Special Called Meeting
October 27, 1976
A Special Called Meeting of City Council was held this after-
noon in the Councilroom at City Hall hearing a request by Col.
and Mrs. Zender V. Dean for a Quit Claim from the City on their
property described as Lot 1, Block 33, Beechwood Drive, Fort
Ward.
The second purpose for which the meeting was called was
to discuss an offer made by Mr. and Mrs. William McCusker on the
property known as the "Tybrisa Property ".
The meeting was presided over by Mayor M. J. Counihan
with a qorum consisting of the following Councilmen present:
Edward J. Fahey, William C. Fleetwood, Fred de Borde, Nick
C. Alexander, Karen Losey and Jerome Bettencourt. City Attorney
W. Lance Smith was also present. Others attending the meeting
were Mr. and Mrs. William McCusker and Col. and Mrs. Zender
V. Dean.
The meeting was officially opened for the transaction of
business.
Councilman de Borde stated that at the last regular Council
meeting when the Quit Claim request by Col. Dean was discussed,
he moved that the City try to give them a buffer of 15 feet
necessary for the protection of their house. He continued by
saying that the Deansi were also to have a survey by an indepen-
dent surveyor. According to the survey dated August 18, 1976,
presented by Col. Dean, the house was built almost entirely
on Beechwood Drive. He, therefore, cannot go along with his
earlier motion due to the fact it would mean the City would be
giving all of Beechwood Drive to the Deans.
Mrs. Dean presented Council with another plat of the property
drawn up by Mr. George Oertel of the Oceanagraphic Institute
showing a more detailed description of the layout of the house
which brought about several questions from Councilman de Borde
on which plat showed the correct situation of the house.
Councilman Fahey stated that according to what he could see,
the house was not built on Lot 1. Col. Dean answered by saying
the entire area was Lot 1.

City Attorney Smith explained to Council that a warranty
deed is only as good as the person who writes it. The Deans
should enforce their warranty because goes back to the party
who gave Col Dean the warranty deed on
Col. Dean spoke saying he though Council demonstrated a
great deal of passion at the last meeting but he feels that they
are beginning to take a different course. All he asks is for
the City to grant his Quit Claim Deed.
Councilman Alexander suggested that rather than grant a
Quit Claim, Col. Dean should pay for the additional 750 to 800
square feet he is requesting quit claim on.
Councilman Fleetwood stated he feels that since the City
never dedicated Beechwood Drive they therefore have no right
to sell it because they do not own it.
Col. Dean asked that Council go ahead and vote on whether
to grant him the Quit Claim or not.
Councilman Bettencourt suggested that Col. Dean exchange a
portion of Lot 1 of comparative size for that portion of
Beechwood Drive on which the house was situated.
After a lengthy discussion, Councilman Fleetwood moved that
the City give the Deans a Quit Claim for a 15 foot buffer for
the sum of $50.00. There being no second, the motion died..
After continued discussion, Councilman Fahey moved that the
City sell the property on which the house is built for the sum of

The next item on the agenda was an offerrb yaMr. aandT rs.
William McCusker to purchase the property
Tract" on Butler Avenue. According to Councilman Q aheydthey were
willing to give the City a $5,000.00 downpayment
and were asking for a 90 day option. At the end of the 90 days
if they could not come up with the remaining balance of $205,000.00
the City would keep the binder.
At this time City Attorney Smith read a Resolution authorizing
Mayor M. J. Counihan to sign the proposed contract with Mr. and
Mrs. William McCusker.

