 50
minutes east, along said right-of-way line, 99.7 feet
to a railroad spike on the north line of said Martin
tract; thence south 72 degrees and 59 minutes west,
along the north line of said tract, 311.20 feet to an
iron pipe; thence 81 degrees and 50 minutes west, along
the north line of said tract, 181 feet to the place of
beginning, containing an area of 0.10 acres, moreor
less.
SECTION 2. This Ordinance shall be in full force and effect
from and after its passage and approval as by law
required.
PASSED AND ADOPTED BY THE Common Council of the City of Richmond

Dear Mr. Bodiker, Members of Common Council & Mrs. Merchanthouse:
The Richmond City Plan Commission conducted a public hearing on
Tuesday, October 28, 1986, on the petition of Bruce and Marie
Houchin, requesting to rezone property located in the 2500 Block
of National Road West on the south side from R-2 Single Family
Residence District and C-2 Commercial District to C-4 General
Business District.
Thirteen (13) notices of public hearing were sent to surruonding
property owners with one (1) returned in favor of the request.
During the public hearing no one spoke in opposition to the
request.
The Plan Commission voted ten (10) to zero (0) to recommend that
Ordinance No. 77-1986 be adopted.
