Savannah Beach, Georgia
November 10, 1976
The regular called meeting of the Mayor and Council
of the City of Savannah Beach was held this afternoon in the
Council Chambers of City Hall at 3:30 P.M. The meeting was
presided over by Mayor M. J. Counihan with a quorum consisting
of the following Councilmen present: Edward Fahey, Jerome
Bettencourt, Karen Losey, Nick Alexander, Fred DeBorde and
Bill Fleetwood. City Attorney Lance Smith was also present.
Also present were the childrens Mayor and Council elected
by their schools for Youth Appreciation Week. They were as
follows: Brian Hendricks, Mayor, Angel Hosti, Kathy Hood,
Patrick Nelson, Chris Odom, Christina Boyd, Sean Williams and.
Katryn Anderson as Council.
Before the meeting was officially opened, Mayor Counihan
presented a problem to the young Mayor and Council, that
being that they must decide whether the elections should
continue to be held in the City Hall or moved to the schools.
If moved to the schools it would involve closing them for
a full day, thus, giving the children a holiday.
A motion was made by Sean Williams to leave the elections
as they are at City Hall. This was seconded by Chris Odom
and unanimously carried.
There being no further business for the children, this
portion of the meeting was closed by Mayor Hendricks.
At this time, Al "Rooster" Williams appeared before Council
repeating a request he had made in the past for a stop sign
at Second and Miller. He offered to pay for the stop sign
if Council would have it installed. He also requested Council
to approve some fill dirt in the same location. These requests
were seconded by Mrs. Stella Case. Mayor Counihan turned
these matters over to Councilman Alexander for his handling.
Mr. J. A. Yarborough wished to go on record stating that
during any heavy rain his yard is flooded.
Mr. W. A. Brogdon appeared describing a problem he has
been having of sewerage backing -up into his house at #91
Cedarwood Drive. He also complained of an overgrown lot near
him that is owned by Lawton Daley. Mayor Counihan turned the
sewer problem over to Councilman DeBorde for his handling and
directed Mr. Brogdon to the City Hall on the overgrown lot.

Mr. Sam Whittington, #24 Lew;;; Avenue, asked that the speed
limit signs on Lewis Avenue be rry aced as the present signs were
either knocked down or too faded out to see. The matter
was turned over to Councilman Alexander of the Department
of Public Works.
Mrs. Irene Williams again aeared before. Council asking
that Council please do something about the storm drain running
through he property. She stated ;:hat she no longer can give
easement on the south side of her property as the contractors
who repairing the seawall have gcle and she had offered to
give the easement only while they were there and the yard was
dug up from construction. She aced that as long as the storm
drain ran through 50 feet of her property, she could never
build on top of it.
The Mayor and Council assure.,i Mrs. Williams that they were
studying the situation and were t; -ying to resolve it.
The meeting was opened for t-he transaction of business
legally presented.
The first item was the second reading of an ordinance
amending the Savannah BEach Zoning Ordinance by changing the
square footage requirements for multi- family housing and cor-
recting a typographical error. 1she Clerk read the ordinance
as follows:

Following the reading of the- ordinance, Councilman
DeBorde moved that the ordinance _be adopted as read. The
motion was seconded by Councilman-. Alexander and carried on
a vote of five (5) for the adopt__ cm and one abstention,
that being Councilman Fleetwood.
Councilman Fleetwood explain: ed to Council that he had
made an extensive study on group insurance for the City's
employees but felt Council should hold this matter in abeyance
until anew Personnel Policy is e- stablished. This was agreed
to by all.
Councilman DeBorde stated to Council that he felt that
every house, whether a duplex or whatever, that is tied into
the City's water system, should - >e required to install a water
meter. He moved that the City WI-te each of the people who
are not metered at this time and explain that they are required
to do so. Councilman Fleetwood ::'made a motion to amend the
original motion to say all house,; that are not metered should
be required to install a meter i___ practical. The motion
with the amendment was unanimously
carried.

