HomeMy Public PortalAbout19761013CCMeeting1 1 1 10 Savannah Beach, Georgia October 13, 1976 The Regular Monthly Meeting of Savannah Beach City Council was held this afternoon at 3:30 P.M., with Mayor Michael J. Counihan presiding and a quorum consisting of the following____ Councilmen present: Edward J. Fahey, Bill Fleetwood, Jerome Bettencourt, Fred de Borde, Karen Losey and Nick Alexander. City Attorney W. Lance Smith, III was also present. Mr. Willy Whalen appeared before Council complaining that the City was sending him a water bill once a month but his water was disconnected three years ago quite a distance from his meter. He feels he should only be required to pay the sewer bill. Mayor Counihan turned the matter over to Council - man de Borde for study. Marcia (Berry) Donaldson appeared before Council describing the many problems that have arisen from the continued parking of marina customers along Venetian Drive near the home of her parents. After showing Council pictures of the problem and letters between the previous Council and City Attorney on the problem, she requested that Council approve the enforcement of the No Parking Signs she plans to put up. She asks that this be done only until they can sell the house. Mrs. Tom Bradley, owner of Tyee Marina, stated that this same problem existed when the Berrys' purhcased their house but it did not stop them from buying. At this time Mayor Counihan stated that the matter would be handled by Council. Pat Nelson and Richard Hood were introduced to Council by the Mayor as two young men who had interviewed him for a school project. Chief John Solomon of the Savannah Beach Volunteer Fire Department presented Council with a Fire Department Master Plan which consisted of several suggestions on what the present department lacks and what is needed to produce and maintain a highly trained and experienced department. Among these suggestions were the purchases of a new truck, more beepers, and a paid fireman. The Mayor said that he and the Council would look into these recommendations and thanked the Chief for coming before Council. The meeting was then opened by the Mayor for the conduct of business legally presented. 1 11 The Minutes of August llth, September 8th, and September 13th, 1976 were approved as written. 1 1 Bills of the various departments for the month of October were approved for payment. At this time, City Attorney Lance Smith gave a rundown on a Quit Claim request by Col. Zender V. Dean for a portion of :eechwood Drive. Upon applying for a financial loan with First Federal it was discovered that the house had been built on a portion of Beechwood Drive for which First Federal is requiring a Quit Claim from the City of Savannah Beach to Col. Dean. After a discussion between Councilmembers on the location of the house and whether the property should be sold or given, a motion was made by Councilman de Borde that a survey and a Real Estate Appraisal of the property be made at the expense of the Deans, at which time the City could determine a reasonble price for the property. The motion was seconded by Councilman Bettencourt. An amendment to the motion was made by Councilman Fahey that a special meeting be called when this information is reviewed. Following the amendment made by Councilman Fahey, the motion was carried on a vote of four in favor with Councilmen Fleetwood and Alexander abstaining. Councilman deBorde gave Council a rundown on a problem Mrs. Irene Williams of 73 Chatham Avenue has had for seven years with a collapsed storm sewer line running through the middle of her property. He stated that it was his understanding that she was willing to give an easement in order to install a new line. Mrs. Willaims stated that she was willing to give easement on the southside of her property adjacent to a vacant lot. She added that a new outlet through the seawall will need to be added at the City's expense. City Attorney Smith asked Mrs. Williams if she would sign an agreement releasing the City of all past present and future damages to her property as a result of the storm sewerline. Mrs. Williams stated that she was not after any of the City's money but that she felt the past damages were the fault of the City's. She was, therefore, willing to sign a release on the in- stallation of the new line only. After further discussion, the City Attorney suggested that upon receipt of the releases which Mrs. Williams attorney is to draw up, a motion be made that immediate action be taken to relieve Mrs. Willams of this problem. Following a phone call to her attorney, Mrs. Williams stated that she would be willing 1 1 to accept $250.00 from the City to help pay for legal services. This was agreed by the entire Council. Councilman Bill Fleetwood stated that the present Personnel Ordinance needed to be revised or completely removed and a new one put in its place. He continued by saying that a Special Meeting had been set for the 27th of October for the purpose of making any changes the Council felt were necessary. Councilman Fleetwood brought up the Franchise Agreement between the City and Savannah Electric and Power Company stating that it was outdated and needed to be revised. He had received a new agreement from them but felt the reading should be held off until the next meeting giving the City Attorney time to go over it. This was agreed by the Mayor and Council. City Attorney Smith read an amendment to an Ordinance updating the Franchise Agreement between the City and Southern Bell stating that the license would now be based on 3% of the receipts from Southern Bell. The amendment read as follows: ORDINANCE This was accepted as the first reading, the second reading to be at the next regular or special called meeting. At this time Councilman Alexander read a letter received from Mr. Shuble Boling of the Chatham County Health Department' setting up a time schedule for house