HomeMy Public PortalAbout2022.284 (10-18-22)RESOLUTION NO. 2022.284 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD APPROVING AN AMENDMENT TO THE AGREEMENT WITH WATERWORKS TECHNOLOGY FOR THE INTERIM MANAGEMENT OF THE WATER AND SEWER OPERATIONS IN AN AMOUNT NOT TO EXCEED $451,100 PER YEAR FOR A ONE YEAR TERM; APPROVING WATERWORKS TECHNOLOGY TO WORK ON CAPITAL IMPROVEMENT PROJECTS; AUTHORIZING THE CITY MANAGER TO APPROVE ADDITIONAL SERVICES OR EMERGENCY SERVICES NOT TO EXCEED 25 PERCENT OF THE CONTRACT PRICE; AND AUTHORIZING THE APPROPRIATION OF $94,387 FROM THE UNAPPROPRIATED SEWER FUNDS. WHEREAS, all suppliers of domestic water to the public are subject to regulations adopted by the U.S. Environmental Protection Agency as well as under the California Safe Drinking Water Act; and WHEREAS, the City's Sewer System Management Plan calls for the City's sanitary sewer collection system facilities are properly operated, maintained and managed to reduce frequency and severity of sanitary sewer overflows (SSO) and their potential impacts on public health, safety, and on the environment; and WHEREAS, Section 64413.7 of the California Code of Regulations requires for each distribution system to designate at least one Chief Operator and one Shift Operator 22 CCR§ 64413.7; and WHEREAS, the Water and Sewer Division still has the Utility Services Manager and Utility Services Supervisor positions vacant; and WHEREAS, on January 15, 2021, the City Council approved a new contract between the City and Water Works Technology to continue to provide services for an additional year with an option to continue on a month -to -month basis; and WHEREAS, continued support from Waterworks Technology is needed to maintain operations continuity until such time that the Utility Services Manager position and other recommended staffing support proposed are recruited and filled. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND, PROCLAIM, ORDER, AND RESOLVE AS FOLLOWS: Section 1. The City Council of the City of Lynwood hereby finds and declares that the foregoing recitals are true and correct, and incorporates them herein as findings and as a substantive part of this Resolution. 1 Section 2. That the City Council approves an amendment to the Agreement between the City and Waterworks Technology, Inc. in an amount not to exceed $451,100 per fiscal year to provide interim services to manage the water and sewer divisions, provide field and administration support for CIP projects, on -call services to address any emergencies and necessary support until June 30, 2023 with an optional year extension ending June 30, 2024. Section 3. That the Mayor is hereby authorized to execute an amendment to the current Agreement in a form approved by the City Attorney for and on behalf of the City of Lynwood. The Mayor is also authorized to execute this Resolution. Section 4. That the City Council authorizes the following appropriation: APPROPRIATION Fund Dept Div Object Description Amount 6401 45 460 62015 Professional/Contractual Services $94,387.00 6401 Budgetary Fund Balance ($94,387.00) Section 5. This Resolution shall take effect immediately upon its adoption. Section 6. The City Clerk shall certify as to the adoption of this City Council Resolution.
