HomeMy Public PortalAbout006-1985- ZONING - 600BLK OF SOUTH L STREETCENERA.L ORDINANCE NO. 6-1985 AN ORDINANCE AMENDING CHAPTER 154 OF THE MUNICIPAL CODE, BEING ORDINANCE NO. 2325-1968, COMMONLY KNOWN AS THE ZONING ORDINANCE OF THE CITY OF RICHMOND, INDIANA, PROVIDING FOR THE REZONING OF THE PROPERTY LOCATED IN THE 600 BLOCK OF SOUTH "L" STREET FROM M-1 LIGHT INDUSTRIAL DISTRICT TO M-2 GENERAL INDUSTRIAL DIS- TRICT. WHEREAS,the Zoning Map which is a part of Ordinance No. 2325- 1968 designates and describes as M--1 Industrial Dis- trict the property located in the 600 Block of South "L" Street; and, WHEREAS, it is the intent and purpose hereof to change the zoning classification of said property from M-1 Light Industrial District to M-2 General Industrial District; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the CZ day of 1985, at which time remonstrances were heard from parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was to p in favor of/�recommending the passage of Ordinance No. 6-1985. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as follows: SECTION 1. That the zoning classification of the property described below, and the same is hereby changed to M-2 General Indus- trial District, and that said property be regulated in accordance with the Zoning Ordinance of the City of Richmond, Indiana and all amendments thereto. Being a part of Lots 289 to 293 inclusive, all;of Lots 342 to 350 inclusive, and Lots 399 to 407 inclusive in Bealview Addition, parts of vacated South 6th Street, South "M" Street, and Oakland Streets, and all of a vacated alley, all being in the City of Richmond, Wayne County, Indiana, and being more particularly described as follows: Beginning at an iron pipe set at the point of inter- section of the south line of South "L" Street with the centerline of vacated South 6th Street as recorded in Plat Book 7, Page 12, and running thence, from said beginning point, east, along the south line of South "L" Street, (assuming said south line runs east and west) and the north line of Lots 399, 342, and along a vacated alley as recorded in Plat Book 7, Page 12, and along vacated Oakland Street, 339.16 feet to an iron pipe set in vacated Oakland Street, said point being 18.00 feet at right angles from a Chesapeake & Ohio Railroad siding track; thence running parallel to said siding tracts 18.00 feet in equal width the following courses and distances, south 6 degrees, 41 minutes and 00 seconds east, 75.33 feet to an iron pipe. set; thence south 8 degrees, 38 minutes and 30 seconds east, 94.23 feet to an iron pipe set; thence south 15 degrees, 38 minutes and 30 seconds east, 119.33 feet to an iron pipe set; thence south 25 degrees, 09 minutes and 35 seconds east, 91.38 feet to an iron pipe set; thence south 27 degrees, 01 min- utes and 45 seconds east, 46.11 feet to an iron pipe set at the point of intersection with the centerline of vacated South "M" Street as recorded in Plat Back 7, Page 12; thence north 89 degrees, 04 minutes and GENERAL ORDINANCE NO.'.6-1985 Page 2 40 seconds west, along the centerline of said vacated street, 430.20 feet to an iron pipe set on the east line of South 6th Street; thence north 0 degrees, 52 minutes and 20 seconds east, along said east line, 30.00 feet to an iron pipe set at the point of inter- section with the north line of South "M" Street and being at the southwest corner of Lot 407 in Beallview ,Addition; thence north 89 degrees, 04 minutes and 40 seconds west, along the north line of said South "M" Street, 30.00 feet to the centerline of vacated South 6th Street; as previously described; thence north 0 degrees, 52 minutes and 20 seconds east, along said centerline, 369.31 feet to the place of beginning, containing an area of 3.520 acres. ALSO: Being all of Lots 284 through M inclusive and a part of a 15 foot wide vacated alley in Beallview Addition to the City of Richmond, wayne County, Indiana, and being more particularly described as fcllows: Beginning at an iron pipe set at the point of inter- section of the south line of South "L" Street with the east right-of-way line of the C. & O. Railroad, said beginning point also being the northwest corner of Lot 284 in Beallview Addition, and running thence,, from said beginning point, east, along the south line of said South "L" Street, (assuming said Street runs east and west), 74.90 feet to an iron pipe set in the centerline of a 15 foot wide vacated alley; thence south 0 degrees, 53 minutes and 00 seconds west, along said centerline and parallel to the west line of South 7th Street, 269.79 feet to an iron pipe set on a curve in the east right-of-way line of said Railroad; thence northwArdly, along a 1904.74 foot radius curve to the right, having a 278.88 foot chord which b.ears.north 14 degrees, 41 minutes and 40 seconds west, an arc distance of 279.13 feet to the place of beginning_ containing an area of 11,053.04 square feet, or 0.254 acres. SECTION.2. This ordinance shall be in full force and effect from and after its passage and approval as by law required. Gardner, Agent, requesting to rezone property located on the south side of South "L" Street in the 600 Block, from M-1 Light Industrial District to M-2 General Industrial District. Twenty-one (21) notices of public hearing were sent to surround- ing property owners with two (2) returned in favor of the re- quest and eleven (11) returned in opposition to the request. During the public hearing, Mr. Jack Edelman, President of the Recycling Center, indicated that the rezoning request was initiated because his business had grown and additional room was needed to accommodate expansion. The property in question is presently fenced and being utilized by the Recycling Center as an area to store vehicles, equipment and material that has been processed. However, the M-1 zoning classification of this property does not allow processing of material or other junk yard operations. Several neighborhood residents spoke in oppo- sition to this petition citing concerns about excessive noise and vibration, fire hazards, air pollution and devaluing of adjoining property values. The Plan Commission considered the following factors: (1) The Master Plan designation for the property is Industrial; and, in fact, the property is surrounded on all sides by Industrial zoning. (2) The property is adjacent to a primary thorough- fare and a major railroad line. Mr. Marion Williams, President Members of Common Council February 28, 1985 Page 2 (3) Surrounding land use is a mix of industrial, commercial and residential. There are twelve (12) dwelling units located along- South 6th Street, between South "M" and South "N" Streets that are zoned Industrial. (4) Traffic volumes associated with a primary thorough- fare and the activity associated with commercial and industrial land use are primarily conditions in the general area. The Plan Commission determined that the highest and best use of the subject property would be represented by the M--2 zoning classification, and, therefore, voted nine (9) to zero (0) to recommend the adoption of Ordinance No. 6-1985 Respectfully submitted, CITY PLAN COMMISSION Daniel S .
