Wayne Neddermeyer - Mayor in Chair Priscilla Arens - Clerk All members present on Tuesday, March The minutes of the meeting of February 1, 1972 read. Moved by Arthur'Theis that the minutes be approved as read. Seconded by Thomas Stevens potion carried. The minutes of the special meeting of February 7, 1972 read. Moved by Robert Franklin that the minutes be approved as read. Seconded by Donald Des Lauriers Motion carried. The minutes of the Plvining Commission meeting of February 21, 1972 read. Thomas Schneeweis of Ehlers and Associates, Inc. discussed the renewal of the M-00,000.00 bond. Moved by Thomas Stevens that we authorize Mr. Schneeweis to consult with Mr. Crow of Strand and Roe in order to give us the necessary information upon the bond issue. Seconded by Donald Des Lauriers Motion carried. + Opened the bids on the snowplow. (2 bids submitted)' Itasca Equipment Campahy - One-way trip plow Hitch Assembly, etc. Hydraulics Hall Equipment Company - Plow and one way Hydraulics Moved by Thomas Stevens to have a special meeting on when the road committee will come in with a recommendation on the snow plow bids. William Torodor appeared at the request of the Council with regard to the type of pictures are tiding shown at the Colonial Theater. Moved by Robert Franklin to thnew the 1972 license for the Colonial Theater with the stipulation that the rating be shown on the marque. Seconded by Thomas Stevens Motion carried. At 9:05 the meeting re -assembled at Medina Lanes because of the large crowd. The Mayor announced that in the fmture the police officers would contact residents where they had pushed snow out on the road and ask them to take care of this situation. Moved by Arthur Theis to appoint Br. R. A. Olson as health officer for 1972. Seconded by Donald Des Lauriers Motion carried. 69 Moved by Robert Franklin for adoption of Resolution 72-5 as follows:. Whereas, a request for a permit has been made by Wilfred Scherer for the construction of a building for the pur:ose of processing meat on property owned by him and legally described as follows: to wit: The Northeast q of the Southeast i of Section 16, Township 118, Range 23, lying East of County Road No. 87 and South of the North 125 feet thereof; and mr AS, the Plannint Commission has recommended that a permit be granted subject to the approval of *the landowners of property surrounding the above -described ormperty; and WHEREAS, it is the desire of the Village Council to protect the surrounding property, which has an agricultural/ rendektuak use, fry "spot" zoning for commercial use; and WHERAS, the property owned by Wilfred Scherer has been used for the purpose of meat processing for over twenty-five yearsT which use was in existence prior to the adoption of the Medina Village Zoning Code on April 7, 1959; and WHERAS, said use of property owned by Wilfred Scherer is of a non -conforming nature pursuant to Section 17of the aforesaid Zoning Code adopted April 7, 1959; and WHEREAS, Wilfred Scherer must construct a building in order to continue his meat processing oper.tion and in order to comply with State and Federal regulations concerning the handling and process- ing of meat; NOW THEEEFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MEDINA, IL MIN; ESOTA : 1, That Wilfred Scherer -be granted a permit for the construction of a building for the purpose of meat processing on property owned by him and legally described above. 2. That the non -conforming use for which said building permit is granted is for a period of 20•years and renewable thereafter and cannot be transferred to any other individual or corporation for the life of the property owner, Wilfred Scherer, and in the event a transfer does occur, or in the event of the death of Wilfred Scherer, the non -conforming use shall be terminated. 3. That the site for the construction of said building shall be approved by the Medina Village Building Inspector. 4. That that building shall be constructed according to plans and specifications submitted to and approved by both the Planning Commission and the Village Council, said plans and specif- ications to include a septic and drain field which shall be installed according to the requirements of the Building Inspector. 5. That said building shall be approximately 1600 square feet in size, having 40 feet x 40 feet as its outside dimensions, and shall not in any way be expanded upon in the future. 6. That said building shall com ly wotj the regiore,emts pf t }e Medina Building Code, the Sanitary Sewer Code, and the Pollution Control Agency, along with State 'and Federal regulations with respect to the handling and processing of meat. 7. That said building shall not contain sales rooms. 8. That commercial advertising signs shall not be placed upon said property. 9. That there•hhall be no slaughtering on the premises. The following people expressed their opinions with regard to the WCCO Tower: John Neale; Mr. Tonkkemper, land appraiser; Larry Geisler, Midwest Plonntmg and Research; Nancy Laurant; Clem Neumann; Matt Reimer; Julia Porter; Emil Jubert; Sheldon Coplin; Dell Deitz; Gordon Michaelson of WCCO; and Mr. Doerr. Moved by Donald Des Lauriers to hire some impartial appraisal company to study the situation and bring back a report at the March/4th'meeting. Seconded by Robert Franklin Motion carried. Walter Kohnen presented the plat of the Third Division'of Independence Heights. Moved by Thomas Stevens to approve the plat for the Independence Heights Third Division. Seconded by Arthur Theis. Motion carried. 