WHEREAS, theTown has heretofore adopted a policy in re-
Bardto water line extensions into areas where there are no
water facilities available and whereas, said policy of the
Town has been for the Town to, at its cost, install the first
one hundred (100) feet of the said line extension and. the
developer pay for the installation of the remainder of the
line extension necessary in the area; and
WHEREAS, the developer has requested the extension for
the first one hundred (100) feet in the name of an owner to
whom the said lot had been sold prior to the request and
whereas at a later date a request has been made for the exten-
sion of an additional one hundred (100) feet at the expense of
the Town; and.
WHEREAS such procedure and similar procedure violates the
spirit of the Town's regulations and whereas the Board of Alder-
men desires to further establish its policy in regard to line
extensions, Alderman introduced a Reso-
lution and made a Motion that it be adopted. The Motion was
seconded by Alderman. , and the Motion
carrying with it the adoption of the Resolution prevailed by
the following vote:

The Resolution as adopted is as follows:
RESOLUTION
By the Town Council of the Town of Richland.
Hills, Texas providing that the Town will
agree to make water line extensinns into any
given area of the first one hundred (100) ft.
at the expense of the Town; Providing further
that all further extensions in said given
area that the expense be borne by the Develop-
er, Owner or Owners.
THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL: OF THE TOWN
OF RICHLAND HILLS, TEXAS:

(1) That the Town hereby agrees that in any area wherein
present water facilities are not installed that upon applica-
tion the Town , at its expense, install the first one hundred
(100) feet of said extension.
(2) That any further extension other than provided in
Section (1) hereof the expense of making the extension shall
be borne by the applicant for such service.
(3) That the areas in which there are no present water
facilities available are,for the purpose of this resolution,
defined and described as those areas which are contiguous to
an area where water facilities are now available and the said.
area shall include all of the property and/or land that is
contiguous with any portion of an area in which no water fac-
ilities are at present available, whether such area in which
there are at present no water facilities available is owned
by one or more corporations, firms, associations or persons
and whether line extensions requests are made by one or more
corporations, firms, associations or persons and whether such
request for extensions are made at the same time or at a sub-
sequent date, it being the declared intention of this resolu-
tion that in any of the areas where no water facilities are
presently available, that the Town will be responsible only
for one one -hundred foot (100) extension of its water facil-
ities into the entire area.
ADOPTED AND APPROVED this 7th day of October, 1955.