Councilman Alexander stated that as the Council was aware,
he was interested in having directional street signs installed
on Butler Avenue directing traffic to the beach front parking
lots. He moved that the City write to Mr. T. S. McKenzie of
the State Department of Transportation on the feasibility of
the State of Georgia installing the signs. The motion was
seconded by Councilman DeBorde and unanimously carried.
At an earlier meeting, Councilman Alexander had proposed
that Council designate the beach area north of 18th Street as
a surf - fishing area with no swimming allowed. City Attorney
Lance Smith read two ordinances on the proposal which read as
follows:
TWO ORDINANCES
Following the reading of the ordinances, Councilman
Alexander moved their adoption. The motion was seconded by
Councilman Fleetwood and unanimously carried.
Councilman Fleetwood stated that a franchise agreement with
Savannah Electric and Power Company was not completed, but
that it would be in its final form in time for the December
agenda meeting.
Councilman Alexander presented a schedule of Housing
Inspections and a fee schedule he had received from the
Chatham County Health Department. Councilman Deborde moved
that the agreement with Chatham County Health Department be
re- established based on the Schedule of Inspections and
fee schedule. The motions was seconded by Councilman Losey
and unanimously carried.
At this time Mayor Counihan had the Clerk read a Resolution
stating that the City of Savannah Beach endorses the re-
establishment of passenger rail service on a north to south
corridor which would bring rail service from Chicago through
Atlanta and Savannah to Miami. The Resolution read as follows:
RESOLUTION
A motion to adopt the Resolution as read was made by
Councilman Alexander. It was seconded by Councilman Fahey
and unanimously carried.
City Attorney Smith stated it was his understanding that
the Council had several revisions in the City Charter they
would like to present to the General Assembly in January,
as well as a bill for the sale of liquor on Sundays. He
proposed that the Mayor appoint a committee to work up the
revisions and submit them to Council for approval. There

being no objections, the Mayor so ordered.
Chief John Price appeared before Council representing
the Marine Rescue Squadron who were requesting a telephone
to be installed on the outside of the meeting house at Chimney
Creek. He proposed that it would be enclosed in a locked
box and only certain people would be issued a key. After
some discussion, it was decided a more extensive study was
needed.
There being no further business, the meeting was adjourned
to the next regular or special called meeting.

AN ORDINANCE OF THE CITY OF SAVANNAH BEACH,
TYBEE ISLAND, GEORGIA, PROVIDING THAT THE
CODE OF ORDINANCES, CITY OF SAVANNAH BEACH,
TYBEE ISLAND, GEORGIA, BE AMENDED BY REVIS-
ING ARTICLE V, SECTION A, PARAGRAPH 11 OF
APPENDIX A OF SAID CODE: PROVIDING FOR THE
CORRECTION OF A TYPOGRAPHICAL ERROR AND TO
CHANGE THE SQUARE FOOTAGE REQUIREMENTS FOR
MULTI - FAMILY HOUSING.
BE IT ORDAINED by the Mayor and Council of the City
of Savannah Beach, Tybee Island, Georgia, that: Article V,
Section A, Paragraph 11 of Appendix A, of the Code of Ordi-
nances of the City of Savannah Beach, Tybee Island, Georgia,
be amended so that such Article shall read as follows:

NUMBERED, CHAPTER 13, PARKS AND
RECREATION, SECTION 13 -15; PROVIDING
FOR A PENALTY FOR VIOLATION OF THE
ORDINANCE DESIGNATING CERTAIN AREAS
AS SURF- FISHING AREAS, CHAPTER 13,
PARKS AND RECREATION, SECTION 13 -14
BE IT ORDAINED by the Mayor and Council of the
City of Savannah Beach, Tybee Island, Georgia, that the
Code of Ordinances of the City of Savannah Beach, Tybee
Island, Georgia, be amended by adding a Section to be
numbered Chapter 13, Section 13 -15, to read as follows:
Any person who shall swim or bath in the
area that has been designated as a surf -
fishing area shall be punished as provided
in Section 8 -1 (Ord. of 8- 14 -68, §3)
It is the intention of the governing body, and it
is hereby ordained the Code of Ordinances, City of Savannah
Beach, Tybee Island, Georgia, may have its sections renumber-
ed to accomplish the addition of this ordinance.
This ordinance shall be in full force and effect
immediately upon its adoption. All ordinances or parts of
ordinances in conflict herewith be and the same are hereby
repealed.

