On this the 2nd day of April, 1955 the Town Council con-
vened in Special Meeting at its regular meeting place with
all members present.
Alderman Woodall introduced a resolution and moved that it
be adopted.The Motion was seconded by Alderman Owens and the
Motion carried by a vote of five ayes and no noes. Resolution'
is as follows:
Resolution directing the Mayor to instruct the engineers,
Freese & Nichols to enter into an agreement with the Texas
Water Wells, Incorporated to abandon drilling of a Trinity
sand well at the Evergreen Water Plant and that a test be
made on a tract of land where the City Hall is located and
that the extra compensation to be paid Texas Water Wells,
Inc., be determined in accordance with the contract exist-
ing between the Town and Texas Water Wells, Inc.
WHEREAS, the Town did on the loth day of February, 1955 enter
into a contract with the Texas Water Wells, Inc. for the con-
struction of a Trinity sand water well at the Evergreen Plant
in the Town of Richland Hills, Texas and in accordance with
said contract the said Texas Water Wells, Inc. did on the
instruction and under the supervision of the Town engineers,
Freese & Nichols drill a test hole at the said Evergreen Plant;
and,
WHEREAS the report of the engineers to the Town Council is that
the Trinity Sand well at the Evergreen Plant is not of suffi-
cient depth and that it is very doubtful that a well could
be completed that would produce sufficient water to justify
the expense of completing a well; and
WHEREAS, the engineers have recommended that the location be
changed and that the Trinity Sand well not be drilled at
the Evergreen Plant and whereas the engineers have recommended
that a test hole be drilled on the tract of land where the
City Hall is located and whereas it is necessary that the Texas
Water Wells, Inc. be compensated for the extra work and; Whereas,
the contract provides a method whereby the extra work done can
be determined in accordance with the contract; and,
WHEREAS, an emergency exists in that it is necessary that a
newvell be completed in the immediate future and whereas,
there is not sufficient time in which to advertise for bids
to drill the proposed test.on the City Hall lot and whereas,
the method of determining the extra work in accordance with
the contract with Texas Water Wells, Inc. is fair and reason-
able;

BE BE IT THEREFORE RESOLVED BY THE TOWN COUNCIL OF THE TOWN
OF RICHLAND HILLS, TEXAS THAT:
1. Mayor Norton shall do all things necessary and proper in
accordance with the contract existing between the Town of
Richland Hills, Texas and the Texas Water Wells, Inc., to
abandon the drilling of a Trinity Sand Well at the Evergreen
Water Plant and to drill a test hole on the Town Hall tract
of land and if said test hole is satisfactory to the engineers
to do all things necessary and proper to see that said well
is completed in accordance with the contract existing between
the Town and the Texas Water Wells, Inc.
2. That the Mayor is further authorized and directed to do
all things necessary and proper to make and enter into an
agreement to compensate Texas Water Wells, Inc. for the extra
work involved in moving the location of the propsed well and
running the extra test hole after receiving recommendation
from the Town Engineers Freese & Nichols.