Following the reading of the Resolution, Councilman Fahey
made a motion that the Resolution be adopted as read. The motion
was seconded by Councilman de Borde and unanimously carried.
Councilman Alexander asked that it be made clear that the
parking lot between 14th and 15th Streets remained with the
City and also asked that the small street running behind the
Wilson Hotel on 16th Street be left open for use by the Police
and Fire Departments. This was agreed to by the McCuskers.
City Attorney Smith presented to Council the contracts between
the City of Savannah Beach, architects, engineers and the U.S.
Department of Commerce on projects for Title I of the Local Public
Works Capital Development and Investment Act. The contracts were
as follows:
1. Between the City of Savannah Beach and Meyer - Gray
Architects for the Municipal Building Project.
2. Between the City of Savannah BEach and J. Paul Hansen
Architects for the Bathhouses Project.
3. Between the City of Savannah Beach and Thomas and Hutton
Engineering Company for the Paving Project.
4. Between the City of Savannah Beach and Thomas and. Hutton
Engineering Company for the Storm Water Pumping Stations
Project.
5. Between the City of Savannah Beach and Thomas and Hutton
Engineering Company for the Parking Lot Project.
Mr. Smith stressed that the City was under no obligation
to come up with any money unless the contracts were accepted
and we received the funds. The fees quoted in the contracts
are in line with current fees for such services.
Councilman Fleetwood made a motion to accept the contracts.
The motion was seconded by Councilman Fahey and unanimously carried.
At this time Councilman Alexander stated that he and several
members of Council had met at 16th Street to discuss his proposal
of making changes in the parking situation and traffic flow.
Councilman Fahey stated that if this was approved, it would
be necessary that a Policeman direct traffic every weekend at
the corner of 16th and Butler Avenue. This was agreed to by all.

Councilman Fleetwood made a motion to go ahead with the
change. The motion was seconded by Councilman Losey and
unanimously carried.
Councilman Fleetwood then brought up the Ordinance, which
was read at the last regular meeting, for changing the schedule
of licensing utilities. He stated the only change that has
been made since the first reading was changing the minimum . pay-
ment to $1,500.00.
At this time he made a formal motion to adopt the Ordinance
which was seconded by Councilman Alexander and unanimously carried.
Mayor Counihan again presented the Personnel Ordinance to
Council stating that he felt it should be completely abolished
and the running of the town back to the hands of the Mayor and
Council.
Councilman Fleetwood explained that doing away with the
Ordinance would bring about unionization because the employees
need some type of representation. He suggested that the Ordinance
be revised, not abolished.
Councilman de Borde suggested the Mayor appoint a committee
for the purpose of reviewing the Personnel Ordinance and then
presenting any changes before the Council. .Mayor Counihan asked
each member of Council to read the Ordinance thoroughly in order
that it can be handled at the December meeting.
City Attorney Lance Smith read a Proclamation declaring the
second week of November as Youth Appreciation Week.

process of electing a child Mayor and Council.
Councilman Alexander made a motion that the Proclamation
be accepted as read. This motion was seconded by Councilman
Losey and unanimously carried.
There being no further business, the meeting was adjourned
till the next regular or special called meeting.

big part you played in making our "Youth Apprecia-
tion Week" project a real success.
We feel that the Honor Youth Mayor and the
six Honor Council Members that attended the regular
Council meeting will be better informed citizens
and voters as a result of the courtesy which you
showed them.
You have been a real friend to the Optimist
Club and to the children who live or go to school
at the beach and we wanted to let you know that
we appreciate it.

"YOUTH APPRECIATION WEEK" PROCLAMATION
WHEREAS, the vast majority of the youth are concerned,
knowledgeable and responsible citizens, and
WHEREAS, the accomplishments and achievements of the
young citizens deserve recognition and praise of their elders,
and
WHEREAS, Optimist International has since 1954
developed and promoted a program entitled Youth Appreciation
Week, and
WHEREAS, the citizens of Savannah Beach, Georgia
have indicated a desire to join with the Optimists in expressing
appreciation and approval of the youth, I, M. J. Counihan,
Mayor, therefore proclaim the second week of November a Youth
Appreciation Week in Savannah Beach, Georgia. By this action,
let it be known that we have faith in the ability of today's
youth as they assume responsible roles in the future of Mankind.