BE IT ORDAINED by the Mayor and Council of the
City of Savannah Beach, Tybee Island, Georgia, that the
Code or Ordinances of the City of Savannah Beach, Tybee
Island, Georgia, be amended by adding a Section to be num-
bered Chapter 13, Section 13 -14, to read as follows:
It shall be unlawful to swim or bath in the
area of the beach beginning on the south
side of 18th Street as projected and thence
running in a southerly direction along the
strand to the corporate limits of the City
of Savannah Beach, Tybee Island, Georgia,
which is the southern boundary. The water
in this area is to be used exclusively for
surf - fishing.
It is the intention of the governing body, and
it is hereby ordained the Code of Ordinances, City of
Savannah Beach, Tybee Island, Georgia, may have its sections
renumbered to accomplish the addition of this ordinance.
This ordinance shall be in full force and effect
immediately upon its adoption. All ordinances or parts of
ordinances in conflict herewith be and the same are hereby
repealed.

RESOLUTION
WHEREAS, the Congress of the United States in its
wisdom has enacted legislation cited as the Rail Passenger Act
of 1970: to provide inter -city rail passenger service as a
vital part of a balanced transportation system; to require im-
provement in rail passenger service, that such service can help
to end congestion on our highways; that the traveler in America
to the maximum extent possible should have the freedom to choose
the mode of travel best suited to his needs, and
WHEREAS, the growth and progress of Savannah Beach as
an ocean resort city has always been and is profoundly influenced
by transportation, and
WHEREAS, this locality and surrounding area has access
to rail passenger facilities at Savannah, Georgia, the present
rail passenger service available being principally between New
York and Florida, and
WHEREAS, the establishment of rail passenger service
between major cities of the coastal area of Georgia and Macon,
Atlanta, Chattanooga, Nashville, Chicago, and the pricipal inter-
mediate cities would reinstate the service of the Savannah -
Atlanta "Nancy Hanks "; would serve the public need, the public
safety and convenience; and in light of the present unfavorable
energy situation would readily be welcomed by the citizens of
Savannah Beach and the entire coastal area of Georgia, and
WHEREAS, the proposed inter -city route corridor through
the state of Georgia from Atlanta to Macon and thence turning
eastward toward the Georgia -South Carolina boundary into Savannah
and the developing coastal area of Georgia would provide certain
specific advantages over other routes through Georgia from a
revenue producing potential, viz:
1. Population
2. Increasing tourist industry
3. Commerce and industry on or near the route corridor
4. Permanent military bases on or near the route
corridor
5. Supporting South Carolina counties including
Hilton Head Island
NOW, THEREFORE, BE IT RESOLVED, that the Mayor and
Council of the City of Savannah Beach, Tybee Island, Georgia,
in a regular meeting assembled on this 10th day of November
1976, hereby unanimously endorse the above described rail passenger
service to improve our transportation system;
BE IT FURTHER RESOLVED, that a copy of this Resolution
be transmitted to the Honorable U.S. Senators and Congressmen
of involved Congressional districts, the Mayor and Council of
Savannah, County Commissioners, the Governor of Georgia, the
Georgia Department of Transportation, the recently appointed
U.S. Secretary of Transportation, the Coastal Area Planning and
Development Commission, the Board of Directors of the AMTRAK
Corporation, the President of AMTRAK, the General Assembly of
Georgia, and any other public interest group of concerned citizens.
