HomeMy Public PortalAbout10-10-2005 Regular Session Closed Session140 CLOSED SESSION MINUTES HILLSBOROUGH TOWN BOARD October 10, 2005 The Town of Hillsborough held a Closed Session on October 10, 2005 in the Hillsborough Town Barn. Present for the Closed Session were Mayor Joe Phelps, and Commissioners Frances Dancy, Brian Lowen, Eric Hallman, Michael Gering, and Evelyn Lloyd. Staff present were Town Manager Eric Peterson, Assistant Town Manager/Public Works Director Demetric Potts, Planning Director Margaret Hauth, Finance Director Greg Siler, Town Clerk/Personnel Officer Donna Armbrister, and Town Attorney Bob Hornik. Mayor Joe Phelps called Closed Session to Order at approximately 9:00 PM. 12.CLOSED SESSION A.Closed Session as authorized by North Carolina General Statute Section 143-318.11 (3) to meet with Town Attorney regarding potential Litigation arising from delinquent Privilege Licenses Finance Director Greg Siler reported that Privilege Licenses are to be renewed each July. After July 31st, businesses are considered delinquent. There are now 12 delinquent businesses and the Town is requesting the Board authorize Town Attorney to pursue collection. Commissioner Lowen stated that he feels the authorization to proceed with delinquent Privilege Licenses collection should be delegated to the Town Manager instead of having to be brought before the Town Board each time. The Board discussed transfer of the authorization, and agreed to give the Town Manager the authority to authorize the pursuance of delinquent Privilege License collection. ADDED CLOSED SESSION ITEM: Corbinton Commons Update The Board discussed the Corbinton Commons court decision. Town Attorney Bob Hornik stated that there is no automatic right to appeal. The Town could file for a petition of discretionary review. Most of these petitions are denied. He stated that the Board’s options are to litigate out the other two outstanding court cases Corbinton Commons now has pending, or to sit down with them and try to work out differences and find common ground, or ask the Supreme Court to take the case on discretionary review. The Board discussed their desire to pursue litigation through the Supreme Court.
