Savannah Beach, Georgia
September 8, 1976
The Regular Monthly Meeting of Savannah Beach City Council
was held this afternoon at 3:30 p.m. in the Councilroom of the
City Hall with Mayor M. J. Counihan presiding and a quorum
consisting of the following Councilmen was present: W. C. Fleetwood,
Fred de Borde, Edward Fahey, Jerome Bettencourt and Karen Losey.
City Attorney Lance Smith was also present.
Mayor Counihan immediately opened the meeting for business
properly presented.
COMMUNICATIONS: The Clerk read a letter from Mr. James
L. Fabrikant, Chief Registrar for Savannah Beach in which he
stated that he had been in contact with Mr. William S. Lovell.
Earlier in the year Mr. Lovell had appealed the decision of
the Board of Registrars on his right to vote in Savannah Beach.
Mr. Fabrikant stated in the letter that Mr. Lovell had registered
to vote in Savannah, declaring that as his home. This was taken
as information by the Council.
The Clerk then stated that he had received a letter from
the Department of Manpower Development stating that the funding
the City was now receiving for C.E.T.A. employees may end
September 20, 1976 if not extended by the Federal Government,
but in any case they needed a list of new positions the City of
Savannah Beach would like to have funded by the C.E.T.A. Program.
It was decided to hold this letter in abayance until word was
received on whether the program would continue.
Bills of the various departments for the month of August
were approved for payment. Copies of same are attached to these
minutes.
The Clerk then read a proposed list of Poll Workers for
the upcoming Special Election of September 13, 1976. The list
read as follows:

There being no objections it was so ordered.
The next item on the agenda was the rezoning of the property
formerly known as "The Tank" located at Second Street and
Butler Avenue and owned by Mr. Charles Masterpolis. Councilman
Fleetwood stated that after a study of the situation, he moves
that the application for re- zoning be denied. The motion was
seconded by Councilman de Borde and unanimously carried.
At this time, Councilman Bettencourt read a brief history
of a historic event that involved Joseph F. Ebberwein who saved
the lives of two children. Mr. Bettencourt read the following
Resolution for Mr. Ebberwein:
RESOLUTION
Following the reading, Councilman. Fahey moved the Resolution
be adopted. The motion was seconded by Councilman Fleetwood and
unanimously carried.
At this time, Mayor Counihan presented Joseph. F. Ebberwein
with the Savannah Beach Meritorious Award Plaque.
A Resolution was then read by City Attorney Smith accepting
the tax digest the City recently received from Chatham COunty
and also setting the City's millege rate at 26 mills. The
Resolution read as follows:
RESOLUTION
A motion was made by Councilman Fleetwood to adopt the
Resolution. The motion was seconded by Councilman de Borde
and unanimously carried.
Councilman Fleetwood suggested that Council instruct
the City Attorney to send a letter to all citizens with a
large delinquent water /sewer account. He continued by saying
that all of these delinquent accounts should be cleared up
before any changes are made in the Water /Sewer Ordinance. He
then read a sample letter to,,be sent.
A motion was made by Councilman Fahey that Council instruct
the City Attorney to proceed in the direction of clearing up
these delinquencies. The motion was seconded by de Borde
and unanimously carried.

City Attorney Smith then read a Resolution authorize
Councilman Fleetwood to countersign for City Clerk E. M. Patterson
in his absence. Mayor Counihan stated this would be used for
bonds also. The Resolution read as follows:
RESOLUTION
Following the reading of the Resolution, Councilman Fahey
moved for its adoption. The motion was seconded by Councilman
Bettencourt and unanimously. carried.
Attorney Leo Beckman appeared before Council representing.-.
Colonel and Mrs. Zender V. Dean on property they purchased
in Fort Screven Ward and have built their home upon. He stated
that when the Deans applied for a loan on the house, they were
told they needed to have a title search to prove the property
was clear of all liens. It was during this title search that
he found that the house had been built on Beachwood Drive, an
unopened street. He continued that the Deans are asking Council
to Quit Claim this property,known as Beachwood Drive, to them.
Mayor Counihan appointed Councilmen Losey, Bettencourt and
Fahey as a committee to get with City Attorney Smith and himself
on this for handling at the next Council Meeting.
There being no further business, the meeting was adjourned
until the next Regular or Special called meeting.
At this time Council reopened for a public hearing that
had been called for the purpose of discussing projects to be
submitted to the Economic Development Administration on Title I
of the Local Public Works Capital Development and Investment
Program. City Attorney Lance Smith read the notice of the Public
Hearing that was placed in the Savannah News /Press. This notice
was accepted as information.
Mayor Counihan then called on Councilman de Borde who
presented the list of projects the City would be submitting
in order of priority. The list read as follows:
1. Storm Drainage.
2. Parking Lot in Fort Screven and the approach to the
Parking Lot.
3. Three bathroom facilities.
4. Police and Fire Department Combination
5. Civic Center.
There being no objections to the list as read, it was so
ordered.

