WHEREAS, Ralph B. and Dawn K. Sandvig have petitioned the Common Council of the City of Richmond requesting to vacate a certain ten (10) foot utility ease- ment; and, WHEREAS, the Common Council, pursuant to the provisions of I.C. 36-7-3-12, conducted a public hearing on said vacation petition on i 1985; and, WHEREAS, a study of this Ordinance was conducted by the Richmond City Plan Commission the day of 7AtLtC�u�4 , 1985, at which time remon- strances ere heard from all parties interested in or affected by this Ordinance; and, WHEREAS, the vote of the Richmond City Plan Commission was y to o in favor of/' t�-e recommending passage of Ordinance No. 7-1985. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of Richmond, Indiana, as follows: SECTION 1. That the ten (10) foot utility easement de- scribed below is hereby vacated: Being all of the five (5) foot utility easement strip beginning in the northeast corner of Lot 18 and Funning 203.87 feet along the east side of said Lot 18 to the Woods Drive right-of-way and all of the five (5) foot utility easement strip beginning in the northwest corner of Lot 17 and running 203.87 feet along the west side of said Lot 17 to the Woods Drive right-of-way. SECTION 2. This Ordinance shall be in full force and effect from and after the passage and approval as by law required. Sandvig FOR THE VACATION OF CERTAIN UTILITY EASEMENTS PETITION FOR VACATION OF CERTAIN UTILITY EASEMENTS The Petitioner, Ralph B. and Dawn K. Sandvig, 3735 South A Street, Apartment 6, Richmond, Indiana, pursuant to the Provisions of I. C. 36-7-3-12. petitions the Common Council of the City of Richmond, Indiana as follows: (1). Petitioner seeks to effect the vacation of the said utility easement described as follows: Being all of the five (5) foot utility easement strip beginning in the northeast corner of Lot 18 and running 203.87 feet along the east side of said Lot 18 to the Woods Drive right-of-way and all of the five (5) foot utility easement strip beginning in the northwest corner of Lot 17 and running 203.87 feet along the west side of said Lot 17 to the Woods Drive right-of-way. (2). The petitioner owns all land abutting the proposed easement to be vacated. The names and addresses of the other property owners who have an interest in the proposed vacation are set forth on the attached "Exhibit All, incorporated herein and made a part of. (3). A list of those utility companies who have been contacted to ascertain the effect of the proposed vacation upon the existing utilities is set forth in the attached "Exhibit B" made a part hereof, and incorporated herein. The petitioner proposes to grant a new utility easement across the west side of Lot 18. PETITION OF Ralph B. and Dawn K. Sandvig:, WHEREFORE, the Petitioner, Ralph B. and Dawn K. Sandvig requesting vacation of a ten (10) foot utility easement in the Glen Hills Addition, Sec- tion One, being located between Lots 17 and 18. All utility companies have reviewed the request and indi- cated they have no objection to the vacation.
