HomeMy Public PortalAbout2000-06 Authorizing to execute the proposal with Agile Courts Construction Company re Tennis Courts at Calusa ParkRESOLUTION NO. 2000-6 A RESOLUTION OF THE VILLAGE OF KEY BISCAYNE, FLORIDA; AUTHORIZING THE VILLAGE MANAGER TO EXECUTE A PROPOSAL WITH AGILE COURTS CONSTRUCTION COMPANY TO REPAIR AND RESURFACE THE TENNIS COURTS AT CALUSA PARK, AND INSTALL ONE BASKETBALL GOAL AND LINE A HALF COURT AREA FOR THE AMOUNT OF $14,380; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Resolution 99-27 (Case No. 95-23701 CA 01) between the Village of Key Biscayne and Miami -Dade County insures that the tennis courts at Calusa Park will remain for at least the next five years; and WHEREAS, these courts are in a state of disrepair and require immediate attention; and WHEREAS, a basketball hoop at Calusa Park would permit recreational opportunities lost when the prior hoop was removed; and NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF KEY BISCAYNE AS FOLLOWS: Section 1. The Village Council authorizes the Village Manager to enter into the attached Agreement. Section 2. That the Village Manager and the Village Attorney are authorized to take any and all action necessary to implement the Agreement. Section 3. That the Agreement, in substantially the form attached hereto, is hereby approved and the Manager is authorized to execute the agreement on behalf of the Village. Section 4. Funds are available in the Capitol Improvement Fund to finance this project in an amount not to exceed $14,000. Section 5. This resolution shall take effect immediately upon adoption. LICENSED INSURED 7335 S.W. 104 STREET • MIAMI, FLORIDA 33156 • PHONE (305) 667-1228 • FAX (305) 667-6959 WORK TO BE PERFORMED Resurfacing of four tennis courts Calusa Park Key Biscayne AGREEMENT CUSTOMER Village of Key Biscayne 85 West McIntyre Street Key Biscayne, Florida 33149 Agreement made between Agile Courts Construction Company hereinafter called the Contractor and Village of Key Biscayne hereinafter called the Customer for the resurfacing of four tennis court(s) with respect to the following terms and specifications: BASE Area to be approximately: (2) 120 ft. by 120 ft. existing courts. The Customer will pressure clean court(s) as necessary. The Contractor will patch damaged areas and existing cracks as best possible prior to surfacing. SURFACING The Contractor will surface the court(s) as follows: (3) coat(s) LAYKOLD Colorcoat Concentrate (green and red). Two-tone surface, inbound and apron, with full individual color through each color coat, is included in the fee below. The Contractor will paint two inch white playing lines to meet U.S.T.A. specifications (three inch base lines). COURT ACCESSORIES The Contractor will install net posts to exceed U.S.T.A. specifications. Posts are 3 inch O.D. heavy duty galvanized steel, with green or black polyurethane powdercoat finish. New net posts are set in existing sleeves. OPTION: The Contractor will furnish and install (1) PR -52 BISON gooseneck goal and line for half -court basketball. Add $1,580.00 to fee below. FEE The Contractor agrees to provide tools, materials, labor, supervision, and insurance to complete the above work for a sum of $12,800.00. All prices are in U.S. Dollars. This proposal is dated December 28, 1999. PROVISIONS The Customer agrees to a final payment of $12,800.00 within ten days after completion of above work. CONDITIONS The Contractor is not responsible for underground that is not marked. The Customer will furnish access to the site for equipment and materials. The Customer agrees to provide a clean water supply and an electrical feed at job site for construction purposes. The Contractor accepts no responsibility for acts by anyone at job site except for those sub -contracted or employed by Agile Courts Construction Company. GUARANTEE The Contractor guarantees all work against defects in workmanship or materials for a period of one year. (Contractor cannot guarantee against cracks reflecting through the new surface.) The Contractor accepts no responsibility for repairs done by anyone except Agile Courts Construction Company. CREDIT If the Customer does not pay as agreed upon, the Contractor shall have the right to file a lien against the real estate for the amount of the work done. No further work shall be accomplished if installment - ments are not made at the time specified. In the event it is necessary to employ the services of an attomey to se urea payment, as per the terms of this agreement, then the Customer agg ee3 to pay ream i ible iney fees.