There being no further business, the hearing was adjourned
to the next Regular or Special Called Meeting.

R E S O L U T I 0 N
WHEREAS, Savannah Beach, Tybee Island, Georgia,
is a Municipal Corporation chartered under the laws of
the State of Georgia, and under its charter, acts through
its Mayor and Council; and
WHEREAS, on the 22nd day of July, 1976, Joseph
F. Ebberwein demonstrated his courage and knowledge ac-
quired through his water safety training; and
WHEREAS, young Joseph F. Ebberwein responded to
the aid of two children who were in the near state of
drowning; and
WHEREAS, Joseph F. Ebberwein rescued the said two
children and demonstrated his water safety knowledge by
rendering mouth -to -mouth resucitation.
NOW, THEREFORE, BE IT RESOLVED that said Joseph
F. Ebberwein is hereby awarded the Savannah Beach
Meritorious Services Award for his timely efforts, which
resulted in the lives of two children being saved.
NOW, THEREFORE, BE IT FURTHER RESOLVED that this
Resolution be spread upon the minutes of the meeting of
City Council, City of Savannah Beach, Georgia as a lasting
thanks and congratulations.
ADOPTED IN OPEN COUNCIL, this 8th day of
September, 1976.

TYBEE ISLAND, GEORGIA
A RESOLUTION
A RESOLUTION TO IMPLEMENT THE PROVISIONS
OF SECTION 2 -6 OF THE CODE OF ORDINANCES OF
THE CITY OF SAVANNAH BEACH, TYBEE ISLAND,
GEORGIA.
WHEREAS, it is necessary that checks drawn against
the several accounts of the City of Savannah Beach, Tybee
Island, Georgia in the various banks in the City of Savannah,
Georgia for the withdrawal of funds, be signed and /or counter-
signed by the Mayor and Treasurer of said City of Savannah
Beach, Tybee Island, Georgia.; and
WHEREAS, No provisions have been made for the signing
and /or countersigning of checks on behalf of the Treasurer in the
event of his absence;
NOW, THEREFORE BE IT RESOLVED that the said William C.
Fleetwood, Financial Officer and Chairman of General Government,
is hereby authorized to sign and /or countersign as the case
may be for and on behalf of the Treasurer in his absence
on any bank in the City of Savannah, Georgia where funds are
now deposited or may hereafter be deposited to the account
of the City of Savannah Beach, Tybee Island, Georgia, and
the several banks are hereby authorized to accept his signature.
THE WITHIN RESOLUTION IS HEREBY ADOPTED AND APPROVED
this 8th day of September, 1976.

° RESOLUTION
WHEREAS, under date of December 8, 1975 the City of
Savannah Beach, in Council assembled, duly adopted an Ordinance
requiring the payment of Real Property Taxes in two (2) install-
ments with the final installment to be adjusted to the new approved
valuation as received, from the Chatham County Tax Assessors for
the year 1976; and
WHEREAS, the City of Savannah Beach has now received the
new valuations for the year 1976 from the Chatham County Tax
Assessors which reflect the one hundred percent (100 %) fair
market value of all Real Estate to be $ 24,616,430.00 , the
assessed value at 40% of all Real Estate to be $ 9,846,572.00 ,
and the gross tax bill at 26 mills to be $ 256,010.87 ;
and
WHEREAS, valuations for Personal Business Property for
the year 1976 have also been received from the Chatham County Tax
Assessors which reflect the one hundred percent (100%) market
value of all Personal Business Property to be $ 760,212.00 , the
assessed value at 40% of all Personal Business Property to be
$ 304,084.80 , and the gross tax at 26 mills to be $ 7,906.20
NOW, THEREFORE, BE IT RESOLVED that THE CITY OF SAVANNAH
BEACH, in council assembled, does hereby adopt these new valuations
for purposes of payment of the final installment of Real Property
Taxes.
The within resolution is adopted and approved this
8th day of September , 1976.