70 Moved by Robert Franklin to. grant a 1972 cigarette license to Robert Feser of the Medina Golf Course. Seconded by Thomas Stevens Motion carried. . Rev. Emerson presented the plat for a study center. He is to bring further information at the special meeting of March 16th. Moved by Thomas Stevens to pass Resolution 72-6 enacting Ordinance 140 with regard to outdoor burning. Seconded by Donald Des Lauriers Motion carried. Moved by.Thomas Stevens to pay the bills as follows: payrol in the amount of $5,061.17 and order checks in the amount of :; 4,804.08. Seconded by Robert Franklin Motion carried. Moved by Robert Franklin to pass Resolution 72-7, Authorizating amendment -of contract for police protection between the Village of Medina and the Village of Loretto, and also the Amendment to the original contract. • Seconded by Thomas Stevens Motion carried/ Moved by Thomas Stevens that we reject the application by Northwestern Bell Company #3365 for installing buried cable, and have Donald Des Lauriers .to Seconded by Arthur Theis check on it.. Motion carried. Moved by Donald Des Lauriers to advertise for bids for gravel as last year, bids to be opened on April 4, 1972 at 8 P. M. Seconded by Thomas Stevens Motion carried. Moved by Robert Franklin to adopt Resolution 72-8 as follows: WHEREAS Hilding W. Silfvertsten reported extensively on the activities of the Medina Village Council,. and chid so in an accurate and complete manner; and WHEREAS Mr. Silfversten went beyond the duties strictly required of him as a reporter and often offered information to the Council in a helpful and cooperative manner; hd WHEREAS Mr. Silfvertsten, as editor of the Mound West Tonka Minnetonka Sun, showed a true spirit of community for the Village of Medina and other villages in western Hennepin County; NOW, THEREFORE, BE IT RESOLVED, that the Medina Village •Council expresses its deep regret at the death of Hilding Silfversten on February 20, 1972, and mourns the loss of this talented man as both a competent profess- ional journalist and as a friend; and BE IT FURTHER RESOLVED that the Council convey its regrets to Mr. Silfversten's family and to the Minnetonka Sun through copies of this resolution; and BE IT FURTHER RESOLVED that the. Council suggests to the appropriate authorities that, should the Luce Line railway be converted to use as a recreation trail, it be named as a memorial to its most active pro- moter as the "Hilding Silfversten Trail of Magic". Seconded by Thomas Stevehs Motion carried. Moved by Robert Franklin that the following letter be sent to the Metropolitan Council, 300 Metro Square Bldg., St.Paul, Minn. 55101. The February Newsletter of the Metropolitan Council indicates that committees are now considering policies on metropolitan benefit as related to sewer construction. The Medina Village Council feels that whatever policy is Rdopted must be broad enough to protect the cleanliness of these lakes that are truly a coundy-wide 71 or metropolitan -wide resource. There are, as you may know, some concentrations of -housing around lakes that are so isolated from any other -developments that the cost of sewering them in now prohibitive, if the effluent is to be diverted elsewhere. Many such concentrations now pose pollution problems or have a potential for pollution. We believe that a failure to provide for such situations in a policy of metropolitan benefit would have a very definite adverse effect on the lakes of the metropolitan region. We trust that Scou will consult with municipalities of the region before adoption of any benefit policy. Signed by Wayne Neddermeyer as Mayor of the Village of Medina. Moved by Robert Franklin to table the -matter of the snow plow for further study. Seconded by Donald Des Lauriers Motion carried. Rev. Emerson presented the matter of hosteling on his farm. Moved by Thomas Stevens that we table the matter to April"and recommend that the tax assessor get in touch with Reve. Emerson. Seconded by Arthur Theis Motion carried. A letter from Hennepin County re Boyer road read. A notice of bankruptcy of the Mickey's Bottle Shoppe read. Donald Des Lauriers reported he had contacted appraisers on land values. Moved by Thomas Stevens that Donald Des Lauriers go to the Planning Commission meeting on Monday and present the information ha has gathered with regard to a study of impact of WCCO tower to the value of the adjacent property owners." Seconded by Arthur Theis Motion carried. Looked at Wetlands maps. They are going to the Planning Commission for the use in re -zoning. 72 Moved by Thomas Stevens to approve appointing William Mills for the comprehsnsive sewer plan for Medina and also to work with the committee to study. the. zoning. Seconded by Donald Des Lauriers Motion carried. A letter is being sent to William Torador with regard to the X rated movies they are showing. Moved by Thomas Stevens to adopt Resolution 72-9 as follows: WHEREAS,. ithas, been called to the attention of the Medina Village Council that it would be timely and proper to establish a separate special police fund; NOW THEREFORE BE IT RESOLVED that the Village Council of the Village of Medina does hereby establish a separate fund to be known as the Special Police Fund and does hereby transfer to said fund the sum of one dollar from the general funds of the Village; and BE IT FURTIIR RESOLVED that the Village may accept and deposit in said fund all monies properly received under state law; that said fund shall be used exclusively for expenditures for the Village Police Department; mut that the Village Council shall have control over such fund and expenditures from it; and that monies from said fund may be spen, for any Police Department purpose that is valid under state law and municipal ordinances. A "Thank You" letter is being Sent to Medina Recreations, Inc., thanking them for all they did when the ballroom•was used for meetings. Moved by Thomas Stevens to post the roads as to weight from March 20, 1972. Seconded by Donald Des Lauriers �--- Motion carried. Moved by Donald DesLauriers to advertize for approximately 4rtons of MC and/or Ac mix to be included with the gravel and oil advertising for bids. Seconded by Arthur Theis . Motion carried. Moved by Robert Franklin that we•get the•.necessary signs to divert all trash, etc. hauling so that it comes to the landfill via #19 and Hamel Road. Seconded by Thomas Stevens Motion carried.