inspections and showing a fee of $1533.00 for the year of 1976. Mr. Alexander made a motion that the clerk write Mr. Boling for a schedule and fee for 1977 and that the inspections be re- established for Savannah Beach. The motion was seconded by Councilman Fleetwood and unanimously carried. Mayor Counihan told Council he felt Mr. Bob Williams of the Sewer Plant should be required to sign a contract agreeing to repay the City for the expense of sending him to school. Councilman deBorde stated that the Ciyt Attorney should be allowed to study this before an agreement is drawn up. It was decided to hold this in abeyance for further study. At this time City Attorney. Lance Smith brought up a sub- division request by Mr. Abe Javetz for his property described as Lot 45, Ward 2, Savannah Beach, Georgia. Mr. Smith stated that when he received the request from Mr. Javetz he turned it over to City Hall inorder that they might let the Zoning Admin- istrator go voer it. He then called on Mr. Earl Anderson, Zoning Administrator, to give his findings. Mr. Anderson stated he found everything in order and recommended approval by Council for the subdivision. 12 1 13 4- Mayor Counihan asked whether the plat showed an easement for garbage pickup, etc. Mr. Anderson stated that an easement of 10' was shown. Chief Johnny Solomon of the Savannah Beach -------Volunteeepartment explained to Council that the 10' easement was considered a walking easement and was not suitable to handle a fire truck. After a long discussion, Councilman deBorde made a motion that the subdivision request by Mr. Abe Javetz be approved on the grounds that he allow for a 12' easement. In addition, he stated that the property owner adjoining Mr. Javetz must be required to give 12' also, if and when he decides to subdivide. The motion was seconded by Councilman Fahey and was carried on a vote of five for and one abstention by Councilman Fleetwood. Councilman Bill Fleetwood stated that Mr. Sidney Register on Tenth Street wished to purchase the portion of 10th Street running east from his property line to the corner of Fourth Ave. He suggested that the neighbors, Mr. Walsh and Mr. O'leary, be notified of Mr. Registers request before Council wades a decision. Mayor Counihan suggested the City sell only a portion of the area he requested so as not to land lock the neighbors. This was agreed by all Councilmembers. At this time, the Mayor appointed Councilman Fahey to find out exactly how much land Mr. Register needed and to report back to Council at the next Regular Council Meeting. Councilman Nick Alexander presented to Council a proposal to turn 16th Street into a two -way street. He presented Council with several drawings showing 16th Street and the parking lots from 14th Street to 18th Street and the proposed changes to be made. Following a question and answer period by the other members of Council, it was decided that Council would meet at 16th Street before the Special Meeting called for October 27th to discuss the proposal. Councilperson Karen Losey stated that at the present time the Savannah Beach Volunteer Fire Department has a total of 29 regular members, ten of which were on the pension plan. She made a suggestion that the City of Savannah Beach begin paying the $5.00 a month for the ten members as well as any new members, not to exceed 30 members. She hoped this would encourage new members. Councilman Fleetwood moved that the City pay for the first ten members and any new members not to exceed 30. The payments were to begin after the first of the month. This was seconded by Councilman de Borde and unanimously carried. 1 -5- There being no further business, the meeting was adjourned to the next regular or special called meeting. BE IT ORDAINED by the Mayor and Council of Savannah Beach, Tybee Island, Georgia, that: Section 11 -8, Schedule of License Taxes, under "Telephone Company" be amended so that such Section under "Telephone Company" shall read as follows: Section 11 -8 Schedule of License Taxes Telephone Canpany (a) Each telephone company operating in the City shall pay an occupational license tax in the amount of three percent (3 %) of the recurring . local ser- vice revenues received by such company from subscribers located within the City or one thousand five hundred dollars ($1,500.00), whichever is greater. Said occupational license tax shall be paid in quarterly installments, each of which shall be due on or before the last day of the second (2nd) month following the end of each calendar quarter and shall be based on recurring local service revenues billed during such calendar quarter. (b) "Recurring local service revenue" shall mean: (1) Monthly charges for local exchange service, including: a. Charges for additional listings and joint users; b. The guarantee portion of the charge for semi- public pay station services; c. Charges for local message rate service, including mobile service local messages; and d. Subscriber station revenues from teletypewriter exchange service; (2) Charges for Morse transmission, signaling, date transmission, remote metering and supervisory control, where both terminal points are within the City limits; and (3) All charges for local private line services (except audio and video program transmission services) where both terminals of the private line are within the City limits. Nothing in this definition shall preclude the charging of a separate franchise tax for the transmission or audio or video programs to customers by CATV companies. 1 1 It is the intention of the governing body, and it is hereby ordained the Code or Ordinances, City of Savannah Beach, Tybee Island, Georgia, may have its sections renumber- ed to accomplish the revision of this ordinance. This ordinance shall be in full force and effect immediately upon its adoption. All ordinances or parts of ordinances in conflict herewith be and the same are hereby revised.
