AN ORDINANCE TO APPROPRIATE WITHIN THE GENERAL FUND
WHEREAS, it has been determined that it is now necessary to appropriate more
m oney than was appropriated in the annual budget:
NOW THEREFORE BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY
Or RICHMOND, WA'YNE COUNTY, INDIANA-
SECTION 1. That for the expenses of said municipal corporation the following
additional sums of money are hereby appropriated.

The Common Council of the City of Richmond, Indiana, met in regular session in the
Council Chambers in the Muncipal
Building of said

The Clerk presented proof of publication of Notice to Taxpayers printed in the
Richmond Palladium Item, a newspaper of general circulation in the City of Richmond,
Indiana on the date of January 25, 1985 Said notice stated that a public
hearing would be held on the 4th day of February , 19 85 , by the
Common Council to consider additional appropriations as provided for in Ordinance No.
5-1985 ) within the City of Richmond, Indiana. The proof of publication was
examined and found to be in order- Councilperson Morris _ moved the
proof of publication be received and filed, seconded by Councilperson Bodiker
and on unanimous voice vote the, motion was carried.
The Clerk read on second reading Ordinance No. 5-1985
President Williams announced Ordinance No. 5-1985 was on public hearing.
After hearing all persons present, Ordinance No. 5-1985 was placed nn final
passage or rejection and on a call of the roll the following was recorded -

The vote being 7 to 2 in favor of passage of Ordinance No. 5-1985

RE: ORDINANCE NO. s 1985
Dear Council,
This ordinance would settle a claim against the City of Richmond brought by
the administratiix of the estate of wilmetta Howard and James Jones. You may
recall that two years ago a house on Butler Street was found to contain two
bodies. A few days after the bodies were found the house was burned pursuant
to the zequest of the fire department and certain administrative officials
at that time. The City has been served with a notice of tort claim asking
for damages in thousands of dollars. The City Attorney and the attorney for
the claimants in this matter have reached a tentative agreement. The agreement
would provide that the City would purchase the .land on which the house was
located at a premium price which would then satisfy all the pending claims
against the City.
Personally, I feel this is a fair settlement. There was a gross absence of
procedural due process in this case. The city's exposure, if this went to trial,
Rtands to be substantial. The land and the building, prior to the fire, appraised
at around $10,000.00, so essentially, in the $20,C00,00 settlement the city
will be receiving some equity back.
There are additional reasons for the City purchasing this property. The property
is not an ideal location to rebuild another house; neighbors are complaining of
the conditions of the burned house and are requesting that it be torn down.
14hile this matter is not resolved the building must remain in its present condition.
If this case is not settled, the City will probably bear the burden of maintaining
the property such as mowing the yard, etc. To settle this case, will require
an appropriation of $20,000.00 from the general fund. The City Controller's
office has indicated that there is that amount of money available.
If you have any questions on this, please ask me. I would prefer to discuss
this in executive session if the questions become detailed. If you will recall,
I did recommend that we settle this case at an earlier executive session in
1984.

REFERENCE: Appropriation Ordinance No. 5-1965
At the request of the City Attorney the appropriation of $20,000. from the fund
balance of the General Fund Is requested.
The fund balance was $130,000. greater at December 31, 1984 than was
anticipated in the 18 month budget plan passed last August,
I feel that this expenditure of $20,000. will not create a hardship an the General
Fund in case the anticipated 1985 Revenues fall short.
The M,000. will be added to the rewards, refunds and indemnity line item in the
Board of Works budget. The 1985 budget set the line item at $5,000. of which
$2,000. has already been expended.

or at such other place as may be designated. At ouch hearing taxpayers
objecting to any of such additional appropriations nay be hoard. Interested
taxpayers may inquire of the County Auditor when rind where such hearing
will be held.
