HomeMy Public PortalAbout27 Rent Control FundRENT CONTROL FUND x ~ r ~~~y ~ -_ CITY OF RAMC O MIRAGE ~, RENT CONTROL FUND ~ .~ FUND 245 RENT CONTROL FUND PROGRAM DESCRIPTION The Rancho Mirage Mobilehome Fair Practices Commission (Commission) is made up of seven (7) members, one of the Commission's members is a mobilehome park resident and one member is a mobilehome park owner/manufactured community operator. All Commissioners are appointed annually by the City Council and serve for a one (1) year period. One of the primary responsibilities of the Commission is to preside over and render rulings in regards to the following petitions: a) Hardship Rent Increase Petitions, b) Rent Decrease Petitions, and, c) Petitions for Determination. All of the above petitions are related to the subject of rent control, rent increases/rent decreases, reductions in services and the interpretation of the City's Rent Control Ordinance -Chapter 9.58 of the Rancho Mirage Municipal Code. Chapter 9.58 of the Rancho Mirage Municipal Code establishes the policies, petition hearing procedures, Commission responsibilities, Commission appointment and terms of the Commission. The Commission may also be responsible for hearings on other issues related to mobilehome parks/ manufactured communities located in the City. The Commission generates a limited amount of annual revenue. The Commission's two revenue sources are the filing fees for the above "petitions" and a $5 annual fee which is collected from each mobilehome park/manufactured community owner for every mobilehome unit/manufactured unit in their park that is not under a long term lease (a long term lease is a lease that is in excess of one year or longer). The revenues collected by the City are then placed into this fund and used to pay for a portion of the costs that are incurred to research, secure necessary professional services/opinions, etc., and research other subjects related to issues proposed or before the Commission. In those years where expenditures exceed revenues, necessary subsidies are provided by the General Fund. FY 2001-2002 ACCOMPLISHMENTS Staff continued to work with RAMMPAC and owners of mobilehome/manufactured communities to ensure and promote positive working relationships and assist both parties in resolving disputes related to mobilehome park issues. Continued development of the Commissioner's understanding of their role and responsibilities. Commission heard a hardship rent increase petition filed by Rancho Palms and rendered a decision to deny the requested increase. 283 FY 2002-2003 ACCOMPLISHMENTS • Staff was successful in conducting aspace-by-space inspection and identifying Title 25 and Health ~ Safety violations related to the Rancho Mirage Mobilehome Community. Subsequent to these inspections, a ,number of residents participated in the Home Improvement .Program to abate identified violations. • Litigation between the Rancho Mirage Mobilehome Community and the City of Rancho Mirage was resolved and the park owner has agreed to undertake and abate a number of Title 25 and Health 8~ Safety violations. • Staff worked with the owner of the Rancho Mirage RV & Mobile Village, LLC, to provide the necessary technical assistance to secure information related to the abandonment of the existing septic system, • Staff also worked with the owner of Rancho Mirage RV & Mobile Village, LLC, to secure the necessary financing from the RDA in the form of along-term loan which was needed to abandon the existing septic system and install a new sewer system in the Park. This work was completed in January 2003. • Staff continued to work with the presidents of the mobilehome park(s) Homeowners Associations to assist in the resolution of issues that could become problematic. • Staff opened dialogue with the flue Skies Village Homeowners Association (HOA) regarding working together (HOA and. staffl to promote the HIP and to undertake apark-wide rehabilitation project-for the replacement of driveways. • Staff continued to successfully work with all park owners and the State of California to collect necessary Annual Permit to Operate fees. These fees are paid annually by the park owners. GOALS AND OBJECTIVES FY 2003-2004 • To ensure that all mobilehome parks/manufactured communities (in the City) provide a safe and decent living environment in compliance with and as required by Title 25 and/or other governing code(s). • To ensure that all mobilehome parks/manufactured communities (in the City) maintain established rent levels in compliance with Chapter 9.58 of the Rancho Mirage Municipal Code. • To make recommendations resulting in portions of Chapter 9.58 of the Rancho Mirage Municipal Code being amended to be consistent with related portions of the State of California Civil Code. • To ensure that. the tenants and mobilehome park/manufactured community owners work in a cooperative manner and receive inspection services in a professional and timely manner. • To ensure that rents for "affordable" mobilehome/manufactured units are ,maintained as "affordable." 284 • To ensure that any reduction in or elimination of services by the park/manufactured community owner results in an appropriate rent adjustment. • To ensure that the Mobilehome Fair Practices Commission is advised on published articles, court decisions, etc., relating to rent control. FY 2004-2005 • To continue to address and abate Health & Safety and Title 25 violations. • To ensure that rents .for "affordable" mobilehomelmanufactured units are maintained as "affordable." • To ensure that all mobilehome/manufactured communities provide safe and decent living environments for their residents. • To ensure that the tenants and mobilehome parklmanufactured community owners work in a cooperative manner and receive inspection services in a professional and timely manner. • To ensure that any reduction in or elimination of services by the park/manufactured community owner results in an appropriate rent adjustment. • To ensure that the Mobilehome Fair Practices Commission is advised on published articles, court decisions, etc.,. relating to rent control. BUDGET HIGHLIGHT'S • The Commission will continue to be presented with a variety of complex issues related to rent control, rent increases/decreases and periodic updates on changes in California Civil Code as they pertain to rent control and related issues.
